HomeMy WebLinkAboutCity Council - 2016-32 RESOLUTION NO 2016-32 A RESOLUTION OF THE CITY COUNCIL OF THE Cl FY OF HUN I ING FON BEACH AUTHORIZING THE APPLICATION FOR FUNDS FOR THE BICYCLE CORRIDOR IMPROVEMENT PROGRAM FUNDED Wl FI-I CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING UNDER THE MOVING AHEAD FOR PROGRESS IN THE 21'Sn CENTURY AND FIXING AMERICA'S SURFACE I RANSPORTA HON FEDERAL TRANSPORTATION AC T FOR THE DELAWARE STREET BICYCLE AND PEDESTRIAN FACILITIES PRO IECI WHEREAS, Orange County Tiansportation Authority ("OCTA") has established the procedures and critei ra for reviewing grant pi oposals, and City of Huntington Beach is author ized to nominate bicycle projects Funded using Congestion Mitigation and Ali Quality hnlpr ovement Program funding and to finance, acquire, and construct the Delaware Street Bicycle and Pedestrian Facilities Project (the "Project''), and By formal action the City of Huntington Beach authorizes the nonninatron of the Project, including all understanding and assurances contained therem, and authorizes the person identified as the official iepresentatrve of the City of Huntington Beach to act in connection with the Project and to provide such additional information as may be required, and Tine City of Huntington Beach will nnarntain and operate the property acgwied, developed, iehabilitated, or restored foi the life of the resultant facilities or activity, and With the approval of the Califon nra Department of fiansportatron (Caltrans) and/or OCTA, the City of Huntington Beach or its successors in interest in the property may tiansfen the responsibility to maintain and operate the property, and NOW, THEREFORE, BE IT RESOLVED that the City of Huntington Beach hereby authorizes the Directoi of Public Works as the official representative of the City of Huntington Beach to apply for the Congestion Mitigation and Air Quality funding under the Moving Ahead for Progress in the 21`r Century Federal Transportation Act and Fixing America's Surface Transportation Act for Delaware Street Bicycle and Pedestrian Facilities Project, and 1 he City of Huntington Beach author rzes the City Manager and his or her designee to execute any documents or agreements in furtherance of the Project, and The City of Huntington Beach will give Caltrans and/or OCTA's representatives access to and the right to examine all records, books, pape►s or docuznients related to the bicycle project, and 16-5254/136457/M V 1 RESOLUTION NO 2016-32 The City of Huntington Beach will cause work to commence within six months following notification fiom the State or OCTA that funds have been authorized and the project will be carried to completion with seasonable diligence, and The City of Huntington Beach commits $60,000 of Gas Tax Funds and will provide 12 2% of the total project cost as match to the requested $432,750 in OCTA CMAQ funds for a total project cost estimated to be $492,750, and The City of Huntington Beach will comply where applicable with provisions of the Califoi nia Environmental Quality Act, the National Environmental Policy Act, the Ameiican with Disabilities Act, Federal Title VI, Buy America piovision, and any other federal, state, and/or local laws, rules and/or regulations, and The City of Huntington Beach will amend the agency Capital Improvement Program (CIP) to include the project if selected for funding, and BE IT FURTHER RESOLVED that the City of Huntington Beach agrees to fund its share of the project costs and any additional costs over the identified ptogiammed amount -4 Mayor REVIE D APPROVED APPROVED FOR City nag Crt Attojney INITIATED AND APPROVED Directoi of Pu i Works 16-5254/136457/MV 2 Res.
