A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH AMENDING RESOLUTION NO. 5159
ENTITLED, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING A CITY FEE SCHED ULE"
PERTAINING TO ESTABLISHMENT OF A VEHICLE IMMOBILIZER FEE
(SUPPLEMENTAL FEE RESOLUTION NO. 90. _)
WHEREAS, on October 4, 1982, the City Council adopted Resolution No. 5159 establishing a fee
schedule for the city; and
The City Council desires to establish, pursuant to Vehicle Code § 22651.7, with respect to the City's use
of a vehicle immobilizing device, a vehicle immobilizer fee to be charged to a vehicle's owner, or the person in
charge of such vehicle, in those cases where five or more delinquent parking violations have been issued to the
vehicle; or to a vehicle's registered owner as to whom five or more notices for failure to pay or failure to appear
in court for traffic violations have been issued; and
The cost to the City of Huntington Beach and its Police Department(field officer,parking officer and
support staff time), of employing(that is, attaching and removing)the immobilizing device is$100.00 per
vehicle,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that
Resolution No. 5159 is hereby amended to include a vehicle immobilizer fee of$100.00 per vehicle where an
immobilizing device is used by the City; and
BE IT FURTHER RESOLVED that the immobilizing device shall only be used with respect to those
vehicles that are described in Vehicle Code § 22651.7; and
BE IT FURTHER RESOLVED that the, 100.00 vehicle immobilizer fee shall only be imposed on those
persons who are described in Vehicle Code § 22651.7; and
BE IT FURTHER RESOLVED that the fee addition set out in this Supplemental Fee Resolution No.
90 shall be effective immediately, and continue during the fiscal year 2001/2002 and thereafter; and
BE IT FURTHER RESOLVED that except as amended herein,the fees contained in Resolution No.
5159, as amended, shall remain in full force and effect.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting
thereof held on the 18 day of November ,2002.

I, CONNIE BROCKWAY, the duly elected, qualified City Clerk
of the City of Huntington Beach, and ex-officio Clerk of the City Council of
said City, do hereby certify that the whole number of members of the City
Council of the City of Huntington Beach is seven; that the foregoing resolution
was passed and adopted by the affirmative vote of at least a majority of all the
members of said City Council at an regular meeting thereof held on the
18th day of November, 2002 by the following vote:
AYES: Green, Dettloff, Boardman, Cook, Houchen, Winchell, Bauer
