A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH TO RE-ESTABLISH LOCAL ENFORCEMENT AGENCIES
TO ENFORCE STATE SOLID WASTE MANAGEMENT LAWS
WHEREAS, Section 66796 of the Government Code requires
counties to designate a local enforcement agency to carry out the
provisions of the Z 'Berg-Kapiloff Solid Waste Control Act of 1976; and
In 1980 the California Waste Management Board granted an
unrestricted designation to the local enforcement agency (LEA)
designated by the County of Orange; and
In May of 1989, notwithstanding its 1980 action, the
California Waste Management Board decided that the Orange County
local enforcement agency was not in accordance with the requirements
of Government Code Section 66796(e) and directed the Orange County
Board of Supervisors to abolish the existing LEA and designate a
County department to fill the function; and
In response to the California Waste Management Board
directive, the Orange County Board of Supervisors has voted to
abolish the existing LEA and to designate the County Health Care
Agency as the Local Enforcement Agency instead; and
It is required by law that the designated enforcement agency
be approved by a majority of the cities of Orange County containing a
majority of the citizens of the incorporated areas;
NOW, THEREFORE, BE IT RESOLVED, that this Council does hereby
approve the action of the Orange County Board of Supervisors
abolishing the current LEA and designating the Orange County Health
Care Agency for Orange County.

Huntington Beach at a regular meeting thereof held on the 6th day
of November 1989 .
