THIS AGREEPRENT is made this � day of
198 i4 by and 'between the GITI'" OF HUNTINGTON BEACH, a aunioipal
corporation of the State of California, hereinafter called "CITY,"
and ANTHONY L. G RISEK, hereinafter called "TENANT."
WHEREAS, CITY 'owns tha residential property at 520-B
Pacific Coast highway in '.he C.ty of Huntington Beach, known as,
the ".Philadelphia House;" and
:Subject property is not now needed for a public purpose, and
CITY haz the opY�rtunity to derive revenue from subject
property; ar.
TENANT deLires rent the subject premises
NOW, THEREFORE, the parties covenant and agree zs follows:
l,' PREMISES
The leased premises are de8cribed as follows:
One 'wooden, two-story house located at 520-B
Pacific Coast Highway, in tie City of
Huntington' Beach, ` as sec out in Cxliibit "A" `
atta6he. hereto and ade - part hereof.
2,, RENT
TENANT shall rent the premises on a month -to -month
',)asis at a rental of five hundred do-Ll'ars (t50O) per month. Rent
shall be payable on or before the tenth (loth) of each month.

T=NANT understands that after six (6) months from the
above date, CITY will require six hundred :dollars ($600.00) per
month for the premises. After anot'�ier six (`6)_ months, CITY may
require a further increase of rents in an amount to be determined
by that date.
Time is of the essence of this agreement. For all
sums due hereunder and delinquent for ten (10) days, there shall
be added thereto on such tenth day, a penalty of ten percent (10%)
of the total amount then due;
3. PERMISSIBLE USE
The premises shall be used solely as a single family
dwelling
4 14AINTAINENCE OF PREMISES
TENANT agrees to maintain the premises in the same
condition, order and repair as they are at the commencement of
this term excepting only reasonable wear and tear arising from the
use thereof under this agreement.
TENANT agrees that he will not permit waste on the
premises or maintain or permit to be maintained a nuisance
thereon,- or use or permit the premises to be used in an unlawful'
manner.

Any and all painting, alterut.ion, remodeling,
addition or deletion to the interior- or exterior of the leased
premises by TENANT must have prior written approval by CITY.
TENANT shall provide CITY with a clearing deposit in
the sumof fifty dollars ($50.00). Upon termination of the
tenancy herein, the deposit will be refunded if it is not
necessary for the cleaning and restoration of the premises.
CITY through its designated agent shall have the
right to enter the premises or building during reasonabli_hours to
inspect or make necessary repairs for the safety at.a comfort of
TENANT, or to exhibit a notice indicating that the building is for
rent at anv time within thirty (30) days before the expiration_
date of ;this lease.
5. TEPOINATION
Either party may terminate this lease upon service of
thirty (30) days written notice upon the other party.

For purposes of this agreement,all, notices to be
provided by _TENANT shall be Forwarded to the Real Property
Manager, and said department shall be authorized by CITY to
receive payment and other notice provided by this agreement.

Statement of Issue Recommendation, Analysis, Funding Source, Alternative Actions, Attachments:
STATEMENT OF ISSUE:
A month to month Rental Ag. eement with a monthly increase from MO to $500. Rental rate
needs to be increased to reflect fair ma: ket value.
RECOMMENDATION;
Approve the attachnd'rental agreement with Mr. Ai)thony L. Garist.k and authorize the Mayor
to execute the same.
ANALYSIS:
On December 29, 1976, the City of Huntington Beach entered into a month to month Reol.70
Agreement with Mr. Anthony L. Garisek forpropertylocated at 520-6 Pacific Coast Highw._f,
in the amount of $300 per month. The property was originally leased on an in:6rim basis
because of pending downtown redevelopment. The tenant has maintained and refurbished the
property at his own expense in an admirable manner over the years.
The current lease was reviewed by the Real F;^operty Management Division, and a physical
inspection was made. The property was found in a well kept condition considering the age of
the house. The staff recommends a rent increase, in stages, starting in August at $500 per
month and $600 per month in six(6) months. Thereafter, every six (6), months make an
adjustment increase as may be fair and reasonable_

Raise rents even higi,ar. Leave rent at present level.
