I C O N T R A C T THIS AGREEMENT, made and entered into as of the 16thday of October , 197_, by and between the CITY OF HUNTINGTON BEACH a municipal corporation, hereinafter referred to as THE CITY, and A & A CONSTRUCTION , hereinafter referred to as THE CONTRACTOR. W I T N E S S E T fi WHEREAS, in accordance with the provisions of Section 1773 of the Labor Code, the State of California, Director of the Department of Industrial Relations, shall determine the general prevailing rate of wages, applicable to the work covered by the contract; copies of the latest General Prevailing Wage Determinations are on file in the office of the City Clerk and made a part hereof. 7.1he supplementary ccnai.tions attached hereto are part of this cccntract. WHEREAS, the City Council of the City of Huntington Beach, County of Orange, State of California, pursuant to statutes in such cases made and provided, duly and regularly caused a notice to be published, calling for bids for labor, material, tools and equipment for the for the construction of the Michael Drive Storm Drain i0 thin Drainage District No 3 in portions of Michael Drive, Van Buren Street, Slater Avenue and Cameron Street. in said City of Huntington Beach, California, said work to be constructed according to plans, specifications, general requirements, and special provisions for same on file in the office of the Director of Public Works and adopted by the City Council of said City of. Huntington Beach on the 18th day of September 19 78 , to which said plans, specifications, general requirements, and special provisions reference is hereby made, and by such reference they are made a part of this contract as if herein set out in full; and WHEREAS, the City Council at a regular meeting thereof and at the time and place appointed therefore received the report of this results of the bids submitted by the respective bidders for the construction and completion of the above mentioned work, and after careful consideration of all bids submitted the City Council awarded the contract therefor to the CONTRACTOR therein named at the prices set forth in his bid, it being the lowest and best bid received by the said City Council. NOWT, THEREFORE, in consideration of the convenants and agree- ments herein contained, being done and peformed by the parties hereto, it is hereby agreed as follows: I. By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for Workmen's Compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract. Contractor agrees to receive and accept as full compensa- tion for furnishing all materials and for doing all the work contemplated and embraced in th-s agreement, the unit prices con- tractor submitted in his proposal which was accepted by the City Council. A copy of said proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees that said payment by City shall include all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties or obstruc- tions which may arise or be encountered in the prosecution or the work until its acceptance by the City, and for all risks of every description connected with the work; also for all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully completing the work, and the whole thereof, in the manner and according to the plans and specifications, and the require- ments of the engineer under them. City agrees with the said Contractor to employ, and does hereby employ, the said contractor to provide the materials and to do the work according to the terms and conditions herein contained and referred to, for the prices aforesaid, and hereby contracts to pay the same at the time, in the manner and upon the conditions set forth in the general requirements and the said parties for themselves, their heirs, executors, administrators, successors and assigns, do hereby agree to the full performance of the convenants herein contained for the contract bid amount of $157, 728.40 which amount is subject to adjustment upward or downward dependent upon inplace quantity wware applicable. Storm drain is necessary to alleviate the floodir. problem in this neighborhood. Recommended Action Approve the plans, specifications and Negative Declaration 78-28, and authorize the call for bids to construct the storm drain system. Analysis At the May 15, 1978 City Council meeting, authorization was given to Hall & F-1reman, Inc., a consultant engineering firm, to design the Michael Drive storm drain. Their design has been completed and approved by the Department of Public Works. In order to construct the drainage improve- ments and provide flood protection for the neighborhood prior to next winter's rains, the project construction should begin at the earliest possible time. The City's Environmenta' Review Commi�.tee recommended the granting of Negative Declaration 78--28 and the Planning Commission found the project to be in cor:formance to the City's General Plan (CGP 78-6C). Alternative Continue to utilize the existing deficient storm drain system and allow the neighborhood to be susceptible to possible flooding. Funding__Source The project is estimated to cost $160,000 and will be financed in the following manner: Drainage District Funds $90,000 Gas Tax Funds 60,0000 Sewer Funds 10,000 The sewer funds are to be used to eliminate a siphon in Slater. RECOMMENDED ACTION: Authorize the Purchasing Officer to engineers to design the appropriate protection at (1) Michael Drive from channel east of Jefferson Street, an Drive on the south to Christy Drive ANALYSIS: retain :he services of consulting faci'it:ies for storm water flood Cameron Street to the flood control d (2) Trudy -Woodstock from Shields on the north. The Michael Drive and Trudy -Woodstock areas have been harra.ssed for years by local storm water flooding. Other areas, too, are subject to storm water flooding. For this reason, priorities were established and various projects completed accordingly. It is evident that present stp:f-f will not have the time to design the two projects in question. Ironically, Gas Tax funding can be used to construct these projects and is available now. The obvious answer is to "farm out" the professional design in order to construct the necessary improvement, to protect these neighborhoods from storm water floodinj during the next winter. season. The cost for professional services to design both projects i:s estimated at $50,000 to $70,000. ALTERNATIVES: Continue utilizing our existing priority listing of storm drain projects. Staff will complete the designs as time permits. This would mean that both Michael Drive and Trudy -Woodstock would not be completed prior to the next winter season. The con- tract was awarded to your firm at the regular meeting of the City Council he'd Monday, October '15, 1978. Will you kindly execute the contracts and have all signatures notarized on all copies and return to this office, together with the L:zbor and Ma terials Bond equal to fifty percent (50%) and Performance Bond in the amount of one hundred percent (100%) of the contract. The enclosed Contractors Certification Concerning Labor Standards and Prevailing Wage Requirements should be filled out and returned with the contracts. Also enclosed are two set of a Certificate of Insurance in quadruplicate. This insurance form is ,the only one that will be accepted by the City of Huntington Beach. Please retL,rn one set with the bonds, executed contracts and Contractors Certification Concerning Standards and Prevailing Wage Requirements.
