A RESOLUTION OF THE CITY OF HUNTINGTON BEACH DECLARING ITS INTENTION TO ESTABLISH A PARKING AND BUSINESS IMPROVEMENT AREA TO BE KNOWN AS THE HUNTINGTON BEACH DOWNTOWN BUSINESS IMPROVEMENT DISTRICT WHEREAS, the Parking and Business Improvement Area Law of 1989 , codified at Streets and Highways Code § 36500 et seq. (the "Act") authorizes cities to establish parking and business improvement areas for the purpose of imposing benefit assessments on businesses for certain purposes; and Business owners in downtown have requested this City Council to establish such an improvement area. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and find as follows : SECTION 1. The City Council of the City of Huntington Beach hereby declares its intention to establish a parking and business improvement area named the Huntington Beach Downtown Business Improvement District (the "District") pursuant to the Act . SECTION 2. The proposed boundaries of the District, including the designation of separate benefit zones, are set forth in Exhibit A and incorporated herein by reference. SECTION 3 . The proposed uses to which the revenue from the District will be put are the following improvements and activities : -1- a. General promotion of business activities within the District. b. Promotion of public events which are to take place on or in public places in the District . C. Decoration of any public place in the District. d. Furnishing of music in any public place in the District. e. Other activities which benefit businesses located and operating within the District. SECTION 4 . The City Council intends to levy a benefit assessment on all businesses, trades and professions, including new businesses, located within the boundaries and benefit zones, as applicable, within the Oistrict, as shown in Exhibit A hereof, in the amounts set forth on Exhibit B hereof, which is incorporated by reference herein. SECTION 5 . Except where funds are otherwise available, an assessment to pay for all specified improvements and activities within the District will be levied annually following a public hearing and adoption of a resolution by the City Council . SECTION 6 . A public hearing shall be held before the City Council on _ March 2. 1999 at 7:00 _ p.m. , or as soon thereafter as this mat�Ler may be heard, in the Council Chambers of the City Hall, 2000 Main Street, Huntington Beach, California, at which time the Council will hear all interested persons for or against the establishment of the District, the -2- extent of the District, and the furnishing of specified types of improvements or activities. Protests may be made orally or in writing but if written, shall be filed with the City Clerk at or before the time fixed for the hearing and contain sufficient documentation to verify business ownership and validate the particular protest. If written protests are received by the owners of businesses within the District which will pay 50% or more of the total assessments to be levied, no further proceedings to establish the District shall be taken for a period of one year from the date of the finding of a majority protest by the City Council . If the majority protest is only against the furnishing of a specified type or types of improvements or activity within the District, those types of improvements or activities shall be eliminated. SECTION 7. SECTION 8 . The City Clerk has caused this resolution of intention to be published Once in a newspaper of general circulation in the city at least seven days before the public hearing. -3- 6341 f 4 SECTION 9 . The City Clerk shall mail a complete copy of this resolution of intention by first-class mail to each business owner in the area within seven days after the Council ' s adoption of this resolution. SECTION 10 . This resolution shall take effect immediately upon adoption.
