A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ADOPTING A SIDE LETTER
TO THE M.O.U. BETWEEN THE CITY OF HUNTINGTON BEACH
AND THE HUNTINGTON BEACH FIREFIGHTER'S ASSOCIATION
REGARDING PAY RATE FOR LEVEL II ARSON INVESTIGATORS
WHEREAS, the Memorandum of Understanding between the City of Huntington Beach
and the Huntington Beach Firefighter's Association, dated October 18, 1999, and adopted by
Resolution No. 99-92 (the "M.O.U.") continues to remain in effect; and
The City Council of the City of Huntington Beach desires to modify the M.O.U.,
regarding pay rate for Level II Arson Investigators, to place said rate 22 ranges above Fire
Protection Sepcialist,
NOW, THEREFORE, the City Council of the City of Huntington Beach resolves as
follows:
1. The Side Letter dated July 17, 2000, to the M.O.U., a copy of which is attached
hereto as Exhibit "A" and incorporated by this referenced as though fully set forth herein, is
hereby approved and ordered implemented in accordance with the terms and conditions thereof..
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 17th day of July , 2000.

SUBJECT: SIDE LETTER— MODIFICATIONS TO RATE ADJUSTMENTS FOR LEVEL 11
INVESTIGATORS, INCLUSION OF NEW PAY RATES FOR LEVEL 11
INVESTIGATORS
This Level 11 Investigators Side Letter shall document our agreement that the Fire Protection
Specialist 40-hour rate should be used as the basis for an 11% salary adjustment, 22 ranges
above the salary classification of the Fire Protection Specialist. The Side Letter will remain in
effect until the salary adjustment is included in a future Huntington Beach Firefighters
Association Memorandum of Understanding (HBFA MOU).
Pay Rate Prior to September 8, 1999 HBFA MOU
The Level I Investigators were paid at the 56-hour time and one-half rate at Firefighter
Paramedic "E" Step. The Level II Investigators were paid at the 56-hour time and one-half
rate at Fire Captain "E" Step, or approximately 11% above the Level I.
Current Pay Rate
After the September 8, 1999 HBFA MOU was signed, the salary rate for the Level I
Investigator increased based on the Fire Protection Specialist salary rate on-duty, and time
and one-half, off-duty. The Level II Investigator responsibilities still remain independent of
the person's rank and the salary rate remained at the 56-hour time and one-half Fire Captain
"E" Step on- and off-duty.
Proposed Rate Adjustment for Level II Investigator
Effective January 8, 2000 the HBFA MOU reduced the difference between the Level I and
Level II Investigator salary rate significantly. The Level I Investigator responsibilities became
part of the job description for the Fire Protection Specialist. The salary rate for level I
Investigator exceeded that of the Level 11. The proposed salary rate adjustment would reflect
the Level 11's education, experience and responsibilities above that of the Level I Investigator.
Additionally, the Level 11 adjusted salary rate (per hour) would bring the percentage
differential back in line with the original salary rates used to attract and maintain personnel to
the Level 11 Investigator's position.

Proposed MOU Language
If approved, the Level II Investigator's salary rate would be adjusted 11% resulting in the
following assigned salary adjustments:
• Fire Protection Specialists assigned to a 56-hour suppression work schedule, regardless
of the suppression rank, while on duty and temporarily reassigned to Level I
responsibilities would be compensated at the Fire Protection Specialist 56-hour salary
rate, for each hour temporarily assigned.
• Fire Personnel assigned to a 40-hour non-suppression work schedule, while on duty and
temporarily reassigned as a Level II Investigator, would be compensated 22 ranges
above a Fire Protection Specialist for each hour temporarily reassigned.
• Fire Suppression personnel, off duty and temporarily assigned as Level II Investigator,
would be compensated 22 ranges above Fire Protection Specialist rate at the time and
one half rate.
• Fire Suppression personnel, while on duty and temporarily reassigned to level 11
Investigator, would be compensated 22 ranges above Fire Protection Specialist rate at a
56-hour rate for each hour temporarily reassigned.
