Garisek - 1976-12-20r RENTAL AGREEMENT THIS AGREEMENT made theQ± day of 1976, is by and between the CITY OF HUNTINGTON BEACH, a municipal corporation., hereinafter called "CITY," and ANTHONY L. GARISEK, hereinafter called "TENANT." WHEREAS, 'CITY orpns property at 520 Pacific Coast I3ighway in the city of Huntington Beach, known as the "Philadelphia House;" and The dwelling on subject property has been used for residential purposes; and Subject property is not now needed for a public purpose; and CITY has the opportunity to derive revenue from subject property in lieu of its current idle status; and TENANT desires to rent subjoct premises as a residence, 14OW, :RERZF0T.E, the parties hereto agree as follows 1. TENANT s'_i ail rent the premises on a month -to -month basis at a rental, of 1,111JEEE HUNDRED DOLLARS ($300) per month. Rent shall be payable on oh•before th.2 tenth (loth) of each month. 2. The leased premises are described as follows: One wocaen, two-story house located at 520 B Pacific roast Highway, in the city of Huntington Beach, as set out in Exhibit "A" attached hereto and re1_4e a pant hereof. 3.- The premises shall be used as a single family dwelling, M1M : c s I. 11/2176 4. Any and all painting, alteration, remodeling, addition or deletion to the interior or exterior of the leased premises by TENANT must have prior written approval by CITY. 5. Prior to entry upon the premises for the use described herein, TENANT shall provide CITY with a cleaning deposit in the sum of FIFTY DOLLARS ($50). Upon termination of the tenency herein, the deposit will be refunded if it is not necessary for the cleaning and restoration of the premises. 6. CITY through its designated agent shall have the right to enter the premises or building during reasonable hours to inspect or make necessary repairs for the safety and comfort of TENANT, or to exhibit a notice indicating that the building is for rent at any time within thirty (30) days before the expiration date of this lease 7. Either party may terminate this lease upon service of thirty (30) dayswrittennotice upon the other party. 8 TENANT agrees to maintain the premises in the same condition, order and repair as they are at the commencement of this term excepting only reasonable wear and tear arising from, the use thereof under this agreement. 9. TENANT agrees t3 protect, defend, indemnify and save harmless CITY against loss, damage or expense by rna.son of any suit, claim, demand, judgment and cause of action caused by TENANT, his agents or any subcontractor of TENANT, arising, out of or in consequence of the rental of subject property. ALA 10 Time is of the essence of this agreement For all sums due hereunder and delinquent for ten (1011 days, there shall 2: be added thereto on such tenth day, a penalty of ten percent (10%) of the total amount then due. 11. TENANT agrees that he will not permit waste on the premises or maintain or permit to be maintained a nuisance thereof, or use or permit the premises to be used in an unlawful manner. 12. For purposes of this agreement, all notices to be provided by TENANT shall be forwarded to the Department of Harbors, and Beaches, and said department shall be authorized by CITY to receive payment and other notice provided by this agree- ment.
