HomeMy WebLinkAboutCity Council - 2002-42 RESOLUTION NO. 2002-42 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE SOLID WASTE DISPOSAL SITE CLEANUP TRUST FUND WHEREAS, the installation of two in-line storm drain runoff treatment structures will improve the quality of storm water entering the Bolsa Chica Wetlands. These structures will remove trash, debris and associated pollutants that endanger the ecosystem of the wetland as a whole. Although the structures will be located with the City limits, this project will have a regional impact. Continuous Deflective Separation (CDS) is an innovative and highly effective solution to address common urban runoff pollutants. CDS technology offers an effective method of preventing pollutants, such as street litter, trash and debris, vegetation and coarse sediments and the attached pollutants including heavy metals and nutrients from entering our waterways. The CDS technology features a patented non-blocking, indirect screening technique developed in 1992 to remove gross pollutants from urban water and storm water runoff. CDS is an innovative technology that separates solids from liquids and is an acceptable best management practice well suited to treat a large range of storm water flows and conditions. A unique advantage of the CDS technology is the ability to treat a wide range of flows, from 1 to 300 cubic feet per second (cfs); and The people of the State of California have enacted Assembly Bill 2136 that authorizes the California Integrated Waste Management Board (the Board) to initiate and administer a program for cleanup of solid waste disposal sites and for cleanup of solid waste at codisposal sites where the responsible party either cannot be identified or is unable or unwilling to pay for timely remediation, and where cleanup is needed to protect public health and safety or the environment; and Said procedures established by the Board require the City to certify by resolution the approval of application before submission of said application to the State of California; and The City will enter into an agreement with the State of California for the site cleanup, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH does hereby: SECTION 1. Approve the filing of an application for the cleanup of solid waste using grant funds from the Solid Waste Disposal Site Cleanup Trust Fund for the project specified above. SECTION 2. Certify that the City has or will have snatching funds for the project. SECTION 3. Certify that the City has or will have sufficient funds to operate and maintain the project. 02resolsolid wasteW23l02 1 Res. No. 2002-42 SECTION 4. Appoint the Director of the Public Works Department as agent of the City Council to conduct all negotiations, execute and submit all documents including, but not limited to applications, grant agreements, amendments, payment requests and so on, which maybe necessary for the completion of the aforementioned project.
