HomeMy WebLinkAboutCity Council - 6454 RESOLUTION NO. 6454 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING UNDERGROUND UTILITY DISTRICT ON BEACH BOULEVARD BETWEEN EDINGER AVENUE AND THE 405 FREEWAY DISTRICT NO. 92-2 WHEREAS, by Resolution. No. 6445, .a public hearing was called for November 16, 1992, at the hour of 7:00 p.m., or as soon thereafter as the matter could be heard, in the Council Chambers of the Civic Center, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service to an underground utility district comprised of property within the public right of way on Beach Boulevard between Edinger Avenue and the 405 Freeway; and Notice was given to all affected property owners and utilities concerned in the manner and for the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby finds and determines that the public necessity, health, safety and ,velfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within that area more particularly described as the property within the public right-of-way on Beach Boulevard between Edinger Avenue and 405 Freeway, which is hereby established as Underground Utility District No. 92-2. BE IT FURTHER RESOLVED that the City Council of the City of Huntington Beach finds that: (a) Such underground will avoid or eliminate an unusually heavy concentration of )verhead transmission facilities; and (b) Said streets and boulevard are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. -1- BE IT FURTHER RESOLVED that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district no later than July 31, 1994 by all affected utility companies. BE IT FURTHER RESOLVED that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of the Huntington Beach Municipal Code Chapter 17.64 to affected property owners, if any, as shown on the last equalized assessment roil, and to the affected utilities. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting therefor held on the 7th day of December, 1992.
