A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH OPPOSING SENATE BILL 1896
AND ENDORSING ASSEMBLY BILL 3154
WHEREAS, the City of Huntington Beach is faced with a growing problem of utility
pavement cuts, due to resultant reduction in pavement life; and
The advent of the information super highway will cause this problem to multiply in the
next few years, due to the vast number of telecommunications providers; and
Senate Bill 1896, sponsored by State Senator Costa, seeks to deny cities the ability to
require fair and reasonable compensation from telecommunications purveyors by providing that
the fees cities may charge for telecommunications facilities shall not exceed the amount
reasonably required by local enforcement agencies to issue permits and the fees shall not be levied
for general revenue purposes; and
Assembly Bill 3154, sponsored by Assemblyman Martines, proposes to allow local
agencies to franchise telephone companies in public rights-of-way and collect fees; and
The City desires the ability to make reasonable charges for utility pavement cuts in order
to cover the cost of trench repairs;
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
SECTION 1. Senate Bill 1896 is hereby opposed.
.SECTION 2. Assembly Bill 3154 is hereby endorsed.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 3rd day of .Tune , 1996.

I, CONNIE BROCKWAY, the duly elected, qualified City Clerk of
the City of Huntington Beach, and ex-officio Clerk of the City Council of said
City, do hereby certify that the whole number of members of the City Council of
the City of Huntington Beach is seven; that the foregoing resolution was passed
and adopted by the affirmative vote of at least a majority of all the members of said
City Council at a regular meeting thereof held on the 3rd of June, 1996 by the
following vote:
AYES: Councilmembers: Harman, Bauer, Sullivan, Dettloff, Green,
Garofalo
NOES: Councilmembers: None
ABSENT: Councilmembers: Leipzig
