The hole in the anode for the lead wire connection shall be bored a minimum of 12" deep with a belled enlargement at the bottom of the hole and a 450 taper at the top of the hole. The anode shall then be completely penetrated with petroleum wax to increase the density of the graphite a minimum of six percent. A lead wire of minimum No. 8 AWG with HMW insulation shall be attached to the anode by means of a poured and caulked solder connection. Payment of all expenses in connsction therewith shall be by the contractor. C. Clean -Up The contractor shall remove all rubbish an4 debris and properly clean the work area as the work pro- gresses. At completion of the installation, the contractor shall remove all equipment and debris leaving the site in a condition satisfactory to the supervisor. 0 D. Damage to Existing Facilities All amage to existing facilities or construction attributed to operations wider th!a contract shall be repaired or replaced to original condition with materials equal in all respects to original mate- rials.. E. Rectifiers Each reotfier unit shall be permanently mounted at the location shown on the site drawing in a manner .which will securely anchor it to the wall or pole. r Recommended A.C. power shall.be supplied to the rectifier in rigid. conduit. The D.C. output leads shall be run in rigid galvanized conduit of adequate size from the rectifier unit to a point above around. The conduit shall be mounted by means of galvanized conduit straps, and shall be terminated in the ground with a chafing bushing. There shall be an accessible switch or breaker within night of the rectifier. F. Anodes Anodes shall be installed as detailed, and at the approximate locations shown on the cite plans. Exact locations shall be selected in the field at the time of the installation. Trenching All concrete pavement shall be saw cut on existing cracks. Trenches may be made by machine, in which �- case extra care must be taken when crossing areas where existing underground utilities traverse the trench line. For trenches through asphalt paved areas, the pavement shall be cut and removed from the site. Upon completion, the excavated areas shall be compacted to the approval of the supervisor. The City will provide all repavement material and labor requirements after approved compaction. R. D.-C. Cable Burial 0. C. cable w c is installed underground shall be installed in a trench of at least 16" depth. The bottom of the trench shall be free of stones and other sharp o6jeets. The cable shall then be laid in the trench and backfilled with rock free native soil. The depth of the selected backfill soil shall be one foot above cable depth. The buried cable marking tape shall be laid in the trench one foot over the buried cable. The remainder of the trench shall then be backfilled with natives soil, compacted to base of existing pavement. All cable in PVC con- duit does not require selected backfill or marking tape. I. Cable Splices Cable !giplices shall be Scotchcast 3M Products, follow- ing manufacturer's installation procedures. No splice shall be covered that has not been approved by the supervisor. ' J. Cable -to -Structure Connections All connections of D.C. cable to underground steel structures shall be by a thermite brazing process. welding charges shall be the product of a manufacturer regularly engaged in the production of such material. Preparation of the weld joint, and the size and type of cartridges used shall be in accordance with manu- facturer's recommendations. After the connection ham been made, the underground structure coating shall be repaired to match the existing coating, or at a mini- mum provided with a coal tar coating Situmastic B-SO or equal. X. All coordination and charges for this insulator installation shall be per- formed by the contractor. It shall be the responsibility of City to have the system inapdeted, energised, adjusted and tested by a corrosion L-ngi,nearing firm. A written report shall be submitted to the City by the engineer- ing firm. Incladed in the report shall ba all recti- fier voltage and current outputs, structure -to -soil potential readings and recommendations for any modifi- cations or deficiencies. M. A contract change order will not become effective until approved by the director or Engineer. New and unforseen work will be classed as extra work when such work is not shorn on the plans or set out in the specifications and special provisions. Director The Director shall decide any and all questions which arise as to the quality or acceptability of materials furnished and work performed, the manner of perforewnce and rate of progress of the work, the interpretation of the plans and spaoificaticms, the acceptable completion of the contract by the contractor, and all questions as to claims and compensation, The Director's decision shall be final and he shall have executive authority to enforce and make effective such decisions and orders. The contractor shall carry out promptly all decisions or orders of the director, affecting the work. 0 a S-b. Full size details shall take precedence over seal* drawings as to shape and details of construction. it is intended that scale drawings, full size details and specifi- cations should agree, but should any discrepancy or apparent error occur in plans and specifications or should any work of others affect this work, the contractor shall notify the Director at once; if the contractor proceeds with the work affected without instruction from the Director, he shall make good any resultant damage or defect. Any Mork called for by the drawings and not mentioned in the specifications, or vine versa, is to be furnished as if not forth by both. Where not specifically stated otherwise, all work and materials necessary for each unit of Construction, including special construction of any specifio brand or shape of material called for, even if only briefly mentioned or indicated, shall be furnished and installed fully and completely as a part of the contract. Standard drawings of the Department of Public works, lists, rules and regulations referred to are recognised printed standards and shall be considered as one and a pert of these specifications within the limits specified. All drawings and specifications are city property and must be returned when ordered. Additional Details: The City may furnish additional details tF %rare u y exp sin the work and same shall be considered part of the contraht documents. Where the work is not sufficiently detailed or clearly shown, the contractor, before proceeding, shall apply in writing for additional � details. Any work done by the contractor before receipt of such details, if not in accordance with sane, shall be removed and replaced or adjusted, at his own expense. $-a. working Drawings Working drawings or plans for any structure, item of wcxk, or facility, not included in the plans furnished by tiie Director of Publics works shall be approved by the Director before any work involving these plans shall be performed, unless approval is waived in writing by the Direetox of Public Works. Interpretation cif Plans tAnd Specifications Should it appear that the work to be done, or any natter relative thereto, is not sufficie..tly detailed or explained in these specifications and plans, the contractor shall apply to the Director for such further explanations as may be necessary, and shall conform, to such explanations or inter- pretation as part of the contract. The decision of the Director shall be final. 5-g. Ins$ection The Director or his authorised agent shall at all 'time■ have access to the work during construction and shall be furnished with every reasonable facility for a►scertaininyy full know- ledge respecting the progress of the work, workmanship# and the character of materials used and employed in the work. d Whenever the contractor varies the period during which work is carried on each day he shall give adequate notice to the Director of Pulic Works, ao that proper inspaction may be provided. Any work done on holidays, (holidays defined as those in labor Agreements), weekends or ur,usual hours be nd the normal 40 hour week will require prior approval of the Engineer and application and fee for special inspection at contractor's expense (sa-e special forms) unless ordered by the City. Arny work done in the; absence of the inspector will be subject to rejection. The inspection of the work shall not relieve the contractor of any of his obligation to fulfill the contract as pre- scribed. The con- tractor shall make the appropriate notification according to the instruction given on the State Encroachment Permit or railroad permit for all inspections, and shall post all bonds and Certifications required by the permit. The permit shall be acquired by the City. Nowevm9r, tha contractor may also be required to secure additional permits under his own name, which permits shall be processed at the contractor's expense. The contractor shall pay for all testing and inspections required by a State Encroachment permit or a • railroad permit. 5-h. Removal of Defective and Unauthorized Work All work which is defective in its construction or does not most all of the requirements of these plans and/or specifications shall be remedied, or removed and replaced by the contractor in an acceptable manner, and no compensation will be allowed for such correction. Any work done beyond the limits of the lines and grndes shown on the plans or established by the Director of public Works, or any extra work done without written authority, will be considered as unauthorized and will not be paid for. Upon failure on the part of the contractor to comply forth- with with any order of the Director made under the provisions of this article, the Director shall have authority to cause defective work to be remedied, or removed and replaced, and unauthorized work to be removed, and to deduct the costs thereof from any moneys due or to become due the contractor. 5-1. Superintendence Whenever the contractor is not present on any part of the work where the City desires to give direction, orders will be given by the Director in writing, and shall be received and obeyed by the contractor's superindentent or foreman in charge of the particular work in reference to which orders are given. • S-j. Lines and Grades All distances and measurements are given and will be made its a horizontal plane. Grades will be given from and referenced to the top of stakes or points, unless otherwise noted on the plans. 0 •N M � I � , 71 r ',I The contractor shall give at least 24 hours notice in writing when he will require the services of the Director for laying out any portion of the work. The contractor shall furnish the Director such facilities and labor necessary for making and maintaining points and lines as he may require. The contractor shall preserve all stakes and points set for lines, grades, or measurements of the work in their proper places until authorised to remove them by the Director. All expenses incurred in replacing stakes that have been remved without proper authority shall be paid by the contractor. Coutrol of Materials G-a. qualitX of Material Materials shall* be new, and of specified kind and quality and fully equal to samples when samples are required. When the quality or kind of material or articles shown and required under the contract is not particularly specified, the contractor shall estimate that the City will require articles or materials representing the best of its class or kind or at least equal to the class or quality of similar articles or materials that are specified. Materials shall be furnished in ample quantities and at such timew to insure uninterrupted progress of the work. Same shall be stowed properly and protected as required. The Contractor shall be entirely responsible for damage or lose by weather or other cause. 6-b. ra:ie`Na�or p uals It is the intent of these specifications to permit the con- tractor to supply any of the materials specified or offer an equivalent. The engineer shall determine whether the material offered is equivalent to that specified. Adequate tins shall be allowed for the engineer to make this determination. Mheaever any particular material, process, or equipment is indicated by patent, proprietary or brand name, or by name of manufacturer, such wording is used for the purpose of facil- itating its description and shall be deemed to be followed by the words "Or approved equal". 1 � ' e A listing of materials is not intended to be comprehensive,or is order of preference. The contractor may offer for approval any material. process, or equipment which he considers to be equivalent to that indicated. Unless otherwise authorised by the engineer the substanti.atton of offers must be sub- mitted within 35 days after award of contract. He shall have the material tested as required by the engineer to determine that the quality, strength, physical chemical, or other characteristics, including durability, f�nish, efficiency, dimensions, service, and suitability are such *hat the item will fulfill its intended function. Samples and Tests At the option of the Director, the nource of supply of each of the materials shall be approved by the Director before delivery is started and before such material is used in the work. Upon request of the Director of Public Works, representative preliminary material samples of the character and quality prescribed shall be submitted, by the contractor producer or manufacturer of all materials to be used in the � work, for such testina or examination deemed necessary by the Director of Publ Works. A1lbests of materials furnished by the contractor shall be made in accordance with coimmnly recognized standards of national organization, and such special methods and tests as are prescribed in these spscifIcations. Legal Relations and Responsibilities 7-a. General lfancts with Law The contractor shall keep informed and observe, and comply with, and cause all of his agents and employees to observe and ceaply with, all prevailing Federal, State and ltnicipal Laws, Ordinances, Rules and Regulations which in Any way affout. the con&4ct of the work of this contract. It any conflict arises between provisions of the plans and specifia- atJons and any such law above raferred to, then the contractor shall notify the City at onea in writing. The contractor shall protect and indemnify the City or any of its officers, agents, and employees against any Claim or liability arising from or based on the violation of any such law, ordinance, rule or regulation, whether by himsolf or his agents employees. 7-b. Registration of Contractor 7--c Prior to the &word of contract# the coaxtractor shall be li"cengel in accordance with the provisions of !article 1, to 9 inclusive of Chapter 9, Division 3 of the Business and Professiofts Code of the State of California and Amendmants thereof, providing for the registration of contractors, and defining the tots coin - tractor; providing a method of obtaining licenses to engage in the business of contracting and fixing the fees for such licensest and prescribing the punishment for violation of provisions thereof, as amended. California Fair_ Employment Practice Act r The contractor shall utilize fair employment practices in accordance with California Labor Code Section 14-10 et seg. 7-f . Px�evailing_Wage The contractor shall forfeit as penalty twenty-five dollars ($25.00) for each laborer, workman or mechanic employed for each calenciir day or portion thereof, such laborer, vrorxman or mechanic is paid less than the general prevailing rate of wages stipulated for any work done by him, or by any subcontractor under him in violation of the provisions of the Labor Code, particularly Section 1770 to 1781 thereof, both inclusive, providing for the payment of not less than the general prevailing rate of wages for legal holiday and overtime work on public work, providing for the ascortain- ment of such general prevailing rate by the public body awarding the contract., providing for the keeping of records of the wages paid all workers engaged in public work and tho i inspection of much records by the proper officials, providing for forfeiture for each calendar day, or portion thereof, any worker is paid less than the said rate and for a stipulation to this effect in the contract, and providing ather penalties for violation of tho provisions. 41 Hours of Labor The contractor shall forfeit., as penalty, twenty-five dollars ($35.00) fox each laborer, workman, or mechanic employed in the execution of the contract by him, or by any subcontractor under him for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor more than eight (8) hours in violation of the provisions of tre Labor Code, particularly Section 1810 to laic thereof, both inclusive, relating to the hours of labor on public works, by requiring contractors to file with the awarding body a verified report as to the nature of any extraordinary emergency when their employees are: permitted to work over eight (8) hours per day, together with the names of the said employees, and the hour3 worked per day making failure to file said :report within thirty (30) days prima facie proof that no extraordinary emergency existed, also making it a misdemeanor for any contractor or subcontractor on public work, or agent thereof, to fail to keep an accurate record showing the name of and the actual hour's worked by each workman employed by him in connection with public work. l� Nf 61 ls� "'l � Ip,il{P�r� �j,,,•ir a. i ' ; a 1-h. �p2rontice on Public Works The contractor sh; ll utilize Apprentices on public works in accordance with California Labor Code Section 1777.i. 7-i. rubric Convenience tend Safety The contractor shall so conduct his operations as to cause the least possible obstruction and inconvenience to public traffic. i Residents along the road, street, or other alignment of improvements shall be provided convenient access to driveways, houses, and buildings along the road or street, and temporary i crossings shall be provided and maintained in good condition. Not more than one cross street or intersecting street or read shall be closed at any one time without the approval of '- the Director of Public Marks. The contractor shall furnish, erect, and maintain Bauch Zones*, barriers, lights, and signs as are necessary to give adequate warning to the public at all times that the road or street is under construction and of any dangerous conditions to be encountered as a result thereof, and he shall also erect and maintain such warning and directional signs as may be furnished by the City. Strict. prohibition against committing any nt._sance in or about the work must be maintained. Coveniencen shall be provided for employees and maintained in sanitary conditions At street crossings and where existing driveways occur, tha contractor shall make provision for glitch crossings at these points either by means of backfills or temporary bridges as the Director of Public works may direct. Free access roust be provided to all fire hydrants, water gates, meters and private drives, and means shall be provided ;;hereby all stoma and waste water can flow in the gutters uninterrupted. 7-j. Accident Pravention Precaution shall be exercised at all times for the protection of persons (including employees) and property. The safety provisions of applicable laws, building and construction codes shall bo observed. Location and Protection of Underground Utilities The City has shown on the plans, the approximate location of known underground utilites, hnwever, the contractor is responsible to notify owrlf:rs of all power, telephone, game oil or other utility lines or structures before starting to mark out in the field the locations of their facilities in the vJcinity of the work and shall notify the City of any interference with the nonstruc•tion of project and to protect in place and/or request relocation of, nr otherwise prevent damage to these iacilities. In the event that every precaution is not exercised to avoid such damage, the contractor shall be liable for all damasgo due to his operatJons 7-1. Responsibility for Damage The City of Huntington Beach, the City Council, appointed e-Ir elected officials, commissions, boards, any City employLa or servant shall not be liable for any loafs or damage to the work performed pursuant to the contract or any part thereof, or for any material or egaipment used in performing the work, or for injury or danuge to any person or persons, either workmen or the public, or for dasegt� to property adjoining the property on which the work is taming performed from any causes whatsoever during the progress of tha work or at any time before final acceptance by the, City. The contractor shall indemnify and save harmless the City of Huntington Beach, the City Council, appointed or elected officials, commissional boards, City employees or servants from any suits, claims, or actions brought by any person or persons for or on account of any injuries oL denragses sustained because of or arising out of the performance of the work contemplated or in consequence thereof. The city Council may retain so much of the money due the contractor as shall be considered necessary for payment of the claims and attorney'ss fees until disposition has been made of such cmits or clain;>s for damages. 7-m. Public Liability and Prol2arty DaMage insurance The contractor shall furnish to the City and maintain during the life of the contract a protective liability policy in which the City is named an an additional insuied. The policy shall insure and hold harmless the City, its officers and employees while acting within the scope of their duties, against all claims arising out of or in connectl.on with the work to be performed. The contractor shall arrange for the policies to be so con- ditioned as to cover the performance of "Extra work", should such work become necessary. Prior to the cormnencemerit of work under the contract, evidence of insurance shall be furnished on a Form provided by the City, and no other form will be accepted. In addition, the con- tractor shall furnish evidence of a commitment by the insurance company to notify the City of the expiration or cancellation of any of the insurance policies required hereunder not lose than 30 days before any change in coverage, expiration or cancell- ation is effective. The contractor will be required to secure the payment of Workmen's Compensation to his employees in accordance with the provisione of Section 3700 of the Labor Code. Prior to the commencement of work, the contractor shall sign and file with the engineer a certification in the following form: 1 im aware of the provi-sions of section 3700 of the Labor Code which require every employer to be insured againot liability for Workmen's Compensation or to undertake self- insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract. The cost of this insurance shall be included in the prices bid for the various items of work and no additional compensation will be made therefor. 7-n. Cooperationbetween -Contractors " Where two or more contractorm are employed on related or adjacent work, each shall conduct his operations in such a manner as not to cause any unnecessary delay or hindrance to y. the other. Each contractor shall be responsible to the other for all damage to work, the person or property, or for loss caused by failure to finish the work within the time specified for completion. 1- + a; . + , 7-o, Contractor's Responsibility for work Until the formal acceptance of the work by the City, the contractor shall have the charge and care thareaf and shall bear the risk of damage to any part of the work by the action of the elements or from any other cause whether arising from the execution or from the non -execution of the work. The contractor shall rebuild, repair restore and make good all damages to any portion of the work occasioned by any of tha above causes before its completion and acceptance and Shall bear the expense thareof, except for such damages as are occasioned by acts of the Federal Government and/or public enrmy. In case of suspension of work from any cause whatever, the contractor shall be responsible for ill materials and shall properly store them if necessary, and shall provide suitable drainage and erect temporary sstructurps where necessary. 7-p. Non-ReUonssibility, of 9-.he Cit The City shall not be responsible for damage or loss from any cause to the work or site, or other pi-iperty, or, for injury or loss of life to persons employed, or to the public. The contractor shall take out and pay for all accident, com- pensation and fire insurance necessary, according to law and assume all risk and responsibility until the work is finally accepted by the City, all as hereinafter specified. Indebtedness incurred for any clause in connection with this work must be paid by the contractor and the City is hereby relieved at all times from any indebtedness or claim other than payments under terms of the contract. 7-q. No Personal Liability Neither the City Council, the Director of Public Works or any other officer or authorized assistant or agent shall be personally responsible for any liability arising under the contract. 7-r. Property flights in Materials Nothing in the contract shall be construed as venting in the contractor any right of property in the materials used after they have been attached or affixed to the work or the soil. All such materials shall bacome the property or the City upon being attached or affixed. 7-s. Conduct of Work The contractor shall observe that the City reserves the right to do other work in connection with the project, by contract or utheraise, and he shall at ail times conduct this work so as to impose no hardship on the City or others engaged in the work.
