HomeMy WebLinkAboutCity Council - 2014-52 RESOLUTION NO. 2014-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CALIFORNIA SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING CITY MEASURES AND DIRECTING THE CITY ATTORNEY TO PREPARE IMPARTIAL ANALYSES OF SAID MEASURES WHEREAS, a General Municipal Election is to be held in the City of Huntington Beach, California, on November 4, 2014, at which there will be submitted to the voters two (2) ballot measures; and The City Council wishes to authorize arguments in favor of and in opposition to the measure and authorize the preparation of impartial analysis of the measure, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. That with respect to the measure entitled: Shall the proposed Amendment to Article VIII of the Charter of the City of Huntington Beach adding Section 805 to permit the sale, possession, display, use and discharge of safe and sane fireworks, subject to regulation by City Council, as set forth in the proposed measure be approved. a. That the City Council authorized Mayor Harper (Councilmember In Favor) Council Member Carchio (Councilmember In Favor) Council Member Boardman (Councilmember Against) Council Member Hardy (Councilmember Against) members of that body, to file written arguments regarding the Measure as specified above in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and to change the arguments until and including the date fixed by the City Clerk after which no arguments for or against the Measure may be submitted to the City Clerk. Said argument to be accompanied by the printed name(s) and signature(s) of the person(s) submitting it, or if 14-4321/111345.doc 1 Resolution No. 2014-52 submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers. b. That the City Council directed the City Clerk to transmit a copy of the Measure to the City Attorney, unless the organization or salaries of the Office of the City Attorney are affected. The City Attorney shall prepare an impartial analysis of the Measure showing the effect of the Measure on the existing law and the operation of the Measure. If the Measure affects the organization or salaries of the Office of the City Attorney, the City Clerk shall prepare the impartial analysis. The impartial analysis shall contain a statement indicating the measure was placed on the ballot by City Council and be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 2. That with respect to the measure entitled: Shall the proposed Amendment to Article VIII section 803 of the City Charter be adopted which provides an exemption for regulation of real property in mobile/manufactured home parks, retroactive to July 21, 2014. a. That the City Council authorizes Council Member Katapodis (Councilmember In Favor) Council Member Hardy (Councilmember In Favor) Mayor Harper (Councilmember Against) Council Member Carchio (Councilmember Against) (Councilmember In Favor/Against) members of that body,to file a written argument regarding the Measure as specified above in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the Measure may be submitted to the City Clerk.
