HomeMy WebLinkAboutCity Council - 6014 RESOLUTION NO. 6Q1 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING A JOINT PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AND THE HUNTINGTON BEACH REDEVELOPMENT AGENCY WHEREAS, the Huntington Beach Redevelopment Agency (the "Agency") has prepared a proposed Amended Redevelopment Plan (the "Plan") and a Program Environmental Impact Report (the "EIR") for the proposed Amendment No. One to the Oakview Redevelopment Project (the "Project") ; and Pursuant to the provisions of the California Community Redevelopment Law (Health and Safety Code §§33000 et seq. ) , there is a need for a joint public hearing of the City Council of the City of Huntington Beach and the Huntington Beach Redevelopment Agency and to have any interested groups and citizens be heard on the proposed Project. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Huntington Beach as follows: Section 1. The City Council of the City of Huntington Beach approves the convening of a joint public hearing with the Redevelopment Agency of the City of Huntington Beach on June 5, 1989, at 7:00 p.m. in the City Council Chambers located at 2000 Main Street, Huntington Beach, California, for the purpose of considering the Plan and EIR for the proposed Project. Section 2 . The City Clerk is hereby directed to publish in cooperation with the Redevelopment Agency of the City of Huntington Beach a "Legal Notice of the Joint Public Hearing" in a newspaper of general circulation not less than once a week for four successive weeks prior to the date of the joint public hearing. The City Clerk is further directed to mail a copy of the aforesaid notice to the last known assessee of each parcel of land within the Project Area boundaries as shown on the last equalized assessment roll of Orange County and to all taxing entities which receive a portion of the ad valorem taxes levied on properties within the Project Area. All mailings as hereinabove provided shall be by certified mail with return receipt requested. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF THE ALLEY IN THE 200 BLOCK BETWEEN MAIN AND THIRD STREETS NORTH OF WALNUT AVENUE WHEREAS, on March 20, 1989, the City Council of the City of Huntington Beach duly adopted Resolution No. 6002 declaring its intention to vacate an easement for public street purposes over the alley in Block 200 between Main and Third Streets, located north of Walnut Avenue, and referring to maps and plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of April 17, 1989, at the hour of 7:.00 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all nersons interested i- or objecting to the propos•uG Vacation, r which .time was not less than fifteen (15) days from the passage of - . this resolution. Notices of vacation were posted conspicuously along the easement for public street purposes over the alley proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted; and On April 17, 1989, at the hour of 7:00 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objectirig to the proposed vacation of an easement for public street purposes over the alley in Block 200 between Main and Third Streets, north of Walnut Avenue, at which time no objection was made to said vacation, and evidence was presented showing that said easement is not necessary for present or -1- 6014: 89-340602 prospective public use and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9 , Part 3 , Chapter 3 of the California Streets and Highways Code, commencing with section 8320 , does resolve that the easement for public street purposes over the alley in Block 200 between Main and Third Streets , north of Walnut Avenue, is not necessary for present or prospective public use, and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the easement for public street purposes over the alley in Block 200 between Main and Third Streets , north of Walnut Avenue, is hereby vacated; and that such easement so vacated is more 4 particularly described as follows : The 15 . 00 foot wide alley within Block 203 of the Huntington Beach Tract in the City of Huntington Beach, County of Orange, State of California , as shown on a map recorded in Book 51, Page 14 of Miscellaneous Maps , in the office of the County Recorder of Said County. Together with the Southeasterly 2 . 50 feet of Lot 10 of said Block 203 . Pursuant to Division 9 , Part 3 , Chapter 1 of the California Streets and Highways Code, commencing with Section 8320 , the City Council of the City of Huntington Beach hereby declares its intention to vacate for public street purposes the alley in Block 200 between Main and Third Streets , located north of Walnut Avenue, more particularly described as follows : The 15 . 00 foot wide alley within Block 203 of the Huntington Beach Tract in the City of Huntington Beach, County of Orange, State of California , as shown on a map recorded in Book 51 Page 14 of Miscellaneous Maps , in the office of the County Recorder of said County. Together with the Southeasterly 2 . 50 feet of Lot 10 of said Block 203 . NOW, THEREFORE, the City Council of the City of Huntington Beach, finds , determines and resolves as follows : 1 . The City Council does hereby fix April 17, 1989 , at the hour of 7 : 00 p .m. , or as soon thereafter as the matter may be heard in the Council Chambers of the Civic Center, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. 3 . The City Clerk is directed to cause a copy of this resolution to be published in a weekly newspaper, printed and published in the county and circulated in Huntington Beach, for at least two successive weeks prior to the time set herein for the public hearing . 4 . The Director of Public Works is directed to post or cause to be posted, notices of vacation conspicuously along the alley in Block 200 between Main and Third Streets , north of Walnut Avenue, at least two weeks before the date of the hearing . The notices shall be posted not more than 300 feet apart , but at the least, three notices shall be posted .
