RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE
CITY OF HUNTINGTON BEACH APPROVING THE
CONVEYANCE OF REAL PROPERTY AND ACCEPTANCE
OF THE GRANT DEED BETWEEN THE REDEVELOPMENT AGENCY
OF THE CITY OF HUNTINGTON BEACH AND THE CITY OF
HUNTINGTON BEACH FOR PROPERTY IN THE DOWNTOWN
PARKING STRUCTURE
WHEREAS, the Redevelopment Agency of the City of Huntington Beach
(the "Agency") is authorized to conduct redevelopment activities within the Main-
Pier Redevelopment Project Area (the "Project Area") which activities include the
disposition of real property for repayment of Agency debt; and
The transfer of property to the City of Huntington Beach in the Downtown
Parking Structure was found to be in conformance with the General Plan on
March 1, 1994 (General Plan Conformance 94-1); and
The Agency and the City Council of the City of Huntington Beach ("City
Council") have conducted a duly noticed joint public hearing regarding the
proposed transaction in accordance with California Health and Safety Code
Sections 33431 and 33433, and
The staff report pertaining to the property disposition which has been on
display prior to the joint public hearing,in accordance with Section 33433 of the
California Health and Safety Code, contains a detailed description of the
transaction; and
The acquisition of the Agency's property by the City will facilitate
redevelopment efforts within the Main-Pier Redevelopment Project Area.
NOW, THEREFORE, the Redevelopment Agency of the City of
Huntington Beach does hereby resolve as follows:

Section 1. The Redevelopment Agency of the City of Huntington Beach
hereby approves the transfer of the property identified as Unit A as shown on the
condominium plan (the "Plan") recorded April 10, 1991 as instrument no. 91-
168227 of official records of Orange County, California and also, an undivided
fifty percent (50%) interest in and to that portion of Lot 1 of Tract no. 14133, as
shown on a map filed in Book 674, pages 46, 47 and 48 of Miscellaneous Maps,
Records of Orange County, California, defined as "common area" in the Plan
and in the Declaration of Covenants, Conditions and Restrictions for Main Pier
Parking Facility ("CC&Rs") recorded April 10, 1991, as instrument 91-168226 of
Official Records of Orange County, California.
Section 2. The Redevelopment Agency of the City of Huntington Beach
finds and determines, based upon the testimony and information presented
during the public hearing with respect to the disposition that the consideration
for the real property to be transferred to the City by Deed constitutes the fair-
market value thereof determined by the highest use permitted under the
Redevelopment Plan for the Project Area and based upon the covenants and
restrictions previously established. The Redevelopment Agency further finds
that the disposition is necessary to effectuate the purpose of the Redevelopment
Plan applicable to the Project Area.
Section 3. Pursuant to Section 15326 of the Guidelines to the
California Environmental Quality Act, the transfer is categorically exempt under
CEQA.
Section 4. The Agency hereby authorizes the Chairman or the
Executive Director to execute the Grant Deed and all documents necessary to
effectuate the transfer.

foregoing resolution was duly adopted by the Redevelopment Agency of the City

3rd day of October 1994, and that it was do adopted by the
