A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH TO WAIVE THE ADVERTISING
PROVISION OF SECTION 503 OF THE CITY CHARTER
PURSUANT TO THE AUTHORITIES GRANTED IN SECTION 614
OF THE CITY CHARTER
WHEREAS, the City Charter Section 503 requires publication
of legal notices in a newspaper selected by the council and
currently the council has selected the Daily Pilot, and
A different newspaper was used to advertise the procurement
of the contract for the Bluff Top Landscape Improvement Phase
IV. Bids were received.
The council finds that it is a matter of urgency that this
contract be awarded as soon as possible for the preservation of
life, health and property, to wit : the safety of pedestrians
and bicycle riders.
The contract must be entered into within the next month or
necessary funding through a state grant will be unavailable .
Unless the grant is received the project will not be funded, in
that the city has not appropriated the required funds to issue
the contract and no surplus of funds are available for such
appropriation.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that pursuant to the authority granted
by Section 614 of the Huntington Beach City Charter the
requirement of Huntington Beach Charter Section 503 is waived
for the procurement of the contract for Bluff Top Park
Landscaping Improvements Phase IV.

Huntington Beach at a regular meeting thereof held on the
day of December—, 1988 .
