A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
ADJUSTING WATER RATES BY THE CONSUMER PRICE INDICES AND
INCLUDING A CAPITAL SURCHARGE PURSUANT TO SECTION 14.12.040
OF THE HUNTINGTON BEACH MUNICIPAL CODE
WHEREAS, on July 19, 1999, the City Council adopted Resolution No. 99-33
establishing water rates for the City's customers effective October 12, 1999; and
On July 19, 1999, the City Council Adopted Resolution No. 99-50 establishing formulas
for the annual adjustment of the City water rates which in part provide for an annual adjustment
to the monthly meter charge based upon an annual percentage adjustment to the Consumer Price
Index for all Urban Consumers for Los Angeles, Orange and Riverside Counties established by
the U.S. Bureau of Labor Statistics ("CPI"); and
Huntington Beach Municipal Code Section 14.12.170 requires in part that all monies
collected from fees and charges under Chapter 14.04 through 14.20 of the Huntington Beach
Municipal Code shall be deposited in a City water fund; and
Huntington Beach Municipal Code Section 14.12.040 establishes a monthly Capital
Surcharge. The amount of the Capital Surcharge is set by a resolution of the City Council; and
Resolution 99-34 set the rate of the Capital Surcharge in an amount not to exceed $5.50
per month in order to pay for ongoing maintenance of facilities constructed under the Water
Master Plan. The monthly Capital Surcharge is charged either by the number of equivalent
dwelling units based on meter size or the actual number of dwelling units, whichever is greater.
Pursuant to Resolution 99-34, on December 31, 2007, the Capital Surcharge decreases to $2.00
per month; and
The Capital Surcharge is currently deposited into the Water Master Plan account within
the Water Fund; and
The City Council of the City of Huntington Beach now desires that the Capital Surcharge
shall be included in the monthly water rates to fund ongoing maintenance of facilities in addition
to new facilities; and
Including the Capital Surcharge in the monthly water rates will allow the Capital
Surcharge to increase every year by the CPI; and
Pursuant to Huntington Beach Municipal Code Section 14.12.045, the City Council shall
adjust water rates in order to maintain a balanced budget,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that Resolution No. 99-33 is hereby repealed and replaced by this Resolution.

BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
the Capital Surcharge shall be included in the monthly water rates to fund ongoing maintenance
of facilities in addition to new facilities.
BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
effective January 3, 2008, water customers shall be charged the following rates:
A minimum charge, as set forth below, based upon size of water meter plus a water usage
charge of $1.3939 per billing unit (100 cubic feet) of water for domestic, commercial and
industrial service.

**A fireline meter(FM) is a type of high capacity meter approved for domestic or fire protection
service.
BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
in cases where more than one "unit," as defined below, is connected to one meter, the basic
charges shall equal the monthly and daily charges for a 3/4" meter for each unit multiplied by the
total number of units. However, in no case shall a charge be less than the monthly and daily
basic charges based on the actual meter size.
"Unit"means any building or a portion of a building consisting of one or more rooms
separated from the rest of the building by a partition, and occupied independently of the other
parts of the building or another building.
BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
the following exceptions be made to the rates set forth in this Resolution:
(1) Single Family Residences With Fire Sprinkler Service:
The monthly and daily basic meter charge for single family residences will be
billed at the established rates for the meter size needed to serve the domestic

service requirement, regardless of actual meter size to meet fire flow demand.
The domestic service requirement shall be calculated in accordance with the
City's adopted Plumbing Code.
(2) Sub-Potable Service:
For those customers receiving Orange County Water District's Green Acres
Project reclaimed water for sub-potable use, the water usage rate shall be 80% of
the City's established water usage rate for potable water.
The minimum charge per month shall be waived on additional meters installed for
the purpose of irrigation with sub-potable water until such time as sub-potable
water is available. In instances where two meters are installed at one address and
the monthly fee is to be waived on the second meter under the above conditions,
the actual monthly fee charged shall be for the largest service at the address.
(3) Temporary Construction Service:
In cases where water service is established on a temporary basis to accommodate
construction activities (construction water), the daily meter charge shall be
$2.3014 ($70 per month). The water usage charge shall equal twice (2 times) that
of the established potable water rate.
