HomeMy WebLinkAboutCity Council - 2015-21 RESOLUTION NO. 2015-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING A LEVEL, 2 WATER SHORTAGE WHEREAS, the State of California has had four consecutive years of below average rainfall and the snowpack is at six percent of normal levels; and Governor Brown issued the first ever Statewide Mandatory Water Reductions on April 1, 2015, directing the State Water Resources Control Board to implement mandatory water reductions in cities and towns across California to reduce water usage by 25 percent; and The Board of Directors of the Metropolitan Water District of Southern California(MWD) voted to activate its Water Supply Allocation Plan at Level 3, which calls for a 15 percent reduction of imported water use; and The Board of Directors of the Municipal Water District of Orange County (MWDOC) voted to activate its Water Supply Allocation Plan at Level 3; and MWDOC Level 3 Allocations will require the City of Huntington Beach to reduce its imported water demands by 15 percent; and The City Council.implemented Level 1 of the Water Management Plan on August 18, 2014; and Chapter 14.18.070 of the Huntington Beach Municipal Code allows the City to declare a Level 2 Water Shortage and take measures to respond to water supply shortage conditions. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. A. A drought and water supply shortage or threatened shortage exists, and a consumer demand reduction is necessary to make more efficient use of water and appropriately respond to existing water conditions. Because of the preceding factors, the City of Huntington Beach declares a Level 2 Water Supply Shortage. B. Additional Water Conservation Measures. In addition to the prohibited uses of water identified in Sections 14.18.050 and 14.18.060 of the Huntington Beach Municipal Coda as currently set forth or as may be amended in the future, the water conservation requirements set forth in Section 14.18.070 apply during the time of a declared Level 2 Water Supply Shortage. 15-4695/119972.doc 1 Resolution No . 2015-21 SECTION 2. The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act("CEQA")pursuant to Sections 15060(c)(2) (the activity will not result in a director or reasonably foreseeable indirect physical change in the environment) and 15050(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Actions taken pursuant to the Water Management Program are exempt from CEQA and are considered necessary to prevent or mitigate an emergency pursuant to Public Resources Code Section 21080 (b)(4) and the CEQA Guidelines Section 15269(c). SECTION 3. This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
