HomeMy WebLinkAboutCity Council - 2009-03 RESOLUTION NO. 2009-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE HUNTINGTON BEACH FIREFIGHTERS' ASSOCIATION, BY ADOPTING A SIDE LETTER OF AGREEMENT REGARDING WORK SCHEDULES WHEREAS, the City Council of Huntington Beach adopted Resolution No. 2008-13 for the purpose of adopting the Memorandum of Understanding (MOU) between the City and the Huntington Beach Firefighters' Association(HBFA); and Subsequent to the adoption of the MOU, the City of Huntington Beach and the HBFA agreed to changes to the MOU that are reflected in a Side Letter of Agreement between the City of Huntington Beach and the HBFA ("Side Letter of Agreement") attached hereto as Exhibit A and incorporated herein by this reference. The Side Letter of Agreement pertains to work schedules of firefighter paramedic trainees, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Huntington Beach as follows: 1. The Side Letter of Agreement attached hereto as Exhibit A is approved and adopted. 2. The Side Letter of Agreement amends the MOU between the City of Huntington Beach and the HBFA. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5 t h day of January , 200 949 . e Mayor REVIE D APPROVED: INI A D P City diWistrator r for of Hu -an R(esdurces APPROVED AS TO FORM: 1 z z,-/� ()—City Attorney M,V- (a- lot-0 8 29391 Exhibit "A", Resolution No. 2009-03 SIDE LETTER AGREEMENT December 18, 2008 Representatives of the City of Huntington Beach and Huntington Beach Firefighters Association ("HBFA") met and conferred regarding the issue of modification to certain work schedules for firefighters attending a paramedic training program ("Firefighter Paramedic Trainee"). The current Memorandum of Understanding (MOU) between the Huntington Beach Firefighters Association and the City of Huntington Beach requires that employees working a 56 hour per week work schedule receive six (6) consecutive days off. However, this schedule is not in accordance with training program hours. This work schedule contemplated in this side letter would allow HBFA employees to work at other Orange County fire agencies during the field internship portion of their training. As a result of that meeting, agreement was reached on the following: MOU Article VII, A., 1. is amended with respect to Firefighter Paramedic Trainees as follows: To facilitate the field internships required for Firefighter Paramedic Trainees attending paramedic training at Saddleback College, Firefighter Paramedic Trainees will continue to work an average of fifty-six (56) hours per week with the remaining days off as designated by the schedule of the other fire agencies in Orange County (with the exception of La Habra Fire Department). MOU Article VII, C.1. is amended with respect to Firefighter Paramedic Trainees as follows: To facilitate the field internships required for Firefighter Paramedic Trainees attending paramedic training at Saddleback College, Firefighter Paramedic Trainees will continue to receive overtime compensation pursuant to all applicable Fair Labor Standards Act overtime rules without applying the current fifteen day work period. Said work schedule shall be determined by the Fire Chief at the time the employee's training schedule becomes effective and the work period shall be a time frame where each employee on each work shift is scheduled to work the same number of shifts and hours as designated by the schedule of the other fire agencies in Orange County (with the exception of La Habra Fire Department). This agreement is not intended to reduce or provide any additional overtime compensation to Firefighter Paramedic Trainees for working regularly scheduled hours while actively engaged in training.
