HomeMy WebLinkAboutCity Council - 2017-09 RESOLUTION NO. 2017-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING A PORTION OF EDINGER AVENUE AND COUNTESS DRIVE LYING WITHIN THE CITY LIMITS OF HUNTINGTON BEACH TO BE A COUNTY HIGHWAY DURING THE PERIOD OF CONSTRUCTION OF THE EDINGER AVENUE BRIDGE PROJECT WHEREAS, those portions of Edinger Avenue, from its westerly limit to 3400 east of Countess Drive; and Countess Drive, from Edinger Avenue to 540 feet south of Edinger Avenue, lying within the City Limits of Huntington Beach, have been deemed to be a highway of Countywide importance; and The City of Huntington Beach and the County of Orange propose to construct roadway improvements along Edinger Avenue and Countess Drive, hereinafter referred to as PROJECT; and The City of Huntington Beach and the County of Orange have entered into Agreement No. 13-027 to define responsibilities of the City and the County with respect to the PROJECT, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. Pursuant to the provisions of Section 1700, Article 3, Chapter 9, Division 2 of the Streets and Highways Code, those portions of Edinger Avenue, from its westerly limit to 3400 east of Countess Drive; and Countess Drive, from Edinger Avenue to 540 feet south of Edinger Avenue, lying within the City Limits of Huntington Beach, are hereby declared to be a County highway during the period of construction of the PROJECT by the County of Orange. 2. The County of Orange Board of Supervisors adopted Resolution No. ! - 00 on J(A nur:;rt" 1 C. U4 i J_to declare those portions of Edinger Avenue, from its westerly limit to 3400 e� t of CountessDrive; and Countess Drive, from Edinger Avenue to 540 feet south of Edinger Avenue, lying within the City Limits of Huntington Beach, to be a County highway during the period of construction of the PROJECT by the County of Orange. 3. This declaration shall take effect upon the City's consent and at the commencement of construction, and shall remain in full force and effect until a Notice of Completion for construction of the PROJECT has been filed with the Clerk of the Board of Supervisors and the Orange County Board of Supervisors accepts the PROJECT as complete, and such Notice of Completion has been filed with the Clerk of the City of Huntington Beach and resolution filed with the Clerk of the Board of Supervisors, respectively. 16-5531/147696/mv 1 RESOLUTION NO. 2017-09 4.
