HomeMy WebLinkAboutCity Council - 2015-38 RESOLUTION NO. 2 015-3 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING GENERAL PLAN AMENDMENT NO. 05-OOIR WHEREAS, pursuant to a request by Rainbow Environmental Services and to comply with the express terms of the Court's June 2, 2015 Order, General Plan Amendment No. 05- 001R proposes to change the Land Use Plan for real property on the southeast corner of Warner Avenue and Nichols Street from CG-F1 (Commercial General-Maximum Floor Area Ratio of 0.35) on a+1.1 gross acre portion and I-172-d (Industrial-Maximum Floor Area Ratio of 0.5- Design Overlay) on a+3.3 gross acre portion back to the previous designation of RM-15 (Residential Medium Density - Max 15 dwelling units per acre) as more particularly described on Exhibit A attached hereto, and Pursuant to California Government Cade, the City Council of the City of Huntington Beach, after notice duly given, held a public hearing to consider General Plan Amendinent No. 05-001R; and The City Council finds that said General Plan Amendment No. 05-OOIR is necessary to comply with a court order and for the changing needs and orderly development of the community, is necessary to accomplish refinement of the General Plan, and is consistent with other elements of the General Plan. NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows. SECTION 1 That the real property that is the subject of this Resolution is generally located on the southeast corner of Warner Avenue and Nichols Street in the City of Huntington Beach, and is more particularly described in the legal description and sketch attached hereto as Exhibit A and incorporated by this reference as though fully set forth herein SECTION 2: That General Plan Amendment No. 05-001R, which changes the General Plan Land Use designation for real property on the southeast corner of Warner Avenue and Nichols Street from CG-F1 (Commercial General-Maximum Floor Area Ratio of 0.35) on a +1.1 gross acre portion and I-172-d (Industrial-Maximum Floor Area Ratio of 0.5-Design Overlay) on a+3 3 gross acre portion back to the previous designation of RM-15 (Residential Medium Density - Max 15 dwelling units per acre) as more particularly described on Exhibit A attached hereto is hereby approved. The Director of Planning and Building is hereby directed to prepare and file an amended Land Use Map.
