'N.eelsr, Director of Public Works FROM: water Suparintendent DATE: October 27, 1.967 &T3JE►CT: Report o;a DFuage by Water to Road Being Conetructed by Douglas Misaile and Space Division On February 7, 1967, Beylik Drilling Company, 11118 luitwiller Avenue, Whittier, otarted to drill a water wel'! , located 600 feet west of Springdale Street and 27 feet south of the United States Navy Railroad for the city of Huntington Beach. The water well was completed and accepted by the city of Huntington Beach on March 27, 1967. Prior to the start of drilling operation the City obtained permission from Douglas to sheet flow water over their property to the sou Wh. (Copy attached.) On or about February 202, Douglas started to construct a new east -went road 1435 feet north of Bolea Street at Springdale Street. Due to the construction of this rcad the City built a dyke 800 feet lo2;g from Springdale Street west, then 600 feet north to the U.S.N. R.i�. This dyke was built to keep water from entering th%.� new road construction during developing of the water well. On March 16, 196-7, at 3:30 P.M. cleaning, development and test. of the water well e , od. `•rixig the developing and t.. sting tha water wellgroduaed i xom 221��J tip. M. to 49G4 G.P.M. The umping operation was ecked �t 7:00 P.M. by myself c�i march 16, 19g7, no water had entered the aaw road being conatructed oy Douglas, Ovate:• was f1cwing down Springdale Street on the west e!'.de at this time. During tha night of March 16 and the morning of Larch 17, 1967, the new road construction was flooded, The water entered the road through a broken. irrigation lile after. the dyked area became flooded. On the morning of March 17, 97, the City crew built a dyke cross- ing the new road to keep water from entering the new road. The City orew started pwn ing water out of the r.ew road at that time using three pump+ until l-i �i P.m. on 1.8, 1967. Paul Jones, City Clo k 0ont lemen : You will recall that by ;your letter of September 22, 19660 the City of Huntington Beach requested *fit: 113r;ion to t,!,n-et flow water on land owned by the Douglas Realty Company, Inc. a site adjac3nt to the Hantir,gton Beach reservoir situated on Springdale Street. By the Douglas Realty Gampanyr's latter of October cl, 1,966, permission was grsi,.ted to t;he City of Huntington Beach for the operations outlined in the City's letter of September 22, i(S`66. This permission was granted conditioned upon the under- standing, indicated in both the City's letter and the Douglas Realty Company's letter referred to above, that the City would be responsible for any liability during the testing of the water well. On March 16, 1967, the operations contemplated by the letters Indicated above were in progress, at which time the sheet flow of water resulting from the testing operation inundated an east west road oxtending From Springdale to Able lane which was in the process of construction. 'At that time the road bed had been graded aid compacted by the Douglas contractor, Sully -Miller Con- tracting Company. The Sully -Miller Contracting Company had taken normal precautions against Inundation in the form of a dike. How- ever, the sheet Flow of water was of such quantity that it exceeded reesonable expectations with the reault that the graded surface of the road had to be removed and replacad with dry material in order to meet contract compaction specifications. This effort resulted In a Change Order with an additional cost to Douglas of $4 995,51). Residents along the road, street, or other alignment of improve- ments shall be provided convenient access to driveways, houses, and buildings along the road or street, and temporary crossings shall be provided and maintained in good condition. Not more than one cross street or intersecting street or road shall be closed at any one time without the approval of the Director of public Works. The Contractor shall, furnish, erect, and maintain such fences, barriers, lights, and signs as are necessary to give adequate warning to the public at all times that the road or street is under construction and of any dangerous conditions to be encountered as a result thereof, and he shall also erect and maintain such warning and directional signs as may be furnished by the' City. SECTION 7. P_E_ION AND EROGREaS (a) Subletting and Assignment - The Contractor shall -Ive his personal attention to the fu'fillmert of the contract and Ahall keep the work under his control. Subcontractors will not be recognized as such, and all persons engaged in the work of construction will be considered as employees of the contractor, and their work shall be subject to the provisions of the contract and specifications. Whers a portion of the work sublet by the Contractor is not being prosecuted in a manner satisfactory to the Director of Public Works, the subcontractor shall be removed immediately on the request of the director of Fubl' c Works and shall not again be employed on tV,e work. M13- 0 0 The contract may be assigned only upon written consent of the City Council of the City of Huntington Beech. (b) Progress of the work and time for completion - The Contractor shall begin work within ten (10) days after receiving notice that the contract has been approved and shall diligently prosecute the same to completion before the expiration of the time specified in the proposal, specifications, and/or contract. (c) Character of Workmen - If any subcontractor or, person employed by the Contractor shall fail or refuse to carry out the directions of the Director of Public Works or shalt appear to the Director of Public Works to be incompetent or to act in a disorderly or improper manner, he shell be discharged inanediately upon request of the Director of Public Works, and such person shall not again be employed on the work. (d) Temporary Suspension of Work - The D4 recto-r of Public Works shall have the authority to suspend the work wholly or in part, for such period as he may deem necessary, due to unsuitable weather, or to such other conditions as are considered unfavorable for the suitable pn)secu- tion of the work, or for such time an he may deem necessary, due to the failure o-n the part of the Contractor to carry out ordero give, or to perform any provisions of the wnrk. The Contractor shall immediately obey such order of the Director of Public Wr:rks and shall not resume the work until ordered to do sty in writing by the Director of Putii.c Works. (e) Time of Completion, and Liquidated Damages - It is agreed by the parties to the contract that in case all work called for under the contract is not completed before or upon the expiration of the time limit as set forth in these specificationa, damage will, be sustained by the City of Huntington Beach and that it is and will be impractiCAhle to determine the actual damage which the City will sustain in the event of and by reason of such delay; and it is therefore agreed that the M 14. 0 Contractor will pay to the City of Huntington Bosch the sun of One - hundred dolls:ra ($100.00) per day for each and every days delay beyond the time prescribed to complete the work, or any approved extension thereof, and the ContractoT agrees to pay such liquidated damages as herein provided and in case the same are not paid, agrees that the City of Huntialitor Beach may deduct the amount thereof from any money due or that may become due the Contractor under the contract. It is further agreed that in case the work called for under the contract is »ot finished and completed in all parts and requirementsi within the time specified the Director shall have the right to extend the time for completion. if the D►irectu-- extends the time limit for the completion of the contract, the City shall f-:rther have the right to charge to the Contractor, his heirs, assigns or sureties, an,� to deduct from the final payment for the work, all or any part, as it may doom proper, of the actual cost of engineering, inspection., superintend- ence, and other overhead expenses which are directly chargeable to the contract, and which accrue during the period of such a%tension, except that the cost of final surveys and l;,eparation of final estimate shall not be included in such charges. The Contractor shall not be assessed with liquidated damages -nor the cost of engineering and inspection during my delay in the completion of the work caused by acts of God or of public enemy, acts of the City, fire, floods, epidemics, quarantine restrLctions, strikes, freight embargoes, and unitqually seve etweether or delays of. subcontractors due to such causes; provided, that the Contractor xhall within ten (10) days from the beginning o;! any �!uch .delay notify the Director of Public Works in writing of the causes of delay. The Director of public Works shall ascertain the facto and the extent of delay, and his f indir,gs of the facto thereon shall be final i.;ind Conclusive. -15- 6 0 0 (f) Suspension of Contract - If at my time in the opinion of the City Council the Contractor has failed to supply an adequate working force, or material of proper quality, or has failed in any other ,respect to prosecute the work with the diligence and force specified and intended by the terms of the contract, notice thereof in writing will be served upon him, and should he neglect or refuse to provide means for a satis- factory compliance with the contract, as directed by the Director of PubLic Works, within the time specifiers in such notice, the City Council shell have the power to suspend than operation of the contract, Upon receiving notice of such suspension, the Contractor shall discontinue performance of said work, or such parts of it as the City Council away designate. Upon such suspension, the Contractor's control shall termi- nate and thereupon the City Council or its dilly authorized representative may take possession of all or any part of the Contractoraa materials, tools, equipment and appliances upon the premises, and use the same for the purpose of completion of said contract, and hire such labor and buy or rent such additional machinery, tools, appliances, and equipment, at the Contractor's expense as may be necessary for the proper conduct of the work and for the completion thereof., or may employ other parties to carry the contract to completion, or employ the necessary workmen, substitute other machinery or materials, and purchase the materials contracted for by Contractor, it such manner as the City Council may deem proper; or the City Council may annul and cancel the contra-,t and relet the work or any part thereof. Any excess of cost arising there- from over and above the contract price will be charged agairy t the Con. tractor and his sureties, who will be liable therefor. In the determination of the question whether there has been any such non-compliance with that .ontract as to warrant the suspension or annulment thereof, the decision of the City Council is final and shall be btndiing an all parties to the contract, (g) Right- of- Way - The right of way for the work to be construct- ed will be provided by the City.
