HomeMy WebLinkAboutCity Council - 2005-81 RESOLUTION NO. 2005-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING AND RESTATING THE PLAN DOCUMENT AND SUMMARY PLAN DESCRIPTION AND DESIGNATING A PLAN ADMINISTRATOR FOR THE FLEXIBLE SPENDING ACCOUNT PLAN WHEREAS, the Flexible Spending Account Plan enables eligible City employees to pay for expenses allowed under Sections 105 and 213(d) of the Internal Revenue Code; and The Flexible Spending Account Plan is offered by the City to employees under a negotiated contract provision in the Memorandum of Understanding between the City and the Management Employees' Association, the Huntington Beach Municipal Employees' Association, the Huntington Beach Police Officers' Association, the Huntington Beach Firefighters' Association, the Police Management Association, the Fire Management Association, the Marine Safety Officers' Association and per Resolution for non-represented employees; and The Flexible Spending Account Plan has been in effect since March 1, 2000; and, The Flexible Spending Account Plan has been amended since January 1, 2003 for the addition of Debit and Credit Cards, April 14, 2003 for compliance with Health Insurance Portability and Accountability Act (HIPAA) privacy standards and January 1, 2004 for the definition of"Medical Expenses" (Over the Counter); and, is now being amended to clarify the definition of a "dependent" based on Working Families Tax Relief Act (WFTRA) under Internal Revenue Service Notice 2004-79 and to add the Grace Period Rule Changes under Internal Revenue Service Notice 2005-42 for Health Care Reimbursement Plan effective January 1, 2005, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Huntington Beach as follows: SECTION 1. Adoption of the FSA Plan effective March 1, 2000, fully amended and restated effective January 1, 2005. SECTION 2. The Deputy City Administrator (City Services) is hereby appointed as the Plan Administrator. SECTION 3. The Plan Administrator is hereby authorized to take such actions that are deemed necessary and proper to execute the Plan, and to set up adequate accounting and administrative procedures to provide benefits under the Plan and to act as soon as possible to notify eligible employees of the City of Huntington Beach of the adoption of the amended Plan document by delivering to each employee a copy of the Summary Plan Description. 05resolflex spend 1 PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 19th day of nPcPmhPr , 200�.
