HomeMy WebLinkAboutCity Council - 99-60 RESOLUTION NO. 99-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING RESOLUTION NO. 96-71 REGARDING THE LIBRARY DEVELOPMENT FEE The City Council of the City of Huntington Beach hereby resolves as follows: Section 1. Purpose. The purpose of this resolution is to increase the Library Development Fee to the maximum levels as supported by Report entitled"Library Development Fee,"which the City Council previously approved pursuant to Resolution No. 96-71. Section 2. Findings. Pursuant to Resolution No. 96-71, the City Council found that the cost for library facilities and materials sufficient to offset the demand created by new development, based upon square footage of new development, is as follows: Residential $0.44 Commercial Office $0.09 Retail $0.04 Service $0.04 Industrial Light $0.09 Heavy $0.05 Warehouse $0.00 Notwithstanding this information, the City Council set the Library Development Fee in 1966 to be $0.25 per square foot of gross floor area for residential development projects and $0.03 per square foot of gross floor area of a commercial or industrial development project, provided that no fee will be charged for warehouse projects. These lower amounts were set because of a concern by the City Council that any Library Development Fee would negatively 1 SF-99Resol ution_Li b0811 RLS 99-474 08/18/99-43 impact new development. However,the past three years have shown no data suggesting that the Library Development Fee has retarded new development. Consequently, the City Council now chooses to set the Library Development Fee at the maximum level supported by the Library Development Fee Report. Section 3. Amount of the Library Development Fee for Residential Devclopment Projects.. Section 5 of Resolution No. 96-71 is hereby amended to read as follows: "The Library Development Fee is hereby established to be 50.44 per square foot of gross floor area of a residential development project." Section 4. Amount of the Library Development Fee for Commercial and Industrial Development Projects. Section 6 of Resolution No. 96-71 is hereby amended to read as follows: "The Library Development Fee is hereby established to be 50.04 per square foot of gross floor area of a non-residential development project, except that a warehouse project shall be charged no fee." Section 5. This Resolution shall take effect sixty(60) days after it has been adopted.
