HomeMy WebLinkAboutCity Council - 5989 RESOLUTION NO. 5989 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF PORTIONS OF SEVENTEENTH STREET, MANSION AVENUE, PINE STREET, AND THE ALLEYS IN BLOCKS 1901 AND 1902 LOCATED IN TRACT 12 WHEREAS, on December 19, 1988, the City Council of the City of Huntington Beach duly adopted Resolution No. 5968 declaring its intention to vacate easements for public purposes over portions of Seventeenth Street, Mansion Avenue, Pine Street, and the alleys in Blocks 1901 and 1902 located in Tract 12, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of January 17, 1989, at the hour of 7: 00 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of vacation were posted conspicuously along the easement for public purposes over those portions of Seventeenth Street, Mansion Avenue, Pine Street, and the alleys in Blocks 1901 and 1902 of Tract 12 proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted; and On January 17, 1989, at the hour of 7: 00 p.m. in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation -1- of an easement for public purposes over portions of Seventeenth Street, Mansion Avenue, Pine Street, and the alleys in Blocks 1901 and 1902 of Tract 12, at which time no objection was made to said vacation, and evidence was presented showing that said easement is not necessary for present or prospective public use and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 3, of the California Streets and Highways Code, commencing with Section 8320, does resolve that the easement for public purposes over portions of Seventeenth Street, Mansion Avenue, Pine Street, and the alleys in Blocks 1901 and 1902 of Tract 12 is not necessary for present or prospective public use, and is not suitable for development as bicycle paths or routes, and it is hereby ORDERED that the easement for public purposes over portions of Seventeenth Street, Mansion Avenue, Pine Street, and the alleys in Blocks 1901 and 1902 of Tract 12, is hereby vacated; and that such easement so vacated is more particularly described as follows : PARCEL 1: Portion of Seventeenth Street and Mansion Avenue That portion of Seventeenth Street in Tract No. 12 in the City of Huntington Beach, County of Orange, State of California, as shown on the map recorded in Book 9, Page 13 of Miscellaneous Maps in the office of the County Recorder of said County and a portion of the land described in the deeds to the City of Huntington Beach dated September 23, 1916 in Book 294, Page 390 of Deeds and dated July 21, 1950 in Book 2045, Page 79 both of Official Records in the office of the County Recorder of said County, described as follows : -2- 5989 Beginning at the most easterly corner of Lot 3 Block 2001 as shown on said map; thence North 41019100" East, 54 .43 feet along the northeast prolongation of the southeast line of said Lot 3 to an intersection with the southwesterly line of Yorktown Avenue (formerly Mansion Avenue) as shown on the precise plan of alignment for Yorktown Avenue on file in the office of the City Engineer, said intersection being a point on a curve, concave northeasterly having a radius of 850 .00 feet, a radial line to said point bears South 27011 ' 59" West; thence southeasterly 81.26 feet along said curve and said southwesterly line through a central angle of 5028 ' 39" to the beginning of a reverse curve concave southwesterly having a radius of 32 .00 feet; thence southeasterly 38 . 13 feet along said curve through a central angle of 68016 '40" to the northerly prolongation of the westerly line of Lake Street, 90 .00 feet in width, as shown on said map; thence South 84 .93 feet along said prolongation to the southerly line of Seventeenth Street as shown on said map; thence West 131.25 feet along said southerly line to the southeasterly line of said Seventeenth Street; thence South 41019 ' 00" West 1, 116 . 60 feet along said southeasterly line to the northerly line of Utica Avenue, 60 .00 feet wide; thence West 93 .20 feet along said northerly line of Utica Avenue to the northwesterly line of Seventeenth Street as shown on said map; thence North 41019 ' 00" East 1,259 . 50 feet more or less along the northwest line of said Seventeenth Street to the point of beginning .
