A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
APPROVING PROPERTY TAX EXCHANGE AGREEMENT BETWEEN THE CITY OF
HUNTINGTON BEACH AND THE COUNTY OF ORANGE REGARDING THE SIGNAL
LANDMARK REORGANIZATION TO THE CITY OF HUNTINGTON BEACH
WHEREAS, Signal Landmark has filed an application with the Local Agency Formation
Commission to annex the unincorporated territory referred to as"Signal Landmark
Reorganization to the City of Huntington Beach(RO 05-60)" which is approximately 111
undeveloped acres located in the upper mesa area of the unincorporated Bolsa Chica Ecological
Reserve, southeast of Warner Avenue, north of the Pacific Coast Highway, west of Bolsa Chica
Street and south of Los Patos Avenue, and
California Revenue and Taxation Code Section 99 allows cities and counties to adopt and
approve property tax exchange agreements to set forth the exchange of such revenues following
the addition to a city of previously unincorporated territory; and
The County and City staffs have reached agreement, subject to Board and City Council
approval, regarding the exchange of property tax as a result of the annexation of the
unincorporated territory by the City, whereby upon annexation by the City, the City shall receive
55.9617% of the County's share of the 1% basic levy of property tax and the County shall
receive 44.0383% of the County's share of the 1% basic levy property tax generated within the
area to be annexed, pursuant to Master Property Tax Transfer Agreement 80-2093; and
The City shall receive 100% of the Structural Fire Fund and 100%of the Library fund
generated in the annexed areas upon annexation; and
The County staff and the City of Huntington Beach staff desire to have the same adopted
and approved by their respective governing bodies,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. That the City Council does hereby approve the property tax exchange agreement
reached between the City of Huntington Beach and the County of Orange, whereby, upon
completion of the annexation of the unincorporated area referred to as the Signal Landmark
Reorganization to the City of Huntington Beach(RO 05-60), the City shall receive 55.9617%
and the County of Orange shall receive 44.0383% of the County's share of the 1%basic levy of
property tax from the annexed area pursuant to Master Property Tax Transfer Agreement 80-
2093.

2. That the City of Huntington Beach will receive 100% of the Structural Fire Fund
and 100% of the Public Library fund generated in the annexed areas upon annexation.

regular meeting thereof held on June 05, , 2006.

I, JOAN L. FLYNN the duly elected, qualified City Clerk of the
City of Huntington Beach, and ex-officio Clerk of the City Council of said City,
do hereby certify that the whole number of members of the City Council of the
City of Huntington Beach is seven; that the foregoing resolution was passed
and adopted by the affirmative vote of at least a majority of all the members of
said City Council at an regular meeting thereof held on the 5th day of June,
2006 by the following vote:
