HomeMy WebLinkAboutRedevelopment Agency - 162 4 RESOLUTION NO. 162 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON BEACH DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE ACQUISITION OF CERTAIN OIL INTERESTS IN THE CITY OF HUNTINGTON BEACH FOR PUBLIC PURPOSES, AND AUTHORIZING THE ACQUISITION OF SUCH PROPERTY BY EMINENT DOMAIN. WHEREAS, THE Redevelopment Agency of the City of Huntington Beach is proposing to take the oil interests generally located between Second and Main Streets and between Walnut Avenue and Pacific Coast Highway for public use, to wit, for the construction of a mixed use retail/residential project for the Main-pier Redevelopment Project, Phase I; and Government Code Sections 37350 .5 and 38010 and Health and Safety Code Section 33391 (b) authorize the Redevelopment Agency to acquire by eminent domain any property necessary to carry out any of its powers or functions; NOW, THEREFORE, the Redevelopment Agency of the City of Huntington Beach finds, determines and resolves as follows : 1 . That the oil interests described herein and graphically depicted in Exhibit "A-1" , are necessary for said proposed public purposes . The specific description of the property is set forth on Exhibit "A-211 , attached hereto and incorporated by reference herein. (a) The public interest and necessity require the proposed project; (b) The proposed project is planned and located in a manner that will be most compatible with the greatest public good and the least private injury, and (c) The property described hereinabove in this 162 4. resolution is necessary for the proposed project . (d) Pursuant to Section 7267.2 of the California Government Code, an offer has been made to the owner or owners of record. 2 . It is necessary that the taking of said property or interests in said real property include the above leases, mineral rights, wells and well equipment, and acquisition of such property is in the- manner which will be most compatible with the greatest public good and the least private injury. 3 . The Attorney for the Redevelopment Agency of the City of Huntington Beach is hereby authorized, directed and empowered to acquire in the name of the Redevelopment Agency of the City of Huntington Beach, a public body, all interests in and to the above described real property by condemnation under the laws of the State of California relating to eminent domain and such other proceedings as are necessary for the acquisition of said property. 4. The oil interests which are authorized for condemnation by this resolution are situated in the City of Huntington Beach, County of Orange, State of California and within Huntington Beach REST OF PAGE NOT USED 162 town lot area of a Redevelopment Project Area. LEGEND RESOLUTION NO. 161 RESOLUTION NO. 162 i . 162 EXHIBIT A - 2 WELL AND LEASE EQUIPMENT f AREA I - CAPRO DRILLSITE Resolution -162 Location and Description Lots 19 and 15 feet of Lot 17, block 102, faces 2nd Street between Pacific Coast Highway and Walnut. The surface area is 4,700 square feet. The drillsite is enclosed by a 6 foot chain link fence in fair condition with gates facing the street and alley. There are no tanks on this drillsite and the wells are located on a common 34' x 22' pad. There is a 6x6 IR gas compressor belt driven from the motor. on Wallace #1. It is believed that production from this lease is processed at a central facility located on Lot 15 of block 201 .
