A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
ADJUSTING WATER RATES AND COMMODITY RATE PURSUANT TO
SECTION 14 12.040 OF THE HUNTINGTON BEACH MUNICIPAL CODE
WHEREAS, on July 19, 1999, the City Council adopted Resolution No 99-33
establishing water rates for the City's customers effective October 12, 1999, which was
subsequently repealed by Resolution 2007-77; and
On July 19, 1999, the City Council Adopted Resolution No 99-50 establishing formulas
for the annual adjustment of the City water rates which in part provide for an annual adjustment
to the monthly meter charge based upon an annual percentage adjustment to the Consumer Price
Index for all Urban Consumers for Los Angeles, Orange and Riverside Counties established by
the U.S. Bureau of Labor Statistics ("CPI-U"), and
Huntington Beach Municipal Code Section 14.12.170 requires in part that all monies
collected from fees and charges under Chapter 14.04 through 14.20 of the Huntington Beach
Municipal Code shall be deposited in a City water fund; and
Huntington Beach Municipal Code Section 14.12.040 establishes a monthly Capital
Surcharge. The amount of the Capital Surcharge is set by a resolution of the City Council; and
Pursuant to Proposition 218, an agency providing water, wastewater, sewer, or refuse
collection service may adopt a schedule of fees or charges authorizing automatic adjustments
that pass through increases in wholesale charges for water, sewage treatment, or wastewater
treatment or adjustments for inflation, if it complies with all of the following-
(a) It adopts the schedule of fees or charges for a property-related service for a period not to
exceed five years pursuant to Section 53755; and
(b) The schedule of fees or charges may include a schedule of adjustments, including a
clearly defined formula for adjusting for inflation. Any inflation adjustment to a fee or
charge for a property-related Service shall not exceed the cost of providing that
Service; and
Pursuant to Huntington Beach Municipal Code Section 14.12.045, the City Council shall
adjust water rates in order to maintain a balanced budget,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that Resolution No. 2007-77 is hereby repealed and replaced by this Resolution.

BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
the adjustment formulas established in Resolution 99-50 for water rates are adopted and will
remain in effect for five years
A minimum charge, as set forth below, based upon size of water meter and water
commodity charge of$1.8302 per billing unit (100 cubic feet) of water for domestic, commercial
and industrial service
Water commodity rate- Per Resolution 99-50, the commodity charge may change based on the
cost to purchase water,the groundwater basin replenishment assessment, and basin pumping
percentage. The rate is increased as follows:

Meter charge rate: Per Resolution 99-50, the meter rate shall be adjusted based on the Consumer
Price Index-Urban (CPI-U) for the Los Angeles, Orange County-Riverside Area and available as
of July 1 each year The CPI-U published July 1, 2015 is 1.1 percent The table below shows
the increase based on CPI-U to each meter based on size

BE IT FURTHER RESOLVED by the City Council of the City of Huntington
Beach that in cases where more than one "unit," as defined below, is connected to one meter, the
basic charges shall equal the monthly and daily charges for a 3/4" meter for each unit multiplied
by the total number of units However, in no case shall a charge be less than the monthly and
daily basic charges based on the actual meter size.

"Unit"means any building or a portion of a building consisting of one or more rooms
separated from the rest of the building by a partition, and occupied independently of the other
parts of the building or another building
BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that
the following exceptions be made to the rates set forth in this Resolution.
(1) Single Family Residences With Fire Sprinkler Service.
The monthly and daily basic meter charge for single family residences will be
billed at the established rates for the meter size needed to serve the domestic
service requirement, regardless of actual meter size to meet fire flow demand
The domestic service requirement shall be calculated in accordance with the
City's adopted Plumbing Code.
(2) Temporary Construction Service:
In cases where water service is established on a temporary basis to accommodate
construction activities (construction water), the daily meter charge shall be
$2.3014 ($70 per month). The water usage charge shall equal twice (2 times) that
of the established potable water rate
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 19 t h day of October , 2015.
