With the current fiscal restraints for most all local governments, now is the time
the City may need representation the most
We propose to continue to monitoring legislation and regulations as we have in
the past, and we propose retaining the registration with the Secretary of State in
case we need to step in and actively lobbying on your behalf This registration
will, of course, require the City to continue preparing the Form 635 quarterly
reports for the Secretary of State, but with a zero balance for services rendered
If necessary, Advocation can help with the preparation of these reports

to Assist the City in Acquisition of State Funding for Priority Projects within the
City and Related State Legislative Issues

Statement of Issue: Approval of an amendment to the contract between the City of Huntington
Beach and Advocation, Inc. for professional services related to state legislative and state budget
issues.
Funding Source: Funds for the Contract have been budgeted in the Administration Department
2008-2009 and 2009-2010 budgets under General Fund Account #10030201.69365. The total
annual cost for this contract is not to exceed $35,000.
Recommended Action:
Motion to: Approve and Authorize the Mayor and City Clerk to execute Contract Amendment #1
between the City of Huntington Beach and Advocation, Inc.
Alternative Action: Do not approve the amendment and direct staff accordingly.

Over the past several years, the city has been represented in Sacramento by Advocation, Inc.
Recently, the need for these services, precipitated in part by the State's financial situation, has
declined. With the downturn in the economy, the city is also faced with a need to reduce operating
costs. Because of this, Advocation was approached and agreed to a reduction in their monthly
stipend.
Under the amended contract, we will pay Advocation a retainer of $2,000 a month. They will continue
to monitor those bills on which we have taken a position and to make us aware of legislation that has
the potiential to impact the city. They will also be available, should the need arise, to assist the city in
meetings on specific issues with the appropriate legislators and/or agencies and to represent the city
at a legislative hearing. In those instances where they represent the city in meetings or hearings,
they will be paid on an hourly basis at the rate of $250 an hour. The amended contract has an annual
limitation of $35,000. This is half the amount of their existing contract.
Advocation, Inc. has been an important part of the city's presence in Sacramento. They have
established relationships with legislators that allow them to have one-on-one conversations with them
or their staff. They have provided us with timely analysis on critical legislation and on the state
budget.
If approved, this contract will secure the services of Advocation, Inc. as described above, and it will
allow us to renew the contract at the same rate for an additional year.

AMENDMENT NO. I TO AGREEMENT
BETWEEN THE CITY OF:HUNTINGTON ]BEACH
AND ADVOCATION, INC.
THIS AMENDMENT is made -and entered into the 0' day of 2009,
by and between the CITY OF HUNTINGTON BEACH, a, California municipal corporation,
hereinafter referred to as "City," and ADVOCATION, INC.., a California corporation, hereinafter
referred to as "Consultant."
WHEREAS, City and Consultant are parties to that certain agreement, dated December
17, 2007, entitled "Professional Services Contract Between The City Of Huntington Beach And
Advocation, Inc., For State Lobbyist Services," which agreement shall hereinafter be referred to
as the "Original Agreement," and
City and Consultant wish to amend the Original Agreement to change the amount of
compensation to be paid to Consultant,
NOW, THEREFORE, it is agreed by City and Consultaint as f6flows .
1. AMENDMENT OF SECTION 4 OF ITIE ORIGINAL AGREEMENT
ENTITLED "COMPENSATION; EXTENTION OF AGREEMENT"
Section 4 of the Original Agreement, entitled "Compensation;.Extension Of
Agreement," is hereby amended to read as follows:
4. COMPENSA!tQ-N �JRXTENSION OF AGREEMENT
In consideration of the performance of the services described
herein, CITY agrees to pay CONSULTANT a fee, including expenses, not to
exceed Two Thousand and no/100 Dollars ($2,000.00) per month. The. total
compensation, including expenses, to be paid to CONSULTANT under this
Agreement shall not exceed Thirty-five Thousand Dollars ($35,000.00).
Additionally, at CITY'S prior written request, CONSULTANT shall work on
other specific authorized projects at an hourly rate of Two Hundred Fifty and
no/100 Dollars ($250.00) per hour.
CITY shall have the option to extend this Agreement up to two (2)
additional years. Such option shall be exercised by written Notice of Extension

from CITY to CONSULTANT at least forty-five (45) days prior to the expiration
date of this Agreement. In the event this Agreement is extended, CONSULTANT
shall be entitled to the following compensation:
First Additional Year: Monthly fee, including expenses, of $2000.00.
Second Additional Year: Monthly fee, including expenses, of $2000.00.
2. REAFFIRMATION
Except as specifically modified herein, all other terms and conditions of the
Original Agreement shall remain in full force and effect.

Statement of Issue: Approval of a new contract between the City of Huntington Beach and
Advocation, Inc. for professional services related to the acquisition of state funds for priority projects
within the city and related legislative issues.
Fundinq Source: Funds for the Contract have been budgeted in the 2007-08 fiscal year budget in
Administration's General Fund Account #10030201.69365. The total cost for this contract is not to
exceed $70,000.
Recommended Action: Motion to: Approve and Authorize the Mayor and City Clerk to execute a
contract between the City of Huntington Beach and Advocation, Inc.
Alternative Action: Do not approve the amendment and direct staff accordingly.

Analysis
Over the past five years, the city has been represented in Sacramento by Advocation, Inc.
Huntington Beach Municipal Code 3.03.120 stipulates that we go out to bid on contracts after three
years. The City Council has waived this requirement for the past two years.
This year, in compliance with that code, the Intergovernmental Relations Committee sent out a
request for proposals (RFP) to represent the city in Sacramento. The RFP was sent to 11 firms.
Proposals were received from Advocation, Inc. and Townsend Public Relations. After review of the
proposals and feedback from references, the Committee is recommending that the city enter into a
new contract with Advocation, Inc.
Having representation in Sacramento has helped the city stay a step ahead in identifying legislation
that has the potential to impact the city. It allows us to have a voice in legislative hearings at times
when it would be impractical to send a member of staff or City Council. This is particularly important
when legislation begins to move with little notice.
Advocation, Inc. has become an essential component to the city's presence in Sacramento; they have
established relationships with legislators that allow them to have one-on-one conversations with them
or their staff. They have been able to provide us copies of draft bills and initiatives often before they
are available online, and they provide timely analysis of critical legislation such as the state budget.
If approved, this contract will secure the services of Advocation, Inc. for the coming year. It also
allows for renewal of the contract, at the city's option, for up to an additional two years. The
Intergovernmental Relations Committee is recommending that the City Council approve this contract.
Environmental Status: N/A
Strategic Plan Goal: Provide quality public services with the highest professional standards to meet
community expectations and needs, assuring that the city is sufficiently staffed and equipped overall.

PROFESSIONAL SERVICES CONTRACT BETWEEN
THE CITY OF HUNTINGTON BEACH AND
ADVOCATION, INC. FOR

THIS AGREEMENT ("Agreement") is made and entered into this - day of
2008, by and between the City of Huntington Beach, a municipal
corporation of the State of California, hereinafter referred to as "CITY, and Advocation, Inc., a
California corporation, hereinafter referred to as "CONSULTANT."
WHEREAS, CITY desires to engage the services of a consultant to provide State lobbyist
services; and
Pursuant to documentation on file in the office of the City Clerk, the provisions of the
Huntington Beach Municipal Code, Chapter 3.03, relating to procurement of professional service
contracts have been complied with; and
CONSULTANT has been selected to perform these services,
NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows:
1. SCOPE OF SERVICES
CONSULTANT shall provide all services as described in Exhibit "A," which is
attached hereto and incorporated into this Agreement by this reference. These services shall
sometimes hereinafter be referred to as the 'PROJECT."
CONSULTANT hereby designates Charles Cole, who shall represent it and be its
sole contact and agent in all consultations with CITY during the performance of this Agreement.
2. CITY STAFF ASSISTANCE
CITY shall assign a staff coordinator to work directly with CONSULTANT in the
performance of this Agreement.

3. TERM; TIME OF PERFORMANCE
Time is of the essence of this Agreement. The services of CONSULTANT are to
commence as soon as practicable after the execution of this Agreement by CITY (the
"Commencement Date"). This Agreement shall expire twelve (12) months from the
Commencement Date, unless extended or sooner terminated as provided herein. All tasks
specified in Exhibit "A" shall be completed no later than twelve (12) months from the
Commencement Date. These times may be extended with the written permission of CITY. The
time for performance of the tasks identified in Exhibit "A" are generally to be shown in Exhibit
"A." This schedule may be amended to benefit the PROJECT if mutually agreed to in writing
by CITY and CONSULTANT.
4. COMPENSATION; EXTENSION OF AGREEMENT
In consideration of the performance of the services described herein, CITY agrees
to pay CONSULTANT a fee, including expenses, not to exceed Five Thousand Eight Hundred
Thirty -Three and 33/100 Dollars ($5,833.33) per month. The total compensation, including
expenses, to be paid to CONSULTANT under this Agreement shall not exceed Seventy
Thousand Dollars ($70,000.00).
CITY shall have the option to extend this Agreement up to two (2) additional
years. Such option shall be exercised by written Notice of Extension from CITY to
CONSULTANT at least forty-five (45) days prior to the expiration date of this Agreement. In
the event this Agreement is extended, CONSULTANT shall be entitled to the following
compensation:
First Additional Year: Monthly fee, including expenses, of $6,125.00.
Second Additional Year: Monthly fee, including expenses, of $6,431.25.

5. EXTRA WORK
In the event CITY requires additional services not included in Exhibit "A" or
changes in the scope of services described in Exhibit "A," CONSULTANT will undertake such
work only after receiving written authorization from CITY. Additional compensation for such
extra work shall be allowed only if the prior written approval of CITY is obtained.
6. METHOD OF PAYMENT
CONSULTANT shall be paid pursuant to the terms of Exhibit "B."
7. DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS
CONSULTANT agrees that title to all materials prepared hereunder, including,
without limitation, all original drawings, designs, reports, both field and office notices,
calculations, computer code, language, data or programs, maps, memoranda, letters and other,
documents, shall belong to CITY, and CONSULTANT shall turn these materials over to CITY
upon expiration or termination of this Agreement or upon PROJECT completion, whichever
shall occur first. These materials may be used by CITY as it sees fit.
8. HOLD HARMLESS
CONSULTANT hereby agrees to protect, defend, indemnify and hold harmless
CITY, its officers, elected or appointed officials, employees, agents and volunteers from and
against any and all claims, damages, losses, expenses, judgments, demands and defense costs
(including, without limitation, costs and fees of litigation of every nature or liability of any kind
or nature) arising out of or in connection with CONSULTANT's (or CONSULTANT's
subcontractors, if any) negligent performance of this Agreement or its failure to comply with any
of its obligations contained in this Agreement by CONSULTANT, its officers, agents or
employees except such loss or damage which was caused by the sole negligence or willful
misconduct of CITY. CONSULTANT will conduct all defense at its sole cost and expense and.

CITY shall approve selection of CONSULTANT's counsel. This indemnity shall apply to all
claims and liability regardless of whether any insurance policies are applicable. The policy
limits do not act as limitation upon the amount of indemnification to be provided by
CONSULTANT.
9. PROFESSIONAL LIABILITY INSURANCE
CONSULTANT shall obtain and furnish to CITY a professional liability
insurance policy covering the work performed by it hereunder. This policy shall provide
coverage for CONSULTANT's professional liability in an amount not less than One Million
Dollars ($1,000,000.00) per occurrence and in the aggregate. The above -mentioned insurance
shall not contain a self -insured retention, "deductible" or any other similar form of limitation on
the required coverage except with the express written consent of CITY. A claims -made policy.
shall be acceptable if the policy further provides that:
A. The policy retroactive date coincides with or precedes the initiation of the
scope of work (including subsequent policies purchased as renewals or
replacements).
B. CONSULTANT shall notify CITY of circumstances or incidents that
might give rise to future claims.
CONSULTANT will make every effort to maintain similar insurance during the
required extended period of coverage following PROJECT completion. If insurance is
terminated for any reason, CONSULTANT agrees to purchase an extended reporting provision
of at least two (2) years to report claims arising from work performed in connection with this
Agreement.

10. CERTIFICATE OF INSURANCE
Prior to commencing performance of the work hereunder, CONSULTANT shall
furnish to CITY a certificate of insurance subject to approval of the City Attorney evidencing the
foregoing insurance coverage as required by this Agreement; the certificate shall:
A. provide the name and policy number of each carrier and policy;
B. state that the policy is currently in force; and
C. promise that such policy shall not be suspended, voided or canceled by
either party, reduced in coverage or in limits except after thirty (30) days'
prior written notice; however, ten (10) days' prior written notice in the
event of cancellation for nonpayment of premium.
CONSULTANT shall maintain the foregoing insurance coverage in force until the
work under this Agreement is fully completed and accepted by CITY.
The requirement for carrying the foregoing insurance coverage shall not derogate
from CONSULTANT's defense, hold harmless and indemnification obligations as set forth in
this Agreement. CITY or its representative shall at all times have the right to demand the
original or a copy of the policy of insurance. CONSULTANT shall pay, in a prompt and timely
manner, the premiums on the insurance hereinabove required.
11. INDEPENDENT CONTRACTOR
CONSULTANT is, and shall be, acting at all times in the performance of this
Agreement as an independent contractor herein and not as an employee of CITY.
CONSULTANT shall secure at its own cost and expense, and be responsible for any and all
payment of all taxes, social security, state disability insurance compensation, unemployment
compensation and other payroll deductions for CONSULTANT and its officers, agents and

employees and all business licenses, if any, in connection with the PROJECT and/or the services
to be performed hereunder.
12. TERMINATION OF AGREEMENT
All work required hereunder shall be performed in a good and workmanlike
manner. CITY may terminate CONSULTANT's services hereunder at any time with or without
cause, and whether or not the PROJECT is fully complete. Any termination of this Agreement
by CITY shall be made in writing, notice of which shall be delivered to CONSULTANT as
provided herein. In the event of termination, all finished and unfinished documents, exhibits,
report, and evidence shall, at the option of CITY, become its property and shall be promptly
delivered to it by CONSULTANT.
13. ASSIGNMENT AND DELEGATION
This Agreement is a personal service contract and the work hereunder shall not be
assigned, delegated or subcontracted by CONSULTANT to any other person or entity without
the prior express written consent of CITY. If an assignment, delegation or subcontract is
approved, all approved assignees, delegates and subconsultants must satisfy the insurance
requirements as set forth in Sections 9 and 10 hereinabove.
14. COPYRIGHTS/PATENTS
CITY shall own all rights to any patent or copyright on any work, item or material
produced as a result of this Agreement.
15. CITY EMPLOYEES AND OFFICIALS
CONSULTANT shall employ no CITY official nor any regular CITY employee
in the work performed pursuant to this Agreement. No officer or employee of CITY shall have
any financial interest in this Agreement in violation of the applicable provisions of the California
Government Code.

16. NOTICES
Any notices, certificates, or other communications hereunder shall be given either
by personal delivery to CONSULTANT's agent (as designated in Section 1 hereinabove) or to
CITY as the situation shall warrant, or by enclosing the same in a sealed envelope, postage
prepaid, and depositing the same in the United States Postal Service, to the addresses specified
below. CITY and CONSULTANT may designate different addresses to which subsequent
notices, certificates or other communications will be sent by notifying the other party via
personal delivery, a reputable overnight carrier or U. S. certified mail -return receipt requested:

When CITY's consent/approval is required under this Agreement, its
consent/approval for one transaction or event shall not be deemed to be a consent/approval to
any subsequent occurrence of the same or any other transaction or event.
18. MODIFICATION
No waiver or modification of any language in this Agreement shall be valid
unless in writing and duly executed by both parties.
19. SECTION HEADINGS
The titles, captions, section, paragraph and subject headings, and descriptive
phrases at the beginning of the various sections in this Agreement are merely descriptive and are
included solely for convenience of reference only and are not representative of matters included
or excluded from such provisions, and do not interpret, define, limit or describe, or construe the

intent of the parties or affect the construction or interpretation of any provision of this
Agreement.
20. INTERPRETATION OF THIS AGREEMENT
The language of all parts of this Agreement shall in all cases be construed as a
whole, according to its fair meaning, and not strictly for or against any of the parties. If any
provision of this Agreement is held by an arbitrator or court of competent jurisdiction to be
unenforceable, void, illegal or invalid, such holding shall not invalidate or affect the remaining
covenants and provisions of this Agreement. No covenant or provision shall be deemed
dependent upon any other unless so expressly provided here. As used in this Agreement, the
masculine or neuter gender and singular or plural number shall be deemed to include the other
whenever the context so indicates or requires. Nothing contained herein shall be construed so as
to require the commission of any act contrary to law, and wherever there is any conflict between -
any provision contained herein and any present or future statute, law, ordinance or regulation
contrary to which the parties have no right to contract, then the latter shall prevail, and the
provision of this Agreement which is hereby affected shall be curtailed and limited only to the
extent necessary to bring it within the requirements of the law.
21. DUPLICATE ORIGINAL
The original of this Agreement and one or more copies hereto have been prepared
and signed in counterparts as duplicate originals, each of which so executed shall, irrespective of
the date of its execution and delivery, be deemed an original. Each duplicate original shall be
deemed an original instrument as against any party who has signed it.

22. IMMIGRATION
CONSULTANT shall be responsible for full compliance with the immigration
and naturalization laws of the United States and shall, in particular, comply with the provisions
of the United States Code regarding employment verification.
23. LEGAL SERVICES SUBCONTRACTING PROHIBITED
CONSULTANT and CITY agree that CITY is not liable for payment of any
subcontractor work involving legal services, and that such legal services are expressly outside
the scope of services contemplated hereunder. CONSULTANT understands that pursuant to
Huntington Beach City Charter Section 309, the City Attorney is the exclusive legal counsel for
CITY; and CITY shall not be liable for payment of any legal services expenses incurred by
CONSULTANT.
24. ATTORNEY'S FEES
In the event suit is brought by either party to construe, interpret and/or enforce the
terms and/or provisions of this Agreement or to secure the performance hereof, each party shall
bear its own attorney's fees, such that the prevailing party shall not be entitled to recover its
attorney's fees from the non -prevailing party.
25. SURVIVAL
Terms and conditions of this Agreement, which by their sense and context survive
the expiration or termination of this Agreement, shall so survive.
26. GOVERNING LAW
This Agreement shall be governed and construed in accordance with the laws of
the State of California.

27. ENTIRETY
The parties acknowledge and agree that they are entering into this Agreement
freely and voluntarily following extensive arm's length negotiation, and that each has had the
opportunity to consult with legal counsel prior to executing this Agreement. The parties also
acknowledge and agree that no representations, inducements, promises, agreements or
warranties, oral or otherwise, have been made by that party or anyone acting on that party's
behalf, which are not embodied in this Agreement, and that that party has not executed this
Agreement in reliance on any representation, inducement, promise, agreement, warranty, fact or
circumstance not expressly set forth in this Agreement. This Agreement, and the attached
exhibits, contain the entire agreement between the parties respecting the subject matter of this
Agreement, and supersede all prior understandings and agreements whether oral or in writing
between the parties respecting the subject matter hereof.

SCOPE OF SERVICES
Identify potential State Government funding opportunities that match the City's funding
needs.
2. Develop strategies to achieve the identified priorities, concentrating first on opportunities
with the greatest chance of success.
3. Generate support for the City's agenda among members of the California Legislature, key
committees, the Executive Branch, and State agencies.
4. Develop and maintain good working relationships between the City and the California
Legislature, committee members, State agencies and through personal meetings, briefing
papers, testimony, letters, and direct communication with City officials.
5. Work with City officials in the preparation of grant applications or requests as required
by funding agencies. Monitor the progress of applications and work on behalf of the City
to ensure approval.
6. Secure funding for City projects through appropriations and follow up support on
competitive applications.
7. Monitor and provide analysis on all regulatory and legislative developments that may
affect the interests of the City and work to enhance the City's position by securing timely
information about policy developments and opportunities.
Report regularly to designated City officials and staff on implementation of the City's
agenda and on policy developments and opportunities.
9. Commit the time and resources necessary to develop and implement a successful strategy
for the City including coordinating trips to Sacramento to meet with legislators and
agency representatives.
10. Prepare support materials and represent the City in State hearings in which funding
requests of the City are heard.
11. Provide support including briefing papers, talking points, etc. when City officials are
requested to testify before a committee or legislator's staff.
12. Provide support on requests brought to the City Council or Intergovernmental Relations
Committee by City departments, which required contact with a governmental agency
outside the City.

EXHIBIT "B"
Payment Schedule (Fixed Fee Payment)
1. CONSULTANT shall be entitled to monthly progress payments toward the fixed fee
set forth herein in accordance with the following progress and payment schedules.
2. Delivery of work product: A copy of every memorandum, letter, report, calculation
and other documentation prepared by CONSULTANT shall be submitted to CITY to demonstrate
progress toward completion of tasks. In the event CITY rejects or has comments on any such
product, CITY shall identify specific requirements for satisfactory completion.
3. CONSULTANT shall submit to CITY an invoice for each monthly progress payment
due. Such invoice shall:
A) Reference this Agreement;
B) Describe the services performed;
C) Show the total amount of the payment due;
D) Include a certification by a principal member of CONSULTANT's firm that
the work has been performed in accordance with the provisions of this
Agreement; and
E) For all payments include an estimate of the percentage of work completed.
Upon submission of any such invoice, if CITY is satisfied that CONSULTANT is making
satisfactory progress toward completion of tasks in accordance with this Agreement, CITY shall
approve the invoice, in which event payment shall be made within thirty (30) days of receipt of the
invoice by CITY. Such approval shall not be unreasonably withheld. If CITY does not approve an
invoice, CITY shall notify CONSULTANT in writing of the reasons for non -approval and the
schedule of performance set forth in Exhibit "A" may at the option of CITY be suspended until the
parties agree that past performance by CONSULTANT is in, or has been brought into compliance, or
until this Agreement has expired or is terminated as provided herein.
4. Any billings for extra work or additional services authorized in advance and in
writing by CITY shall be invoiced separately to CITY. Such invoice shall contain all of the
information required above, and in addition shall list the hours expended and hourly rate charged for
such time. Such invoices shall be approved by CITY if the work performed is in accordance with the
extra work or additional services requested, and if CITY is satisfied that the statement of hours
worked and costs incurred is accurate. Such approval shall not be unreasonably withheld. Any
dispute between the parties concerning payment of such an invoice shall be treated as separate and
apart from the ongoing performance of the remainder of this Agreement.

SUBJECT: Additional Information Regarding Selection of a Lobbyist to Represent the City
in Sacramento
At the City Council meeting of December 17, 2007, the City Council postponed action on the contract for
Advocation, Inc. so that additional information could be provided.
Attached is a letter from Advocation outlining their accomplishments for the city during the years they
have worked with us. It also discusses their plans to assist the city this year.
The following are a few highlights of Advocation's accomplishments during the years they have worked
with the city.
• 2002 - Advocation worked in conjunction with our City Treasurer, Assemblyman Harman, and a
consortium of cities in assuring passage of AB 81. Passage of AB 81 protected property tax revenue
the city received as a result of having a power facility located within the city.
• 2003 - Advocation worked closely with our state legislators in moving forward the city's position on
AB 710. AB 710 ultimately established the current configuration of the OCTA Board.
• 2004 - Advocation worked closely with our state legislators in moving forward the city's position on
AB 2690 (excluding volunteers from prevailing wage requirements when working on local public
works projects such as Shipley Nature Center). They also provided timely analysis of critical
legislation related to the state budget's impact on the city.
• 2005 - Advocation represented the city in hearings regarding Assemblyman Harman's Condo
Conversion bill (AB 14) and they helped to get language included in the California Clean Water, Safe
Neighborhoods, and Coastal Protection Act (SB 153), which gave acquisition of closed school sites a
preference in receiving funding. They also worked with the Mayor, staff, and the Huntington Beach
Conference and Visitors Bureau in getting Senator Simitian's Resolution (SCR 60) tabled. It would
have designated Santa Cruz as the official "Surf City, USA" for the State of California.
• 2006 - Advocation kept us informed on the initiatives being put forth through both the legislative
process and the petition process. They also tracked several bills of interest to the city and closely
monitor Senator Simitian's, Surf City, USA Resolution (SCR 60) so that we would be able to respond
if he brought it back to floor for consideration.

You have asked us to provide a summary of Advocation's activities on behalf of the City
of Huntington Beach for 2007 and to identify issues which may be of concern to the City
as we enter the 2008 Legislative Session.
I am proud of our mutual successes during our representation of the City of Huntington
Beach. Advocation has most recently protected the City's interest with respect to helping
defeat Senate Concurrent Resolution 60 which would have granted the City of Santa Cruz
the distinction of being "Surf City U.S.A." and our efforts (working with the Robert
Mayer Corporation) to defeat Assemblyman Lloyd Levine's onerous time share proposal
contained in Assembly Bill 1459. Over the course of our eight years representing
Huntington Beach we have worked on issues affecting storm water runoff, the acquisition
of the Bolsa Chica Mesa using Proposition 50 funding and various water quality related
initiatives impacting the quality of life at the public beaches and tourism economy.
Advocation also sponsored AB 14 on behalf of the City to prohibit an assessor from
assigning any parcel numbers or preparing a separate assessment or separate valuation to
divide any existing residential structure into a subdivision, until state and local
requirements have been complied with. This bill was an important bill to the City and its
constituents as a result of conduct by local officials and developers.
We believe 2008 will be an extremely challenging year to protect vital community
services, and infrastructure investment in Huntington Beach.

Summary of 2007 Activities:
The Governor and the Legislature paid a great deal of attention to redistricting, levees
and water supply, health care reform, prison reform, disaster preparation, eminent domain
and adjusting term limits during the 2007 legislative session. There are currently two
special sessions active on healthcare and water and an additional session on the Budget to
be called on January 10, 2008. There remain a significant number of two-year bills
addressing infrastructure initiative implementation and appropriations for the bonds
passed in 2006. We work regularly with the League of California Cities and attend the
City caucus meetings on Thursdays, which is an opportunity for lobbyist representing
various cities to gather and share information on issues of interest.
Advocation reviewed all 3103 measures introduced in the Legislature and actively
lobbied and monitored 162 bills on behalf of the City of Huntington Beach. Of particular
concern were those major measures that were supported or opposed by City of
Huntington Beach including the following: AB 19, AB 258, AB 411, AB 468, AB 630,
AB 823, AB 1338, AB 1355, AB 1430, AB 1459, AB 1597, AB 1634, SB 4, SB 5, SB
286, SB 303, SB 645, SB 710, SB 857, SB 964, SB 1000, SB 1028, SCA 12 (please refer
to attached chart).
Additionally, Advocation worked on measures relating to the 2007-2008 state budget and
bond implementation in order to ensure that legislative projects and issues like the
following public works identified the City's State and Federal list can be competitive for
State funding: stormwater infrastructure and water quality, Gothard/Heil Pump Station,
Main Street median improvements, energy efficiency upgrades and replacement,
neighborhood street repair, and 171h street downtown storm drains.
The following is an update on the implementation of each of the infrastructure bonds
passed in November 2006. To date, as noted by the California League of Cities, the
following has occurred:
Transportation Bond: Proposition 113: This measure provides $19.92 billion for various
transportation projects to rebuild California. Priority programs of significant interest to
Huntington Beach are:
• Local Street and Road Funds: A total of $950 million is available to cities and counties
in FY 2007-08. SB 77 (Chapter 171, Statutes of 2007), the main budget bill, allocates
$600 million (Item # 9350-104-6065), and SB 88 (Chapter 181, Statutes of
2007), the bond implementation trailer bill, allocates an additional $350 million for this
program.

Additionally, after the state budget was passed in late August, the Legislature passed two
additional clean-up measures in early September affecting this funding: AB 193 (Chapter
313, Statutes of 2007) and AB 196 (Chapter 314, Statutes of 2007), which contained the
provisions and amendments that the League and the California State Association of
Counties sought to ensure accountable, efficient and effective transportation project
delivery. AB 196 specifies that the $950 million is to be appropriated with $550 million
for cities and $400 million for counties. The allocation of $550 million to cities in FY
2007-08 guarantees that each city receives a minimum of $400,000, or half of their total
bond funds, whichever is greater. However, prior to receiving an allocation, local
governments must submit a list of projects expected to be funded with these funds to the
Department of Finance (DOF). The DOF will report monthly to the Controller on which
agencies have submitted the list to DOF. DOF will begin dispersing funds on January 15,
2008.
• Trade Corridor Goods Movement & Emission Reduction: The development of
allocation criteria for the $3.1 billion "goods movement" and air quality improvement
programs remains underway. SB 9 (Lowenthal) and SB 19 (Lowenthal) are the main
legislative vehicles seeking to define this program. These bills are stalled for the year,
however, $250 million ( included in SB 77, Chapter 171, Statutes of 2007, item# 3900-
001-6054) was allocated in the budget to the Air Resources Board to fund projects in FY
2007-08 intended to improve air quality along four of California's major transportation
corridors: from the Los Angeles ports to the Inland Empire, State Route 99 in the Central
Valley, the San Francisco Bay Area, and the San Diego border region.
• State -Local Partnership: There are two measures in the Legislature that attempt to
define the $1 billion State -Local Partnership Program, which requires a local match to
access transportation bond funds - AB 1351 (Levine) and SB 748 (Corbett). These bills
differ in the criteria for eligible matching funds. AB 1351 includes only sales tax
dedicated to transportation as a match, thus limiting the program only to "self-help"
counties. SB 748 broadens the local match to also include all voter approved taxes and
fees, bridge tolls and Uniform Developer fees.
• Local Bridge Seismic Retrofit: $13.5 million was allocated (SB 77, item # 2660-104-
6062) to the California Transportation Commission for this program, to be allocated prior
to June 30, 2010. An additional $2.8 million maybe expended for this program with the
approval of the Department of Finance. Funds will be administered by Caltrans to
provide the federal match requirement for local agencies for work on bridges, overpasses,
and ramps.
• High -Priority Grade Separation Projects: $122.5 million (SB 77, item# 2660-104-
6063) was allocated for high -priority grade separation projects. Guidelines for this
program must be adopted by February 15, 2008. Prior to adoption, the California

Transportation Commission will hold two hearings, one north and one south, to get
public input on the draft guidelines.
• Public Transportation Capital Improvements: Prop. 1B designated $4 billion for various
transit improvements, of which $3.6 billion will be distributed per an established formula
among the state's transit agencies. SB 88 (Chapter 181, Statutes of 2007) contains
additional allocation criteria. The budget bill (SB 77, item# 2640-104-6059) appropriates
$600 million for these transit capital improvements projects.
Housing and Infrastructure Bond: Proposition 1C: This measure allocates $2.85 billion
for housing and infrastructure projects, most of which will be distributed by the
Department of Housing and Community Development (HCD). Approximately half of the
bond, $1.45 billion, will fund existing programs including the Multifamily Housing
Program (MHP), Emergency Housing Assistance Program (EHAP), and Building Equity
and Growth in Neighborhoods (BEGIN) programs. The remaining $1.4 billion is
designated for infill infrastructure ($850 million), parks ($200 million), transit -oriented
development ($300 million), and innovative programs ($100 million).
• Funding for Infill Infrastructure: $240 million has been made available for a wide
variety of capital improvements to support infill development. Grants are available to
local agencies and non-profit or for profit developers for developing in qualifying infill
areas. Housing element compliance is a precondition. 15% of housing units must be
affordable (for very low income households if the units are rental, or for moderate
income households if the units are owner -occupied). Priorities will be given to projects
that can demonstrate project readiness, higher density, proximity to transit, parks, schools
and jobs, consistency with adopted regional blueprints, and demonstrated local support.
Additional guidelines are to be developed by HCD. (SB 86, Chapter 179, Statutes of
2007, Sections 27, 28 and 39 contain definitions and criteria. SB 77, the budget bill,
contains the appropriation, item #2240-101-6069). Additionally, AB 1053 (Chapter 692,
Statutes of 2007) authorizes business improvement districts to apply for these funds
through a joint application with a city or county.
• Brownfield Remediation: $60 million is allocated for loans and grants to cleanup
brownfields that promote infill residential and mixed use development consistent with
regional and local land use plans. This program is required to be administered, in
consultation with HCD, through the California Recycle Underutilized Sites (CALReUse)
program operated under the state Treasurer's Office. (SB 86, Chapter 179, Statutes of
2007, Sections 27, 28 and 39 contain definitions and criteria. SB 77, the budget bill,
contains the appropriation, item #2240-101-6069).
• Transit Oriented Development: $95 million is allocated to a program created under
Proposition 1 C designed to provide assistance to public agencies and developers with

developing higher density housing within one -quarter mile of a transit station (SB 77,
item # 2240-101-9736).
• Parks and Housing: The budget did not contain an allocation for the $200 million that
was included in Prop. I for parks. AB 1252 (Caballero), a League supported bill, which
contained implementation criteria for this program was held in the Senate Appropriations
Committee.
• Housing Innovations Fund: SB 586 (Chapter 652, Statutes of 2007) allocates the $100
million from Proposition 1 C for the Housing Innovations Fund among four programs as
follows: 1) $35 million is designated for the local housing trust fund matching grant
program established under Proposition 46; 2) $50 million is designated to fund the
acquisition of property to develop or preserve affordable housing; 3) $5 million is
available for the Construction Liability Insurance Reform Pilot Program (The purpose of
the program is to promote best practices for residential construction quality control as a
means of reducing insurance rates for condominium developers); and, 4) $10 million is
available to increase and maintain affordable homeownership opportunities for
Californians with lower incomes.
Proposition 84: Environmental Quality Bond: This measure designates $5.4 billion for
improving natural resources and water programs including state projects and flood
control, safe drinking water, water quality improvement, integrated water management,
water planning and sustainable communities. No funding was appropriated for these
purposes in the budget.
However, several measures remain to be debated, including:
• $400 Million in Park Funds: AB 31(De Leon) is in position as the central remaining
vehicle for allocating these funds, as other bills have either been amended or stopped.
Significant additional amendments are expected in 2008.
• $90 Million in Planning Funds & $90 Million in Urban Greening: SB 732
(Steinberg), was comprehensively revised within the last several days of the legislative
session to focus primarily on the allocation of these funds. This measure creates a
"Sustainable Communities Council" to coordinate the activities of various state agencies
that aim to improve air and water quality, natural resource protection, affordable housing,
and transportation through land use planning. It is likely that additional discussions will
take place on how to best spend these funds during the 2008 legislative year, which may
lead to additional legislative proposals.
Proposition 1E: Levee Bond: This bond designates $4.09 billion in bond funding for
critical river levee repair and construction, flood control projects and the updating and

repair of old water mains and sewer systems. It also includes $290 million to create flood
protection corridors and floodplain mapping. SB 85 (Chapter 178, Statutes of 2007), a
budget trailer bill, establishes several reporting requirements related to the expenditure of
bond funds for levees, and limits local cost share requirements for the facilities part of the
State Plan of Flood Control and specified urban areas.
Proposition 1D: Education Facilities Bond: This bond establishes $10.5 billion for
performing school building repairs, and providing innovative learning facilities for
California students, including seismic retrofitting and classroom repairs. One of the open
issues is the allocation of $29 million to fund joint -use projects for construction of K-12
school facilities. SB 35 (Torkalson) proposes to expand the definition of projects and
what is considered local contributions under the school facilities joint -use program.
2008 PROJECTIONS:
The state budget has a deficit for the remainder of the current fiscal year and the next
fiscal year in the current amount of $14 billion. Additionally, all of the two-year bills
that remain active in the legislature will need to be monitored and reviewed by the City to
determine the individual impacts and decide if positions are to be taken. These include
measures relating to expenditure of the infrastructure bond measures.
Among the issues that remain at the forefront of the 2008 session is eminent domain.
The Howard Jarvis group has an initiative that will be similar to Prop. 90; it also contains
vacancy de -control so that if a unit becomes vacant, rent control is eliminated. The
Redevelopment Association and the League of Cities is sponsoring a measure that will
apply to single family residences and it will include a provision that if the League
measure gets more votes than the Jarvis measure, the League's provisions will take
effect.
Additionally, there are numerous regulatory and statutory matters that pertain to global
climate change. There are 15 scoping groups at the Air Resources Board which are
looking at issues and will make recommendations for policy changes.
Senator Steinberg's SB 375, which relates to affordable housing, remains very active and
Advocation participated in a lobbying collation that was seeking amendments to make the
measure more compatible to Huntington Beach's desires.
We will continue to pursue funding from all of the infrastructure initiatives for projects in
Huntington Beach. This includes funding from the $3 billion in goods movement, $0.5
billion in local partnership money, Proposition 84, the $900 million for infill
development and parks, as well as transit dollars and water bond funds.

There are proposals before the Legislature to increase waste diversion beyond the current
50% level to 75% by the year 2020. Additionally, there may be some public safety
money to assist in fighting gang crimes.
We will continue to remind the Legislature that Prop. 1A, which protects local
government funding, passed by an 84% vote and that the need for the Prop. 42 dollars
remain as high as ever. The Governor has announced that a fiscal emergency will be
declared when his budget is submitted and this will likely lead to potential efforts that
will put enormous pressure on the Administration to cut local resources. If there were
ever a need to have representation in Sacramento for the City of Huntington Beach, 2008
is the year in which it occurs.
Lastly, we have a great opportunity to assist the City of Huntington Beach in it's
Washington D.C. efforts since Ron Loveridge, Chuck Cole's faculty advisor at the
University of California at Riverside and the person most responsible for Mr. Cole's
being in Sacramento, is the incoming president of the National League of Cities.
As estimates of the California's chronic general fund budget problem continue to grow,
we must remember that it wasn't too long ago when the California Legislature looked to
local revenues to help solve budget shortfalls. We'll need to protect against cuts to cities,
Redevelopment Agencies, Prop. 42 and property tax raids.
Prop. lA prohibits the state from:
• Shifting property taxes from cities, counties or special districts with certain
exceptions;
Reducing the local Bradley Burns Uniform Sales & Use Tax rate or altering its
method of allocation (except to comply with federal law or an interstate compact);
• Decreasing vehicle license fee (VLF) revenue from the 0.65 percent rate without
providing replacement funding to cities and counties. The state may charge for
administrative costs (California Department of Motor Vehicles, Controller) and
the Legislature retains the power to change state law allocating VLF revenue
among cities and counties; and
• Failing to reimburse to cities and counties for local sales tax revenues shifted to
fund state economic recovery bonds under the triple -flip.
Prop. lA also expands definition of "state mandate" to include the transfer of
responsibility of a program for which the state previously had full or partial
responsibility. Under Prop. IA, the state is required to suspend any state mandate upon
local government in any year the Legislature does not fully fund the mandate, including
for all costs incurred in prior years.

Beginning in FY 2008-09, the Legislature may temporarily suspend the property tax
revenue protection provisions of Prop. I under certain very restrictive conditions. The
Legislature may "borrow" not more than 8 percent of total property tax revenues
(currently around $2 billion) if:
l . The Governor issues a proclamation of "severe fiscal hardship;"
2. The Legislature enacts an urgency statute suspending Prop. I property tax
protection with two-thirds vote of each house; and
3. The Legislature enacts a law providing for full repayment of the "borrowed
funds" plus interest within three years
The Legislature may not enact such a suspension more than twice in any 10-year period
and may only do so if any previous borrowing under this provision has been repaid.
Prop. 42 of 2002 earmarked revenues from the state sales tax on gasoline for
transportation purposes including local streets and roads. Under longstanding provisions
of Prop. 42 and its implementing legislation, cities and counties received no allocations
this year. In FY 2008-09, however, cities are due to receive nearly $300 million
(allocated on a per capita basis), with a like amount allocated to counties, and another
$300 million to public transportation.
In November 2006, the voters of California approved another Prop. IA, this one
providing protections for the Prop. 42 transportation sales taxes. Similar to the property
tax protections in Prop. IA of 2004, the 2006 measure provides that the Legislature may
borrow revenues Prop. 42, but only under the same stipulations posted for Prop. lA
(2004) listed above.
The state budget is expected to carry over a debt from FY 2007-08. That amount,
combined with the projected shortfall between spending and revenue, brings the deficit to
nearly $14 billion. Confirming the budgetary news at a press conference on Wednesday,
November 14, Legislative Analyst Elizabeth Hill also cautioned that the shortfall is
anticipated for a number of years into the future.
The LAO identified several factors contributing to the state's budget problem, including
the lower state revenue projections due to the economy's current outlook, lower property
taxes and impact on K-14 education funding. Additional factors include an expected
delay in the sale of EdFund and its value, the delay in new tribal compact implementation
and a court ordered payment to the state's teacher retirement system.
The Governor will issue his proposed Fiscal Year 2008-09 State Budget on January 10,
2008 and the fireworks will begin. 2008 will be a very challenging year in Sacramento
and Advocation would be very proud to continue to serve as Huntington Beach's state
lobbyist.
