(1) All mechanics and laborers employed in the construction of project shall be paid unconditionally and not less often than once a week, and without subsequent deduction or rebate on any account, except such payroll deductions as are permitted by Regulations of the Secretary of Labor, Part 3 (29 CiR Part 3), the full amounts due at the time of payment computed at wage rates not less than those contained in the applicable wage determination decision of the Secretary of Labor, regardless of any contractual relationship which may be alleged to exist between the contractor and such laborers and mechanics; and the applicable wage determination decision shall be posted by the Contractor at the site of the work in a prominent place where it can be easily seen by the workers. (2) A breach of the foregoing conditions may be grounds for termination of the contract, and for debarment as provided in 29 CFR 5.6 and 24 CFR 200.190 - 200.195. ARTICLE 2 - EQUAL EMPLOYMENT OPPORTUNITY During the performance of this contract, the contractor agrees as follows: A. The contractor will riot discriminate against any employee or applicant for employment because of race, religion, color, or national origin. The contr,actor will take affirmative act).on to ensure that applicants are employed, and that employees, are treated during employment without reclard to their race, religion, color or national origin. F. in the event of the contractor's noncompliance with the nondiscrimina- tion clauses of this contract or with any of the said rules, regulations, or orders, this contract may be canceled, terminated or suspended in whole or in part and the contractor may he declared ineligible for further government contracts or federally assisted c;,ristruction contracts in accordance with procedures authorized in Executive Order 112,16 of September 24, 1965, and such other sanctions may be imposed and remedies invoked as provided in Exe-:utive Order 11246 of September 24, 1.965, or by rule, regulations, or order of the Secretary of Labor, or as otherwise provided by law. G. The contractor will include the portion of the sentence immediately preceding paragraph A and the provisions of paragraphs A through G in every subcontract or purchase order unless exempted by rules, regulations, or orders of the Secretary of Labor issued pursuant to section 204 of Executive Order 11246 of September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor. ANALYSIS: The following is a summary of the contract costs and a discussion of the contract changes: Original Contract Bid $1,447,225.00 Deleticn to contract kid items (199,688.05) Change order Amount 120,091.01 S1,367,627.96 Change orders were issued to modify the structural street section by lime treating the subgrade to correct problems of poor soil conditions and peat stratas. The change in structural section was also necessary to avoid conflicts with various very shallow utility lines. By lime treatment of the subgrade, reductions were able to be made in the contract bid items for excavation and aggregate rock base resulting in a final cost less than the original contract amount. It is required for a corporation that the President and Secretary of the corporation must sign the contracts and also sign the hold harmless clause on the ceriific,ate of insurance. After signing, return to this office together with the Labor and Materials Bond equal to fifty percent (50-0 and Performance Bond in the amount of one hundred percent (109%) of the contract price. A guarantee for the project shall be furnished to the City and may be included as part of the Faithful Performance Bond. There shall be express wording in the Performance Bond if such bond includes the guarantee or warranty of the labor and materials fr,r a one year period commencing with the filing of the Notice of Completion and acceptance of the contract by the City. The guarantee amount shall be for the full amount of the Performance Bond, Release of the Performance Bond shall not apply to the guarantee and warranty period. Also enclosed are two sets of a Certificate of Insurance in quadruplicate. This insurance form is the only one that will be accepted by the City of Huntington Beach.
