A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH REQUESTING THE ORANGE COUNTY
TRANSPORTATION COMMISSION TO ALLOCATE ORANGE COUNTY
UNIFIED TRANSPORTATION TRUST FUNDS FOR MAGNOLIA STREET
BETWEEN ADAMS AVENUE AND INDIANAPOLIS AVENUE
WHEREAS, THE Orange County Transportation Commission may
allocate funds from the Rapid Transit reserve fund to local
agencies for the improvement, construction, or repair of local
streets and roads;
The Orange County Transportation Commission approved a
twelve million dollar Orange County Unified Transportation
Trust (OCUTT) Streets and Roads Program on April 14 , 1986 , for
fiscal years 1986-87 through 1988-89;
The three-year program includes $124 ,627 .00 for the fiscal
jyear 1988-89 rehabilitation project on Magnolia Street between
Adams Avenue and Indianapolis Avenue;
In conformance with the OCUTT allocation process, the City
Council of the City of Huntington Beach requests the fund
authorized by OCUTT;
The City of Huntington Beach has designed the project
improvements in accordance with the city's design standards,
possesses right-of-way for the project in conformance with the
city' s policies and procedures , and has completed and
certified all required environmental documentation for the

project, and has awarded the project contract to R.J. Noble
Company, in the amount of $135 ,519 .00 .
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Huntington Beach hereby requests the Orange County
Transportation Commission to transfer $65 ,000 .00 to the City

of Huntington Beach, which is 90% of OCUTT ' s share of
construction and construction engineering costs, taking into
account the revised figures of the construction bid.
BE IT FURTHER RESOLVED that the City of Huntington Beach
hereby agrees to fund its share of the improvement costs in
fiscal year 1988-89 and any additional costs in excess of the
programmed OCUTT allocation of $124 ,627 .00 .
BE IT FURTHER RESOLVED that the remaining 10% in OCUTT
funds will be transferred to the City of Huntington Beach when
construction is completed and the final report on the project
is accepted by the Orange County Transportation Commission.
The City of Huntington Beach agrees to submit the final report
to the Orange County Transportation Commission within 90 days
after the city's acceptance of the improvements .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 18th
day of July , 1988 .

that the foregoing resolution was passed and adopted by the affirmative
vote of at least a majority of all the members of said City Council
at a regular meeting thereof held on the 18th day
