HomeMy WebLinkAboutCity Council - 2007-51 RESOLUTION NO. 2007-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ACCEPTING THE DETERMINATION THAT CERTAIN AREAS HAVE MET THE CITY'S DEFINITION OF DETERIORATING OR DETERIORATED AREAS, AND DESIGNATING THESE AREAS FOR SPECIAL CODE ENFORCEMENT ACTIVITIES IN CONDAU1VITY DEVELOPMENT BLOCK GRANT PROGRAM WHEREAS,the City of Huntington Beach is a recipient of Community Development Block Grant(CDBG)Funds, distributed by the Department of Housing and Urban Development("HUD"); and WHEREAS, as a recipient of CDBG funds, the City must certify that its projected use of CDBG funds has been developed to give maximum feasible priority to activities which will carry out one of the national objectives of benefiting low-and moderate- income persons or aid in the prevention or elimination of slums or blight. WHEREAS, it is the desire of the City of Huntington Beach to utilize CDBG funds to reduce or eliminate conditions which cause a reduction of or lack o f proper utilization of areas to such an extent that it constitutes a serious physical, social, visual, or economic burden on the community; and WHEREAS, pursuant to the regulations outlining the eligible activities for CDBG funds, City is permitted to use CDBG funds for costs incurred for inspection for code violations and enforcement of codes in deteriorating or deteriorated areas when such enforcement together with public or private improvements, rehabilitation, or services to be provided may be expected to arrest decline of the area; and WHEREAS, from January to June 2007, City Staff completed a comprehensive survey of certain areas within the City and documented conditions within these areas that evidence that the areas are deteriorating or are deteriorated areas, which is defined as any area of the City which contains a substantial number of buildings or properties maintained in such a manner that substandard conditions, as defined by Chapter 10 of the 1997 California Uniform Housing Code, are in existence or are likely to be observed, and/or exhibit other factors and conditions believed to indicate, influence, or contribute to the deterioration of buildings or properties; and WHEREAS, based on the City's survey, deteriorating or deteriorated areas within the City are described and depicted in the attached Exhibit A incorporated herein by this reference; and 06-567.001/12471 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DOES RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: 1. Deteriorating or deteriorated area are defined to be any area of the City that contains a substantial number of buildings or properties maintained in such a manner that substandard conditions, as defined by Chapter 10 of the 1997 California Uniform Housing Code, are in existence or are likely to be observed, and/or exhibit other factors and conditions believed to indicate, influence, or contribute to the deterioration of buildings or properties. 2. The City of Huntington Beach accepts the findings of the survey . completed by City Staff, and declares that the areas, as specified within borders and boundaries defined in the completed survey as depicted in the attached Exhibit A, have met the criteria of a deteriorating or deteriorated area and meet the criteria as a qualified area for special code enforcement activities and for utilization of CDBG funds in these areas to carry out one of the national objectives of benefiting low-and moderate-income persons or aid in the prevention or elimination of slums or blight.
