HomeMy WebLinkAboutRedevelopment Agency - 253 RESOLUTION NO. 2S- A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON BEACH ADOPTING AN IMPLEMENTATION PLAN FOR THE ESTABLISHED IN-LIEU FEE FOR PARKING WHEREAS, the Downtown Specific Plan provides that parking requirements for non-conforming uses or structures may be met by payment of an "in-lieu" fee; and The City Council of the City of Huntington Beach has established an annual in-lieu parking fee for implementation of the Downtown Specific Plan to facilitate traffic and pedestrian movement in the future; and A plan for implementation and allocation of the fees is necessary to effectuate the program. NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of Huntington Beach as follows: SECTION 1. The following measures are hereby approved and adopted for implementation of the in-lieu parking fee program: 1) Any property owner who requests to participate in the In-Lieu Parking Fee Program shall submit a request in writing for review by the Redevelopment Agency, after action by the Zoning Administrator, Planning Commission or City Council, as required. 2) The parking fee will be established by the City Council. In establishing the fee, the City Council/Agency will address amount, payment terms, contributions by the City/Redevelopment Agency, time of payment, and other terms and conditions. 1 sl\inlieu\82793 3)' The first in-lieu fee per space payment due shall be paid by the property owner prior to issuance of a Certificate of Occupancy or building permit, whichever occurs first. Subsequent annual payments shall be made by the property owner upon the one-year anniversary of the first payment. 4) Payment of the fee shall be the responsibility of the property owner and may be made in lump sum or in annual payments. A lien in the amount of the unpaid balance may be placed on the property. 5) The number of in-lieu fee spaces purchased shall not be in excess of the number required for an approved use. 6) For any property owner with an Agency approved agreement, business-to-business transfers (i.e., tenant to tenant) located on the same parcel and/or suite will be permitted if the number of parking spaces required does not increase. 7) Evidence of City/Redevelopent Agency approval, (such as covenant or agreement), of the in-lieu fee participation for each business must be provided prior to issuance of a Certificate of Occupancy or building permit, whichever comes first. 8) The in-lieu fee parking fee applies gnly to private property development not publicly owned land. (9) All fees collected from the property owners and the Agency's contribution, if any, shall be deposited into a dedicated parking fund to be used for creating opportunities for additional parking (i.e., valet, restriping, etc.) or construction of surface or structured parking in the downtown area. 2 sl\inlieu\82793 SECTION 2: The in-lieu parking fee measures, as indicated above, are based upon negotiations with the property owners as to type of use (e.g. retail or restaurant), payment of a fee depending upon the number of spaces needed and an agreement or covenant with the Agency placed as a lien on the property to ensure payment of the fee over fifteen years if a lump sum payment is not made. SECTION 3: The Director of Economic Development is authorized to execute all documents necessary to effectuate the above implementation measures.
