HomeMy WebLinkAboutCity Council - 6304 RESOLUTION NO. 6304 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ADOPTING AND CERTIFYING ENVIRONMENTAL IMPACT REPORT NO. 90-6 WHEREAS, Environmental Impact. Report No . 90-6 has been prepared in conjunction with General Plan Amendment No. 90-9 and Zone Change No. 90-19 ; and The City of Huntington Beach was the lead agency in the preparation of the Environmental Impact Report; and All persons and agencies wishing to respond to notice duly given have been heard by the Planning Commission either through written notice or during a public hearing on June 18, 1991; NOW, THEREFORE, The City Council of the City of Huntington Beach as follows: SECTION 1: Environmental Impact Report No . 90-6 has been completed in compliance with the California Environmental Quality Act and all State and local guidelines . SECTION 2 : The City Council has considered all significant effects detailed in Environmental Impact Report No . 90-6, together with proposed mitigation measures to mitigate such effects (see Exhibit A) . SECTION 3 : Through the implementation of the aforementioned mitigation measures the potentially adverse impacts associated with the project can be eliminated or reduced to a level of insignificance. 1 SECTION 4 : The City Council of the City of Huntington Beach does hereby adopt and certify as adequate Environmental Impact Report No. 90-6 . SECTION 5 : The Planning Director is hereby authorized and directed to file with the Office of the County Clerk and the State Office of Planning and Research a notice of determination for Environmental Impact Report No. 90-6 , as required by Section 15094 of the California Environmental Quality Act Guidelines. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 15th day of Ulu 1991. MITIGATION 1 . Existing access onto Bushard Street from the project site shall be right-turn only. 2 . Access/circulation plans for development of the project area shall be approved by the Department of Public Works prior to issuance of building permits . 3 . The developer shall comply with on-site parking requirements of Article 960 . 4 . Prior to issuance of grading permit, hydrology and hydraulic studies shall be submitted for Public Works approval . 5 . A grading plan shall be submitted and approved by the Department of Public Works (prior to issuance of a grading permit) . A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works . 6 . Subsequent development shall not be allowed to drain on to adjacent properties . 7 . Construction activities shall be restricted to the hours of 7 : 00 a .m. to 8 : 00 p.m. , Monday through Saturday. Construction shall be prohibited on Sundays and Federal Holidays . 8 . Commercial development of the site shall be designed to prohibit truck deliveries in areas adjacent to residentially zoned property. 9 . Residential structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that 'lie within the 60 CNEL (or greater) contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, and shall be submitted prior to issuance of certificate of occupancy. 10 . During cleaning, grading, earth moving or excavation, the applicant shall: 6304 a . Control fugitive dust by regular watering, paving construction roads , or other dust preventive measures approved by the Department of Public Works . b. Maintain equipment engines in proper tune. 11 . During construction, the applicant shall : a . Use water trucks or sprinkler systems to keep all areas where vehicles move damp enough to prevent dust from rising when leaving the site. b. Wet down areas in the late morning and after work is completed for the day. c . Use low sulfer fuel ( . 05% by weight) for construction equipment . d . Phase and schedule construction activities to avoid high ozone days (first stage smog alerts) . e . Discontinue construction during second stage smog alerts . 12 . All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations of future development projects on the subject property. 13 . A detailed soils analysis shall be prepared by a registered Soils Engineer . This analysis shall include on-site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading , chemical and fill properties , foundations, retaining walls , streets , and utilities . 14 . An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for th subject property. All structures within this development shall be constructed in compliance with the g-factors as indicated by the geologist ' s report . Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits . 15 . Any residential development on the subject property shall be elevated so that the lowest structural member of the first habitable floor is located three feet or more above adjacent grade. 16 . Any commercial development on the subject property shall be elevated or flood proofed to three feet or more above the adjacent grade , 17 .
