HomeMy WebLinkAboutCity Council - 2001-75 RESOLUTION NO. 2001-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING RESOLUTION NO. 5159 ENTITLED, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING A CITY FEE SCHEDULE" TO RECOVER ADMINISTRATIVE COSTS INCURRED IN CONJUNCTION WITH BOOKING AND PROCESSING ARRESTEES (POLICE DEPARTMENT SERVICES) (SUPPLEMENTAL FEE RESOLUTION NO. 83 ) WHEREAS, on October 4, 1982, the City Council adopted Resolution No. 5159 establishing a fee schedule for the City; and California Government Code gives authority to local agencies to recover administrative costs incurred in conjunction with booking and processing arrestees; and The City Council desires to establish new fees charged to persons arrested and convicted in order to recover costs associated with processing persons taken into custody, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that Resolution No. 5159 is hereby amended to incorporate a fee in the amount of$177.00 to be charged to persons arrested by the Huntington Beach Police Department and later convicted of an offense arising out of that arrest in order to recover administrative costs incurred in conjunction with the arrest. Any booking fee imposed pursuant to this section shall be charged to the person booked and not to the arresting entity; and BE IT FURTHER RESOLVED that except as amended herein, the fees contained in Resolution No_ 5159, as amended, shall remain in full force and effect. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 15th day of October , 2001.
