HomeMy WebLinkAboutCity Council - 2011-36 RESOLUTION NO. 2011-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING AN APPLICATION FOR FUNDS FROM THE ENVIRONMENTAL CLEANUP, TIER 1 GRANT PROGRAM UNDER ORANGE COUNTY LOCAL TRANSPORTATION ORDINANCE NO. 3 FOR THE MCFADDEN/EDWARDS AND HEIL/ALGONQUIN CATCH BASIN RETROFIT PROJECT WHEREAS, Orange County Local Transportation Ordinance No. 3, dated July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance and Investment Plan makes funds available through the Environmental Cleanup Program to help protect Orange County beaches and waterways from transportation-generated pollution (urban runoff) and improve overall water quality; and The Environmental Cleanup, Tier 1 Grant Program consists of funding for purchases and installation of catch basins with Best Management Practices, such as screens, filters, inserts, and other "street-scale" low flow diversion projects; and OCTA has established the procedures and criteria for reviewing proposals; and The City of Huntington Beach possesses authority to nominate water quality improvement projects that have a transportation pollution nexus to finance and construct the proposed project; and The City Council authorizes the nomination of McFadden/Edwards and Heil/Algonquin Catch Basin Retrofit Project, including all understanding and assurances contained therein, and authorizes the Director of Public Works to act in connection with the nomination and to provide such additional information as may be required; and The City of Huntington Beach will maintain and operate the equipment acquired and installed; and The City of Huntington Beach will give OCTA's representatives access to and the right to examine all records, books, papers or documents related to the funded Tier 1 Grant Project; and The City of Huntington Beach will cause work on the project to be commenced within a reasonable time after receipt of notification from OCTA and completion of the project will be carried out with reasonable diligence; and The City of Huntington Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, and any other federal, state, and/or local laws, rules and/or regulations, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1 11-2887/63475 Resolution No. 2011-36 1. The Director of Public Works is authorized as the official representative of the City of Huntington Beach to apply for the Environmental Cleanup, Tier 1 Grant Program for McFadden/Edwards and Heil/Algonquin Catch Basin Retrofit Project and execute all grant documents in connection with such application. 2. That the City of Huntington Beach agrees to its share of the project costs which will be by matching twenty-five percent (25%) of the grant funds and any additional costs over the identified programmed amount.
