HomeMy WebLinkAboutCity Council - 2011-09 RESOLUTION NO. 2011-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING AN APPLICANT PROCESSING FEE AND A GPS INMATE TRACKING FEE SCHEDULE FOR THE HUNTINGTON BEACH POLICE DEPARTMENT JAIL COURT COMMITMENT PROGRAM WHEREAS, the Huntington Beach Police Department, pursuant to Council Resolution Number 6257, initiated a Jail Court Commitment Program for offenders who had been sentenced to serve a county jail sentence the option to apply for, and if accepted, the opportunity to serve their sentence in the Huntington Beach City Jail in lieu of serving their sentence in Orange County Jail; and WHEREAS, the Police Department currently charges sentenced inmates who qualify and are accepted to serve their sentence in City Jail a fee of$100.00 per day as established in 1991 pursuant to Resolution 6257; and WHEREAS,jail staff spends a considerable amount of time processing an applicant for consideration in the jail court commitment program which includes, but is not limited to, conducting a background check, processing of finger prints through state and federal data bases, discussing details of the jail court commitment program with the applicant, the applicant's attorney, and the sentencing court; and WHEREAS,the establishment of a one-time administrative fee is necessary to cover the reasonable cost of performing the background check, processing fingerprints and further processing applicants approved to participate in the jail court commitment program; and WHEREAS, the jail court commitment program also allows those offenders, who have been approved by the sentencing court and the City's Jail Detention Administrator, to maintain their employment while serving their sentence in the work release program; and WHEREAS, the Orange County Grand Jury has recommended that any city jail operating a work release program implement the use of a GPS inmate tracking system to monitor the movement of a sentenced inmate while they are out of custody; and WHEREAS, the establishment of a fee is necessary to cover the reasonable cost of renting a GPS device and administering the work release program. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 11-2762/57701.doc 1 Resolution No. 2011-09 1. A one-time administrative fee of$50.00 be established to cover the reasonable costs of processing an applicant for consideration in the jail court commitment program. 2. A fee of$10.00 per 24-hour period be established to cover the reasonable cost of renting a GPS inmate tracking device and administration of a GPS inmate tracking system for persons accepted to participate in a work release program as part of the jail court commitment program.
