RESOLUTION NO. 5977
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH APPROVING THE SETTLEMENT AGREEMENT
AND RELEASE BETWEEN CITY OF HUNTINGTON BEACH AND
ERIC AND LUCY HEXBERG
WHEREAS , on March 1, 1983 , a severe storm, coupled with high
tides and strong winds, struck the City of Huntington Beach
causing severe flooding and damage to public and private
property; and
Eric and Lucy Hexberg are owners of the Brookfield Manor and
Del Mar Mobilehome Estates, both of which are located in the
City of Huntington Beach, and located at 9850 Garfield and 19251
Brookhurst Street, respectively; and
On or about December 2, 1983, Eric and Lucy Hexberg filed a
complaint for damages, Orange County Superior Court Case No. 41
74 70 , against, inter alia, the City of Huntington Beach in
inverse condemnation, dangerous condition, nuisance and trespass
for flooding damages which occurred to the Brookfield Manor and
Del Mar Mobilehome Estates on March 1, 1983; and
The Parties believe that it would be in their respectively
best interests to settle their differences on the terms
specified in the Settlement Agreement and Release presented to
the Council in conjunction with this Resolution,
NOW, THEREFORE, the City Council of the City of Huntington
Beach hereby approves the Settlement Agreement and Release
between the City and Eric and Lucy Hexberg and other parties and
authorizes the mayor to execute such documents on behalf of the

the City.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 6th
day of February , 1989 .

that the foregoing resolution was passed and adopted by the affirmative
vote of at least a majority of all the members of said City Council
at a regular meeting thereof held on the 6th day
of February , 19 89 , by the following vote:
