HomeMy WebLinkAboutCity Council - 98-71 RESOLUTION NO. 9 8-71 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING ENVIRONMENTAL FINDINGS WHEREAS, the Redevelopment Agency of the City of Huntington Beach(the "Agency") has certified the Final Environmental Impact Report for the Merged Redevelopment Project of the City of Huntington Beach and the Final Environmental Impact Report for the Disposition and Development Agreement dated as of August 15, 1988 between the Agency and ROBERT L. MAYER, as Trustee of the Robert L. Mayer Trust of 1982 (the "DDA"); and On July 18, 1983, by Council Resolution No. 5284, the City Council of the City of Huntington Beach (the "City Council" certified the Final Environmental Impact Report 82-2 for the Downtown Specific Plan, and on August 15, 1988,the City Council certified the Supplemental Environmental Innpact Report No. 82-2 for the "Development Agreement By and Between the City of Huntington Beach and Robert L. Mayer, as Trustee of the Robert L. Mayer Trust of 1982, dated June 22, 1982, as Amended," adopted by the City Council of the City on October 3, 1988, by Ordinance No. 2962 (the "Development Agreement"), and all development contemplated thereunder; and The City Council has approved an Addendum to said Final Environmental Impact Reports and Supplemental Environmental Impact Report (the three final Environmental Impact Reports, Supplemental Environmental Impact Report, and the Addendum are referred to collectively herein as the "EIR"); and The Agency and MAYER FINANCIAL, LTD., a California limited partnership ("Developer"), assignee of certain interests of ROBERT L. MAYER, as Trustee of the Robert L. Mayer Trust of 1982 under the DDA, have conducted negotiations for an Amended and Restated Disposition and Development Agreement(the "Amended and Restated DDA") which provides for the construction of hotel and residential improvements on certain real property referred to in the Amended and Restated DDA and herein as the "Site"; and The City and Developer and THE WATERFRONT HOTEL, LLC, a California limited liability company, assignees of certain interests of ROBERT L. MAYER, as Trustee of the Robert L. Mayer Trust of 1982 under the Development Agreement, have conducted negotiations for an amended and Restated Development Agreement (the "Amended and Restated Development Agreement") which vests certain criteria for the construction and operation of the hotel and residential improvements on the Site, and Developer has submitted applications for coastal development permits and conditional use permits to effect such improvements (the "Permits"); 1 SF-98ResoLCityfdg RLS 98-585 0911 1/98-91 98-71 The project described in the EIR(the "Project") includes the construction of hotel and residential improvements on the Site; and The City Council has reviewed the EIR,the proposed Amended and Restated DDA,the proposed Amended and Restated Development Agreement, the proposed Permits, and other reports and information relevant to the findings made herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DOES RESOLVE AS FOLLOWS: SECTION 1. Neither the approval nor the implementation of the proposed Amended and Restated DDA, THE PROPOSED Amended and Restated Development Agreement, or the proposed Permits will cause a substantial change in the Project. SECTION 2. No substantial changes in the circumstances under which the Project is undertaken have occurred since the time that the EIR was certified as complete. SECTION 3. Neither the approval nor the implementation of the Amended and Restated DDA, the Amended and Restated Development Agreement, or the Permits will have a significant effect on the environment which is new or substantially more severe than the significant effects identified in the EIR. SECTION 4. No major revision of the EIR is required. SECTION 5. No new information of substantial importance to the Project has become available since the time that the EIR was certified as complete that shows that the Project as amended by the Amended and Restated DDA,the Amended and Restated Development Agreement, and the Permits will have one or more significant effects not discussed in the EIR, or that significant effects previously examined will be substantially more severe than shown in the EIR, or that mitigation measures or alternatives previously found not to be feasible would be feasible, or that mitigation measures or alternatives which are considerably different from those analyzed in the EIR would substantially reduce one or more significant effects on the environment but have not been adopted. SECTION b.
