Because it is anticipated th&t the completed Huntington Beach
Code will contain more thaw one -ol:ame, the cost for additional
binders to the Huntington Beach Code will be $6.50 per birder.
In the original contract, the cost for one sinder waa included
in the quoted price. Thus, if the completed code has two binders,
there will be a eharge of $6.50 per binder for the second volume.
A third volume to the Huntington Leach Codb will contain annota-
tions. The cost for the completion of this volume will be as
follows:

Book Publishing Company is to prepare annotations to the California.
State .ode and AcQuillin and submit the annotations to Huntington
Beach. Upon sabittissson of these annotations, Book Publishing

CALIFORNIA. PUBLICATION OF 50 COPIES OF THE CODE AND ANNUAL
SUPPLEMENTATION SERVICE.
This contract covers complete editorial work of recodification ant'
the publication of fifty (50) copies of the code (complete with
binders) in the BOOK PUBLIt-HING COMPANY MUL_ILITH FORMAT. A
sample code page is attached in this contract following the
signature page.
The code may be printed on one side of the sheet ( 1, or on both
rides of the sheet . Choice is usually based on the probable
size of the code, t6 result in a single volume of convenient size.
The 500 pages stated for Basic Cast is not an estimate of the
size of the code for the City of Huntington Beach.

PAYMENT SCHEDULE
On signing of the contract, cne-third of the basic bid
is due for payment.
An additional one-third payment is due when the Ordinance
Analysis and Report is submitted to ';he city.
The balance of t;hf total cost of the code is 1ue on delivery
of the code books to the city. in some cases, the city prefers
to have three (3) advance copies of the code delivered. These
are used to officially adopt the code. If this procedure is
followed, the balance of the total cost of the code is due on
delivery of the three (3) advance code books to the city.
By anreement between the company and the city, the payment
r'edule may be extended over a long-,r period. Balances due

The city will supply to the zaupany two legible working

not available, the city will make the ordinance books available
J_or duplicating. The company will make duplicates of the ordi-
nances necessary to the code and will charge the city the com-
pany•s cost in having the ordinances duplicated.
ME FOR COMPLETION
Time is of the essence. It is the intention of the company
to deliver the completed code volumes to the city within one
year of the signing of this contract. Should delivery be delayed
because of the city's delay in performing its duties according
to this contract, the company shall have the right to increase
the final cost of _he code to compensate for any increase in
labor, materials or overhead costs.
PRODUCTION SCHEDULE FOR CODE
1. Ordinance Analysis and Report. Upon receipt of materia.L
from the city, `Book Pul ,is ing Company will prepare an ordinance
analysis and report as described within this contract under Cod:.-
fication Procedurea and Editorial Specifications.
2. C_itY Action. 'Upon receipt of the ordinance analysis and
report, the city or authorized city representative will
review the report and recommend appropriate action to the city
council on all i,-ams contained within the ordinance analysis and
report.

3. Editorial Conference. Immediately after receipt of the
ordinance ana ys� is and report, an editorial conference will be
scheduled to be held in the city between the city attorney or
authorized city representative and the Book Publishing Company
representative. The conference will be held at a time mutually
satisfactory to both the company and the city and after the
city has had an opportunity to review the ordinance analysis and
report. At this conference, the book Publishing Company repre-
sentative and the city will review the rough code manuscript
prepared by the company in order to determire recommended or
needed changes in the city°s laws.
4. Post Conference Work. Upon completion of the editorial
conference conducted in the city, it will be the responsibility
of the city to draft and enact all amendments, repeals, and new
ordinances agreed to by the city. In most case., the amendments,
repeals, and new ordinances will be included i:i the. code upon
original publication. however, in those cases where changes or
additions will be extensive, the city may omit selected provisions
from the original codification. omitted provisions will then be
included in a later supplement.
To produce a municipal code, Book Publishing Company will
follow these pr.:ceduress
COUiFICkTION PROCEDURES AYD EDITORIAL SPECIFICATIONS
1. Examine all ordinances and codify, classify and edit,
subject to the approval of the city representative, all, ordinances
of a genexal or public .nature or imposing a fine, penalty or for-
feiture. Separate and arrange such ordinances logically according
to subject in numbered titles (first division), chapters (second
division), a ccitions ;third division)- Each division will
contain prow.L-,.Lon.• similarly related ani complete within themselves.
2. Formulate, draft and zecommend a title and chapter outline
of a proposed code structure and furnish to the city representative
a copy,of the outlined proposed code structure and classification
of exiLting ordinances (Ordinance Analysis and Report). Such pro-
posed structure and classification of ordinances will not be adopted
'intil it has been approved by the city representative.
3. Inform the city representative of all oL moded or obsolete
ordinal :es and of all apparently conflicting provisions of ordi-
nances, ,here amendment., repeal, or new legislation is deemed
neress..ry or advisable.
4. Divide each ordinance to be included in the code into short
sections, so that each Section wild. contain only one provision of
law pertaining to only one subject.

5. Techni.cai codes which have been adopted by reference ---
c.g., building, plumbing, electrical, and similar technical odes
-- will be excluded from the municipal code unless the city rep-
resentative directs the company to include such technical codes
in toto. Ordinances adopting such technical codes by reference
shall be included and classified in appropriate sections of the
municipal code.
6. All ordinances will be checked against applicable state
statutes and a ,r conflicts or inconsistencies will be pointed out
to the city representative, State Supreme Court decisions and
United States Supreme Court decisions affecting or bearing upon
the validity of the ordinances of the city will be pointed out
to the city reprF.sentative.
7. A table showing the disposition o"' each ordinance of the
city will be prepared and included in the code volume.
B. Catchli,nes for each individual section of the code will
be inserted at the beginning of each section.
9. A table of contents for each chiVter will be prepared
consisting of numerical listinge of the catchlines of the individual
sections in each particular chapter. A table of contents for each
title will be prepared consisting of numerical 'listings of the
chapters in each partycula.r title.
10. A historical citation showing its legislative history and
derivation_ will be prepared for each vection of the code.
11. Cross-references to related parts of the :ode will be
prepared with proper and appropriate references in numbered foot-
notes under the apuropriate sections of the code.
12. Only the ubstantive provisions of each ordinance will
be codified, provisions such as the 'title, ordaining clause and
attestation clause of each ordinance being omitted to the extent
permitted by law.
13. Where necessary, the lang,:ag�y of existing ordinances
will be edited, �.mproved and/or mo•de%-rtized to clarify, y(r t meanings
will not be changed.
14. The city representative shall accept or reject any or
all of the recommendations submitted by the �,ompany. The city
representative shall make all legal decisions and determine all
legal questions and shall be responsible to the city council for
such determination,
15. A complete and comprehensive general index covoring sash
section of the code will be prepared and included in the code
volume.

16. Only experienced and qualified editors and researche.-,
will be employed in all editing, research and codification work.
The supervising editor will consult the city, when necessary,
and will keep the city informed of the progress of all c;odfication
work.
17. The city aias exclusive right: to sell copies of the com-
pleted code and thn loose-leaf supplementation material.
MECHANICAL SPECIFICATIONS
1. Upon completion of the editorial, research and codification
work, the coele will be reFroducec accord�.ng to samples submit,.ed
and the style selected by the city.
2. Birders shall be a loose-leaf style selected by the c7itY
-- either the binder submitted as a sample and included in the
basic cost. or a binder ordered at an addir=oval cost, as speci-
fied by the cir ty. An appropriate title approved by the city shall
be imprinted on each binder.
3. All labor and materials for the completed code will be
furnished by Book Publishing Company tend all services will be
perform.:d in a �;rofessional and workmanlike manner.
COSTS AND PAYMENT SCHEDULE
1. The pay.,ient schedule shall be as agreed between Book
Publishing Company and the city, but unless otherwise staffed in
writing, shall be as set forth on page 2 of this 7ontract.
2. The costs shall be ac^.ordina to the biO agreement s`.gned
by Book Publishing Company and the city. The total cost is adjusted
from the basic coast according to the actual riumbei of pages -used,
the number of copies ordered, the use or ov is;sion of tabbed title
divider pages, the possible selection. of special binders at extra
cost, ar d any other pertinent factors.
3. If a State sales ta,r is applicable to this work, the
ariount of the tax is in addition to cost,i quoted in this contr.,ct.

1. It 4-;i agreed that a supplement service will be maintained
for five years. The first annual supplement is due one year after
the delivery date of the code, if desired, more frequent supplements
will be published.
2. Ordinances adopted by the.city are to be forwarded as they
are enacted. Book Publishing Company will edit such ordinances,
appending appropriate headnotes, catchlines, cross references and
explanatory noteu, and reprint the page or pages of the code amended,
reiiioving the provisions superseded by the amendment and inserting
the new provisions. The pages in the comprehensive index which are
affected by the amendment will also be revised to take account of
change.; and of new provisions and will be reprinted.
3. Copies of tha supplement pages for each code book, together
with instruction sheets containing full instructions for insertion
of all supplemental material and revised index sheats will be sup-
plied to the city,
4. Supplements will btu' in the style and format of the original
codification, Replacement pages will be provided not less tnan
once each year. The supplying of more frequent replacement pages
or the use of advance sheets will be established with experience,
according to the needs of the city.
S. Payment for the supplement service will be at the pjr--page
rare established in the signed' bid agreement. Payment is due on
delivery to the city of the replacement page supplement material.
6. The supplement service, may be terminated after five years
by written notice of cancellation not less than sixty days prior to
the date for delivery of the annual supplement material. This due
date is the anniversary date of the code, and is established as the
first day of the month in which the basic codification was completed.

closed when not in actual use. Hydrants, urinals, water
closets, bath gabs and other openings must not be left running
for any purpose other than the iise for which they are intended.
In adlition to the penalty provided herein for violati,_,ns of

tract, and consumers so offending will be required to pay

the right to shut off the supply for abuses of water priv.

Dear Mr. Frayn:
We received yesterday 50 copies of the Huntington Beach
Administrative Code, and we are most satisfied with the
completed volume.
The volume was examined in an office staff meeting and
several questions were raised. It was suggested that the
index might be more aseful if the page number of d given
topic was shown in addition to the resolution number (or
section number in the municipal code). Perhaps you could
explain the policy of excluding the page numbers.
It was pointed out that "Volume I" did not appear on the
cover of the binder. 1 explained that the codes of Huntington
Beach would be in four volumes, but that the Administrative
Code was separate from the several volumes of the municipal
code. We will expect the volume number to appear on the
covers of the three volumes of the municipal code.
The page entitled, "Procedure for Drafting, Ordinances",
Included in front of the title page was confusing. We
appreciate the information but ?eel that it is unnecessary
to include a copy of sack page in each copy. Since such
procedure pige is not important to the general public and
detracts from the effect of the title page, we plan to
remove such page and -equest that it not be placed in the
copies of the municipal code.
Perhaps the most importar"; item noted in the Administrative
Code concerns the pain 1 � of future volumes. It is
imperative that the patios of the municipal code be printed
on both sides. We simply do not have the space to handle
a code which would require a doubling of our facilities.

that I only needed one (1) oopy, vhet said I was supposed
to be se�ndina three (3) copiers of everything to Book
Publishing Comp&ny. .
It was tray belie' that I need only send three ; 3) copies
of amendment to the Administrative Code. The City Clerk
�� 28 under the impression that you area also maintaining
�hree3 (3) copies of the Ordinance Code.
If the City Clerk is correct, I do not understand why
you returned to sae a copy of our Ordinance: Coda to which
history notes had been added. Your lea moat of May 10, 1973
suggests that they '-istory notes should be included in ary
% official version we send.

I think the contract is self explanatory. I have included in the
back of the contract sample pages of how the Administrative Code
will be printed. Please review these pages carefully.

Please send another copy of the Huntington. Beach Seal that you
want to have imprinted on the title page to the Administrative
Code. The one you sent had scotch tape over it and, consequent y,
we cannot reproduce it. Also, I would appreciate your sending
copies Iof all muxps to be included in the, Districting and Master
Planning eection of the Administrative Code. The better the copy
we receive, the better the reproduction we can achieve.
I have included in the contract the cast for our legal department
to prepare a pasted -up version of the Administrative Code. I think
it would be wise to do this and I would like to submit it to you
before we a-�tually go into production. The pasted -up version ;could
show you ex.,ctly what we intend to print and would, hopefully, pre-
vent any errors on our part. For instance, Resolution 2724 contains
a certificate signed by Paul Jones. Your instructions did not say
whether we should print the certificate. By pasting up all the
material prior to our actually prepari-.j the manuscript for printing,,
we can provide you w*,.th the copy for your review so that you will
know exactly what we intend to do.

J. a note to advise you of our progress in preparing
our ordinance code for re -codification. I was assigned
an administrative intern three weeks ago, and he has
been �Torkingg on researching the history of each ordin-
ance adopted since 1951 - the date of the last re -codif-
ication. He is pretty well through with that job,
having only Division 9 (Planning) and pa t oi: Division 1
(Governmental structure) yec i..v Uia,
The City Attorney, Bonfa, then wants him to work on some
of his ideas. Bonfa also is assigning a legal student
he has working for h as to do some research on anr_ota-
rions in connection with the ccde. We are pretty well
agreed, I think, that annotations will not be made an
actual part of the code, but will be in a supplemental
volume. When we are finally ready to discuss, the pro-
ject again before it is assigned to you, we will :Hake a
decision on whether maintenance will be done by Book or
by my office.
This will give you a resume ofwhere we stand now on the
re -codification, and we will be in touch again later.
It appears as though we will be eble to supply you copies
of the updated cone soon after the first of the year.

editorial and production departments employ the most modern and
efficient techniques enabling us to provide supplements as often
as desired. We can publish supplements on a weekly, monthly,
quarterly, semiannual or annual basis depending an your needs.
We also have available our exclusive Ordinance Digest system,
which enables our customers to keep their codes up-to-date at
the most economical cost. If we are selected to recodify your
ordinances, I will want to discuss in more detail our various
supplement procedures to assure that you obtain a service that
fits exactly yorr needs and budget.
As noted in our proposal, we do not charge for blank pages. Thia
is an important point. our modern printing facilities include
computerized composition machines and high speed press and bind-
