HomeMy WebLinkAboutCity Council - 2002-29 RESOLUTION NO. 2002--29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE HUNTINGTON BEACH MARINE SAFETY OFFICERS' ASSOCIATION, BY ADOPTING THE SIDE LETTER OF AGREEMENT WHEREAS, on December 18, 2000, the City Council of Huntington Beach adopted Resolution No. 2000-123 for the purpose of adopting the 2000/03 Memorandum of Understanding (MOU)between the City and the Huntington Beach Marine Safety Officers' Association (HBMSOA); Subsequent to the adoption of the MOU, the City of Huntington Beach and the HBMSOA agreed to changes, corrections, and clarifications to the MOU that are reflected in a Side Letter of Agreement between the City of Huntington Beach and the HBMSOA("Side Letter of Agreement") attached hereto as Exhibit A and incorporated herein by this reference. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Huntington Beach as follows: Section 1. The Side Letter of Agreement attached hereto as Exhibit A is approved and adopted. Section 2. The Side Letter of Agreement amends the MOU between the City of Huntington Beach and the HBMSOA. Safety Officer positions represented by HBMSOA and specific agreed upon changes to the existing 2000-2003 Memorandum of Understanding and 5.1 and 5.3 of the Marine Safety Policies and Procedures Manual. Article 11 — Representation Unit/Classifications (Replaces Existing Article 11) It is recognized that the Marine Safety Officer's Association is the employee organization, which has the right to meet and confer in good faith with the City on behalf of the employees of the Huntington Beach Community Services Department within the following classifications: Marine Safety Lieutenant Marine Safety Officer 11 Marine Safety Officer With the approval of the Personnel Commission, and upon adoption of the revised classification specification for Marine Safety Lieutenant, Marine Safety Officer I, and Marine Safety Officer II by the Huntington Beach City Council; all existing Marine Safety Officers shall be temporarily "grand fathered" into the new classification of Marine Safety Officer II for a period not to exceed the current MOU's expiration date of September 30, 2003. Any temporarily "grand fathered" Marine Safety Officer who does not obtain all required qualifications for Marine Safety Officer 11, as specified in the classification specification, shall be reclassified to Marine Safety Officer I effective October 1, 2003, All existing Marine Safety Lieutenants shall be temporarily reclassified into the new revised classification of Marine Safety Lieutenant for a period not to exceed the current MOU expiration date of September 30, 2003. Any temporarily reclassified Marine Safety Lieutenant that does not obtain all of the required qualifications for Marine Safety Lieutenant, as specified in the classification specification, shall be reclassified to Marine Safety Officer II effective October 1, 2003. MSOA 00-03 Side Letter 3/20/2002 11.06 AM Res.No.2002-29 Exhibit A SIDELETTER OF AGREEMENT Between the City of Huntington Beach And The Huntington Beach Marine Safety Officers' Association Extensions to the "grand fathered" deadline for obtaining the requirements of the above classifications shall be allowed if the City, due to its scheduling needs, does not allow an employee the time to obtain the required certifications; or, if the employee is unable to obtain these requirements due to work related injury or illness. Time extensions may also be granted at the option of the City if the required classes or training for such requirements were unavailable during the "grand father" time period. All time extensions will be considered on a case-by-case basis after considering the circumstances causing the delay. It is the intent of both the City and the Association to make their best effort to obtain all required qualifications by September 30, 2003. Article V— Salary Schedules (Replaces Existing Article V) Employees shall be compensated at rates by classification title and salary range during the term of this agreement as set out in Exhibit Al attached hereto and incorporated herein. Article VI —Special Pay (Replaces Paragraph C —Assignment Pay with the Following Language) C. Incentive Pay: 1. Marine Safety Officer 11 — Employees classified as MSO 11 shall receive an additional five (a) percent incentive pay, over their base pay for obtaining and maintaining active certification in all seven of the following specialties: SCUBA/Rescue; ICS Incident Command System 100 and 200; Instructor 1A and 113; SCUBA/Dry Suit; and Instructor Emergency Response Red Cross. 2. Marine Safety Lieutenant — Employees classified as Marine Safety Lieutenant shall receive an additional five (5) percent incentive pay, over their base pay for obtaining and maintaining active certification in all four of the following specialities: ICS Incident Command System 300; Command I and 1B; and Management I.
