ARTICLE 1 - LABOR STANDARDS

and not less often than once a week, and withoc! subsequent deduction of rebate on any ac-ounl, ex-

(i) (a) A copy of all payrolls, including those t,f all subcentraclom, shall fie submitted weekly to the
FHA by the prime contractor. The copy of each paytoll shall be accompanied by a "Weekly
Statement of Compliance" In the form specified In Regulations of the Secretaty of Labor, Part 3 (29 CFR
Pact 3). The statement shall be executed by Cite employer (ownet, partner or corporate oiticer) at, if n copy
of a current letter of atithorizution sigrird by the employer is furnished to the FIIA, the statement may he
signed by the employee authorized in said leper to supervise the payment of the employees. In addition, each

of Bebek Company on CC-415.
Recommendation:
Adopt a resolution authorizing a negotiated settlement with the Bebek
Company. The City Attorney's office has informed us that this is a
highly attractive settlement, and it is recommended that vour Honorable
Body approve the settlement and authorize the payment of $2,857 to
Bebek Company.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING PAYMENT OF
SETTLEMENT AGREEMENT FOR CLAIMS FOR DAMAGES
REGARDING PUBLIC WORKS CONTRACT CC-415
WHEREAS, the City Council of the City of Huntington Beach,
at their meeting of September 9, 1977, awarded a contract to the
Bebek Company for the construction of the Delaware Street Storm
Drain Phase I, Cash Contract 415, and claims filed arising out
of their contract shall be paid for out of related drainage
funds if funds are available, and if not, then out of the gas
tax funl; and
Bebek Company has now completed the storm drain construction
and has filed six claims totaling $12,011-36 against; the City of
Huntington Beach in connection with Public Works Cash Contract
CC-415; and the Director of Public Works, City Administrator
and the City Attorney's office recommtnd that it is in the best
interests of the city to settle such claims, and through exten-
sive settlement negotiations with Debek Company, and their
attorneys, a settlement amount of $2,857 has been agreed upon
subject to approval of the City Council; and
Bebek Company will file a release for all claims and causeFa
of action against the city regarding this matter,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington .Beach that the payment of $2,857 is hereby
authorized to be made to Bebek Company in exchange for a full
release of all. claims and damages regarding Cash Contract CC-U15.

Statement of Issue
.he Bebek Company has coi!.pleted, at a total contract price of $614,363.00,
the Delaware Street storm drain which is Phase II of the Old Town storm
drain project. Four change orders were issued and additional contract
quantities were installed, increasing the contract price from $606,080
to $614,363.00. Approval is needed for the change orders.

Approve Change Orders 1 thru �'in the amount of $5,429, accept the work
completed by Bebek Company,`and instruct the City Clerk to file the
Notice of Completion.
Analzsis
The following is a summary of the contract costz and discussion of the
contract changes:

Total contract price $614,363.00
The $2,854 for additions to contract quantities represents the difference
between the quantities used on the project and the quantities called out
in the contract. This occurs because the contract is based on ctimates
of quantities to be installed during construction.
The analysis of the change orders is as follows:

An additional exhibit. xas added to the supplemental conditions of the
contract. This exhibit was required by the Housing and Community Develop-
ment Administration_. This change was made at no cost to the City.

Change Order No. 2
It was necessary to relocate a catch basin and connector pipe from
the location shown on the project plans because the street improve-
ment plans for a proposed subdivision show that a curb return will
be installed at that location. The total cost of $595 is based on
the contract unit prices.
Change Order No. 3
This change order was issued for two reasons. First, it was ncL:-
essary to revise the re -construction plans for Delaware Street
between Adams and Utica because the existing structural section was
discovered to be 4" of asphalt concrete over 15" of base material
instead of the 3" over 10" as called out in the project plans. The
cost of this part of the change order is $8,834. The second part
represents a credit to the City of $4,000 for the paving of Delaware
Street adjacent to Tract 9481. This paving will be done as a con-
dition of development .for this subdivision. The total cost of this
change order is $4,834.
Change Order No. 4
It was necessary to extend the time of completion for this contract
from February 24th to June 10, 1078. This extension of time was
granted because of the inclement -weather and wet trench conditions
experienced by the contractor during the winter. There is no cost
to the City for this change order.

Council held Monday, September 191. 1977.
Will you kindly execute the: contract= and have all signatures notarized
on all copies and return to this office., together with the Labor - and
Materials Bond equal to fifty percent (50%) and Performance Bond ill the
amount of one hundred percent (100%) of the contract price. Also
enclosed are two sets of a Certificate of Insurance in quadruplicate.
This insurance form is the only one that will bc: accepted by tiie City
of Huntington Beach. Please return one set with the bonds and executes
contracts.

STATEMENT
On August 15, 1977 the City Council authorized a call for bids
for the subject project.
RECO14M.ENDED ACTIOh7
Accept the low bid and award the contract to Bebek Company,
167'06 Construction Way East, Irvine, ('dli.forni.a 92714, in the
amount of $606,080.00 and reject all other bids.
ANALYSIS
The project was estimated to cost $531,000. The reasons for
the higher bids are that the construction is to take place in
the winter months (we estimated it to be done in dry weather).,
and the close proximity of the County Sanitation District. trunk
line to the storm drain trenching operation. The bids were re-
ceived on September 16, 1977 and are listed below in order of

and shall be opened by a committee composed of the City Clerk, the City
Attorney and Director .of Public Works or their authorized representative
and the results of said bidding will be reported to -the City Council of said
City of Huntington Beach at'the-ir regular meeting to be held on Monday, the
19th of September, 1977, at the hour of 7:30 P.M. in the City Council Chambers
in,the Civic ^enter of said City of.;Huntington Beach, and shall be acted
upon by said City Council at the regular meeting of September 19, 1917.

Call for Bids, Delaware Storm. Drain; CC--4'.5
.This portion of City experiences and is,subject to flooding con—
ditions. This project is Phase II'of the Old Town S norm Drain
required to serve the area.
RECOMMENDED ACTION:
1. Approve the Plans and specifications and authorize the call
for bids.
2. Authorize -the use of Contingency Funds to finance the unfunded
portion of this project, to be repaid by future drainage fees
collected in Drainage District No, 8G.
ANAVYSIS:
This, project will construct 96 and 43 •inch storm drains, .junctir..n
structures,,catch basins and connector pipes Iin Delaware Street be—
tween Adams Avenue and Yorktown Avenue., These facilities are Phase
II of the Old Town Drainage System.
The project was.round to be in conformance with the General Plan by
the Planning Commission on February 23, 1977.
BIR 73--23 was adopted by the City Council on April 21, 1975, this
project being'a portion of the system considered.
FUNDING SOURCE;
The project is es4imated at $531,000.00.-

H.C.D. funds in the amount of $300,00�0 have previously been approved
and allocated for the project. The project is within Drainage
District 8G with funds of $1.75,000 available.
We are requesting that the remaining, portion of the project, -.approxi—
mately $56,Q001 be funded with monies from the Contingency Fund to
be repaid from future drainage fees to be collected in the project
area drainage district.. We anticipate development in area 8G will
reimburse the Contingency Fund within six months of the start of
construction.
