A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTI NGTON BEACH OPPOSING BR3636,
THE NATIONAL COMMUNICATIONS COMPETITION
AND INFORMATION INFRASTRUCTURE ACT OF 1994
WHEREAS, the Congress of the United States is currently considering HR3636, the
National Communications Competition and Information Infrastructure Act of 1994; and
The City Council desires to establish and communicate its position regarding the Act,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. That the City of Huntington Beach opposes HR3636, The National
Communications Competition and Information Infrastructure Act of 1994 in its current fonn.
This bill would preempt cities and counties from requiring a franchise fee for a telephone company
that enters into cable TV services. The legislation would also reduce franchise and other fees that
local governments now collect and would otherwise collect in the future as compensation for use
of the local public rights of way by telecommunication providers.
2. That such franchise fees are used to support basic local governmental services to
our residents, and such franchise fees are used to support our local governnnent access channel
which is an invaluable resource for informing our citizens.
3. That an attempt to by-pass the House Rules Committee, and eliminate any
opportunity for amendments by members on the House Floor is underway. We urge our
Representative, Congressman Dana Rohrbacher, to oppose this effort and attempt to get five
fellow members of Congress to oppose it as well.

1, CONNIE BROCKWAY, the duly elected, qualified City Clerk of
the City of Huntington Beach, and ex-officio Clerk of the City Council of said
City, do hereby certify that the whole number of members of the City Council of
the City of Huntington Beach is seven; that the foregoing resolution was passed
and adopted by the affirmative vote of at least a majority of all the members of said
City Council at an adjourned regular meeting thereof held on the
21 st of June,1994, by the following vote:
