A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SUPPLEMENT NO. 22 TO AGREEMENT
NO. 12-5181 FOR THE SEISMIC RETROFIT OF BRIDGES
55C-0258, 55C-0259, 55C-0282, 55C-0284, 55C-0428,
55C-0432 and 55C-0453
WHEREAS, on February 7, 1978, the City entered into an agreement with the State of
California for the Federal Aid Program, identified as Agreement No. 12-5191; and
Program Supplement No. 22 to the above mentioned Master Agreement requires the
Seismic Retrofit of Bridges 55C-0258, 55C-0259, 55C-0282, 55C-0284, 55C-0428,
55C-0432 and 55C-0453.
The total cost of such a public safety improvement program is $1,540,500.00 which
amount will be appropriated from Federal and City funds as shown on Exhibit 'B" attached.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Bea-h that the Mayor and City CIerk are authorized and directed to execute the necessary
documents to implement Program Supplement No. 22 to Master Agreement NO. 12-5181
for the Seismic Retrofit of Bridges 55C-0258, 55C-0259, 55C-0282, 55C-0284, 55C-0428,
5SC-0432 and 55C-0453.

his Program Supplement is hereby incorporated into the Local Agency-State
Igreement for Federal Aid which was entered into between the Local Agency
nd the State on 02/06/78 and is subject to all. the terms and conditions
thereof. This Program Supplement is adopted in accordance with Paragraph 3
of Article I of the aforementioned Master Agreement under authority of
Resolution No. approved by the Local Agency on
(See copy attached) .
The Local Agency further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages.

SPECIAL COVENANTS OR REMARKS
1. The Local Agency will reimburse the State for their share of
costs for work requested to be performed by the State.
2. The Local Agency will utilize the structural plans,
specifications and estimates (PS&E) provided by the State and
will be responsible for completion of the non-structural PS&E and
for preparation of the contract documents, , and for
advertisement, award and administration of this project.
3 . The local Agency agrees the combined payment of Federal (HBRR)
and State (SB 36X) funds will be limited to seventy percent (705Z)
of the total eligible seismic safety retrofit portion of the
project cost as indicated in the FNM-76.
4. The Local Agency agrees to pay thirty percent (30a) of the total
federally eligible seismic safety retrofit portion of the project
cost including eligible overhead and other federally
nonreimbursable costs in. accordance with Senate Bill No. 1742 .
5. Federal funds (CRP) , if used to pay the thirty percent (30%)
share of eligible project costs, either in part or in full, will
be limited to the amount indicated on the FNM-76 .
6. Unless otherwise agreed to in writing, the total eligible project
cost will be limited to no more than a twenty five percent (25%)
increase of the amount shown in this agreement.
7. The Local Agency agrees to advertise the project no later than
six (6) months after receipt of the structural plans,
specifications and estimates from the State.
S. The Local Agency agrees to use their own funds to pay for any
portion of the project not eligible under the Seismic Safety
Retrofit Program.
9 . The dollar value difference between the amount shown in the
"Federal Funds" field and the amount certified on page one of
this Program Supplement shall be automatically funded when
sufficient funds are made available upon approval of the
Annual State Budget.
10. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Program.
11. Whenever the local agency uses a consultant on a cost plus basis,
the local agency is required to submit a post audit report cover-
ing the allowability of cost payments for each individual consul-
tant or sub-contractor incurring over $25, 000 on the project.
The audit report must state the applicable cost principles utili-
zed by the auditor in determining allowable costs as referenced in
CFR 49, part 18, Subpart C - 22, Allowable Costs.
