HomeMy WebLinkAboutBoy Scouts - 1975-02-19o-4 BOY SCOUT CABIN CUSTODIAL MANAGEMENT AGREEMENT THIS AGREEMENT entered into this I%jh day of , 1975, by and between the CITY OF HUNTINGTON BEACH, a municipal corporation, hereinafter referred to as "CITY," and BOY SCOUTS OF AMERICA, TROOP #1, hereinafter called "SCOUTS," W I T N E S S E T H: WHEREAS, CITY has designated "Boy Scout Cabin," hereinafter called "Cabin," located in Lake Park, City of Huntington Beach, as an Historical Landmark by Resolution Number 3795, dated January 21, 1974, and desires SCOUTS to serve as official custodian of "Cabin." WHEREAS, SCOUTS desire to serve as official custodian of "Cabin" and to make use of, occupy, operate, have custodial management, keep in good state of repair, condition and appearance, and keep clean said building. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, the parties agree as follows: 1. "Cabin" is owned by the CITY OF HUNTINGTON BEACH and is located on land which is owned by the CITY so long as the land is used for park purposes. 2. SCOUTS have donated labor, equipment, material and money to renovate said building. 3. Renovation of said building has been completed. 4. SCOUTS shall occupy and maintain and shall serve as DPB/JG:k 2/11/75 1. official custodian of said building and shall make use of, occupy, operate, have custodial management, keep in good state of repair, condition and appearance, and keep clean said building for the duration of this Agreement. Vx1M 5. CITY shall maintain the grounds surrounding said building 6. SCOUTS shall permit and make available the use of said building to other organizations whenever SCOUTS' scheduling permits such use; however, first priority of "Cabin" use shall be given to SCOUTS and other scouting organizations. SCOUTS shall have the responsibility of scheduling use of the "Cabin" and may collect a reasonable clean-up charge from other organizations using "Cabin." 7. CITY shall provide liability insurance for authorized "Cabin" activities, as well as the usual form fire and extended coverage insurance on "Cabin." Proceeds from said fire and `,Z extended coverage insurance shall be used for repairs and/or restoration of "Cabin." 8. This Agreement is contingent upon the Huntington Beach Company consenting to this Agreement and relinquishing for the term of this Agreement any reversionary interest it may have to that portion of the land in Lake Park upon which "Cabin" is erected as a result of this Agreement or the use permitted herein. g. This Custodial Management Agreement is to have effect from and after the date of this Agreement and continuously until Boy Scouts of America, Troop #1, no longer retains its charter and maintains its standing in good order with Boy Scouts of 0 America, Inc. or until terminated, whichever shall first occur. 10. This Agreement can be cancelled by SCOUTS at any time, provided SCOUTS give CITY sixty (60) days prior written notice of such cancellation. 11. This Agreement can`be cancelled by CITY in the event SCOUTS breach any term of this Agreement and fail to correct said breach within sixty (60) days after written notice of said breach. 12. Wentworth City Clerk AMW:cb CITY OF HUNIT1NGT®NI BEACH COUNCIL - ADMINISTRATOR COMMUNICATION HUNTINGTON BEACH To Honorable Mayor and City Council Members Subject BOY SCOUT CUSTODIAL Management Agreement in Lake Park CA 75-11 From City Administrator Date February 13, 1975 Attached for your review and consideration is an agreement between the City of Huntington Beach and the Boy Scouts of America, Troop #1, whereby the City will permit the Boy Scouts of America, Troop #1, to be the official custodians of the Boy Scout Cabin in Lake Park. The City has contributed $500 toward the renovation of the Boy Scout building and the Boy.Scouts of America have donated approxi- mately $25,000 worth of labor, equipment and material toward renovation of this building. The agreement stipulates that if the Boy Scouts of America, Troop #1, no longer retains its Charter and maintains its standing in good order with Boy Scouts of America, Inc., this agreement will be terminated.
