HomeMy WebLinkAboutCity Council - 2017-68 RESOLUTION NO. 2017-68 A RESOLUTION OF THr CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REAUTHORIZING FEES FOR STATE FRANCHISED VIDEO SERVICES PROVIDERS WHEREAS, the City of Huntington Beach ("City") adopted Ordinance No. 4130 on March 20, 2017, wherein City imposed certain fees on cable providers within City's jurisdiction; and Public Utilities Code section 5870(n) provides that the Public, Education and Governmental ("PEG") fee must be reauthorized upon the expiration of an applicable State franchise; and Some State franchises within City's jurisdiction will expire and are expected to be renewed in 2018; and City intends to reauthorize the collection of PEG fees, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. Ordinance No. 4130 of the City of Huntington Beach is hereby readopted in its entirety. SECTION 2. In readopting Ordinance No. 4130, City intends, to the extent required by California Public Utilities Code section 5870(n), to reauthorize the Public, Education, and Cevernmental channel facilities fee ("PEG fee"). In adopting this Ordinance, City does not in any manner affect or alter the continuing obligation of State franchises to collect and pay the preexisting PEG fee- SECTION 3. This Resolution shall become effective upon its adoption.
