A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH FINDING THAT
THE PROCEDURE FOR THE FORMATION AND ELECTION
OF A PROJECT AREA COMMITTEE FOR THE 1999 AMENDMENT
TO THE HUNTINGTON BEACH DEVELOPMENT PROJECT
WERE FOLLOWED IN THE ELECTION OF THE PROJECT AREA COMMITTEE
AND DETERMINING THE VALIDITY OF ANY CHALLENGES TO THE ELECTION
WHEREAS, the City Council of the City of Huntington Beach has established
boundaries and formulated a Redevelopment Plan("Plan") for the merged Huntington Beach
Redevelopment Project by Ordinance Nos. 2576, 2577, 2578, 2582, 2634, 2743, 3002, and 3343
on December 16, 1998 of the City of Huntington Beach; and
The Redevelopment Agency of the City of Huntington Beach ("Agency") and the City
Council desire to amend the Plan ("1999 Amendment")to establish the authority to use eminent
domain on residential property in the Main-Pier subarea of the Huntington Beach
Redevelopment Project Area; and
In connection with the 1999 Amendment, the City Council adopted Resolution No. 99-4
on January 19, 1999, thereby adopting the Procedure for the Formation and Election of a Project
Area Committee ("Procedure"), and calling upon the residents,businesses, and existing
community organizations within the Huntington Beach Redevelopment Project Area("Project
Area")to form a Project Area Committee; and
Pursuant to the procedure, notice was provided to all Project Area residents, businesses,
and community organizations by first class mail, and was published in the Huntington Beach
Independent; and
A public meeting was held on March 8, 1999,to explain the establishment of, functions
of, and opportunity to serve on, the PAC; and
A second public meeting was held on March 22, 1999, to elect members to the PAC, and
six representatives were elected to the PAC; and
Section 33385(d) of the Community Redevelopment Law, California Health and Safety
Code Sections 330000 et seq.,provides that a challenge to the PAC election or to the electoral

process must be filed with the City Council no more than 15 calendar days after the PAC
election, and further provides that the City Council shall consider all challenges so filed and will
determine the validity of those challenges within 30 days following the PAC election; and
No challenges to the PAC election or electoral process were received within the 15-day
time period.

NOW, THEREFORE, the City Council of the City of Huntington Beach hereby finds and
determines that(1)no challenges to the election of the Project Area Committee or to the electoral
procedures were filed with the City Council; and(2)that the "Procedure for the Formation and
Election of a Project Area Committee for the 1999 Amendment to the Huntington Beach
Redevelopment Plan,"which were adopted by the City Council on January 19, 1999,were
followed in connection with the election of a Project Area Committee on March 22, 1999.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof on the 19 tb day of April , 1999.

I, CONNIE BROCKWAY, the duly elected, qualified City Clerk of the
City of Huntington Beach, and ex-officio Clerk of the City Council of said City, do
hereby certify that the whole number of members of the City Council of the City of
Huntington Beach is seven; that the foregoing resolution was passed and adopted by
the affirmative vote of at least a majority of all the members of said City Council at a
regular meeting thereof held on the 19th day of April, 1999 by the following vote:
