Cook, Director Public Work ';-o Subject: DESIGN OF 1MPFtfJVEt�]TS FOR THE HEIL AVENCTE ITY { I ERK PUMP STATION IMPROVE qTS Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: STATEMENT OF ISSUE: Boyle Engineering Corporation has completed the preliminary design phases of their exist- ing contract with the City for improvements to the Heil Avenue Channel and Drainage Sys- tem. The City wishes to exercise its option within the agreement to authorize Boyle Engineering Corporation to prepare the final design plans and specifications for improve- ments to the system. RECOMMENDATION: 1. Authorize the City to obtain Boyle Engineering Cbrsporation to prepare final design, plans and specifications for improvements to the Heil Avenue Channel System and Pump Station at a cost of $36,150 (per option in existing agreement with Boyle Engineering, dated February 3, 1984). 2. Approve a $20,000 appropriation fron the Unappropriated General Fund balance in Drainage District 5. 3. Approve a $20,000 appropriation from the Unappropriated General Fund balance in Drainage District 5C. ANALYSIS: Boyle Engineering Corporation was retained to analyze the Heil Avenue Channel System and Pump Station and provide preliminary design for improvements to the system. This phase has been completed and was provided to us in a report dated June of 1984. The following is a recap of deficiencies found, recommended improvements and an estimate of cost: 1. Box Culvert at Heil Avenue 2. Heil Avenue Pump Station 3. Storm Drain Systems, N/o Heil, W/o C5-SC3 Channel Storm Drain Systems, S/o Heil, W/o C5-Sc3 Channel 4. City Channel C5-SC3 Reconstruct to increase capacity Add third pump and engine Catch basin reconstruction and additional storm drains Catch basin reconstruction and additional storm drain Reconstruct to increase capacity $ 150,000 $ 140,000 $ 120,000 $ 3.5 million The total cost of all improvements far exceed present available and anticipated funds in the drainage district. An assessment was made to phase the oprovements, consider- ing benefits and costs: The first priority is the reconstruction of the Heil Avenue Box Culvert which presently is restricting channel flow. The second priority is the addition of a third pumping unit at the Heil Avenue \ Pump Station. The third priority is the Storm Drain System modification north and south of l Heil Avenue, West of the C5-SC3 Channel. The fourth priority is the reconstruction of the C5-SC3 Channel. PEC:JM:ik 8 i CONSULTANT AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND BOYLE ENGINEERING CORPORATION FOR ENGINEERING OF HEIL AVENUE CHANNEL AND DRAINAGE SYSTEM IMPROVEMENTS f�. THIS AGREEMENT, is made and entered into this day of �,�,, , 19-?Y , by and between the , CITY OF HUNTINGTON BEACH, a municipal corporation of the State of California, hereinafter referred to as "CITY," and BOYLE ENGINEERING CORPORATION, hereinafter referred to as "CONSULTANT." WHEREAS, the CITY OF HUNTINGTON BEACH previously engaged, by contract dated February 3, 1984, the services of CONSULTANT to provide preliminary engineering services for the Heil Avenue Channel and Drainage System Improvements; and Pursuant to said contract, CITY was granted an option to require CONTRACTOR to perform certain further engineering services; and CITY timely exercised said option and desires CONSULTANT to perform the -further engineering services, NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows: 1. WORK STATEMENT CONSULTANT shall provide the engineering services described in the document entitled Request for Proposal; Upgrading of a Concrete Flood Control Channel anda Concrete Box Culvert, a copy of which is included in, and supplemented by, - 1 - • the document entitled Proposal for Engineering Services, hereinafter referred to as Exhibit "A", as supplemented by the document entitled Proposal for Design of Heil Avenue Channel System and Pump Station Improvements, hereinafter referred to as Exhibit "B". All three (3) of said documents are incorporated, into this Agreement by this reference. CONSULTANT shall complete Tasks 4, 5 and 6 as described in Exhibit "A". CONSULTANT shall also perform Part 1 ("Surveying, Mapping and Utility Investigations") and Part 2 ("Geotechnical Investigation") of Tasks 2 and 3. All of said engineering services shall be performed at the costs specified in Exhibit "An. - CONSULTANT shall attend and assist in all coordination meetings. CONSULTANT shall designate a .registered civil engineer who shall represent it and be its sole contact and agent in all consultations with CITY during fulfillment of the terms of this Agreement. 2. DISPOSITIONS OF PLANS, ESTIMATES AND OTHER DOCUMENTS CONSULTANT agrees that all original drawings, reports, both field and office notes, calculations, maps and other documents, shall be turned over to CITY upon anv termination of PROJECT. CITY shall hold CONSULTANT harmless from any liability arising from the use of these documents for other that the use contemplated by this Agreement. - 2 - 3. INDEMNIFICATION CONSULTANT shall defend, indemnify, save and hold harmless CITY, its officers, agents, and employees from and against any and all liability, damages, costs, loss, claims and expenses of any kind or nature which CITY may sustain or incur or which may be imposed upon them as a result of, arising out of, or in any manner connected with the negligence or willful misconduct of CONSULTANT. CONSULTANT shall be required to defend any action brought against CITY, when it is alleged that any cause or causes of action arose out of the aforesaid negligence or willful misconduct of CONSULTANT or the combined active or passive negligence or willful misconduct of CITY and of CONSULTANT; however, CONSULTANT shall not be required to indemnify or save and hold harmless CITY for any award of damages arising out of either the sole active or passive negligence or willful misconduct of CITY or CITY'S share of any concurrent or joint negligence or willful misconduct award against both CITY and CONSULTANT. CITY may enter into anv action brought against CITY and CONSULTANT and provide for its own defense without any rights to reimbursement for cost of defense from CONSULTANT. In the event a final iudgment is entered against CITY and CONSULTANT because of the concurrent or joint negligence or willful misconduct of CITY and CONSULTANT and the parties defendant cannot agree as to an apportionment of the damages, an apportionment of liability to pay such judgment - 3 - may be requested of the court in which the judgment was rendered, but in no case shall a jury apportionment be demanded or requested. 4. WORKERS' COMPENSATION CONSULTANT shall comply with all of the provisions of the Workers' Compensation Insurance and Safety Acts of the State of California, the applicable provisions of Division 4 and 5 of. the California Labor Code and all amendments thereto; and all similar state or federal acts or laws applicable; and shall indemnify, defend and hold harmless CITY from and against all claims, demands, payments, suits, actions, proceedings and judgments of every nature and description, including attorney's fees and costs presented, brought or recovered against CITY, for or on account of any liability under any of said acts which may be incurred by reason of any work to be performed by CONSULTANT under this Agreement. 5. INSURANCE In addition to the Workers' Compensation Insurance anr? CONSULTANT'S covenant to indemnify CITY; CONSULTANT shall procure the following insurance policies to cover the PROJECT: A. General Liability Insurance. A policy of general public liability insurance, including motor vehicle coverage. Said policy shall name CITY, its officers and employees, while acting within the scope of their duties, as Additional Insureds, for the acts of the insured, and shall provide coverage in not less than - 4 - the following amount: combined single limit bodily injury or property damage of t300;000 per occurrence. Said policy shall specifically provide that any other insurance coverage which may be applicable to the PROJECT shall be deemed excess coverage and that CONSULTANT'S insurance shall be primary. B. Errors and Omissions Insurance. CONSULTANT shall acquire an errors and omissions insurance policy covering the work performed by it hereunder. Said policy shall provide coverage for CONSULTANT'S errors and omissions in an amount of not less that t300,000. Certificates of Insurance for said policies shall be approved in writing by the City Attorney prior to the commencement of any work hereunder. All Certificates of Insurance (and the policies of insurance or endorsements thereof) shall provide that any such Certificates and policies shall not be cancelled or modified without thirty (30) days' prior written notice to CITY. 6. INDEPENDENT CONTRACTOR CONSULTANT is, and shall be, acting at all times in the performance of this Agreement as an independent contractor. CONSULTANT shall secure at its expense, and be responsible for any and all payments of all taxes, social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONSULTANT and its officers, agents and employees and all business licenses, if any, in connection with the services to be performed hereunder. - 5 - 7. CITY STAFF ASSISTANCE CITY shall assign a staff coordinator to work directly with CONSULTANT in connection with the work of this Agreement. 8. PROVISION FOR PAYMENT In consideration of the performance of the above described engineering services, CITY agrees to pay CONSULTANT according to the fee schedule set forth in Exhibit "A", a sum not to exceed thirty six thousand, one hundred and fifty dollars (0 6,150). CONSULTANT will submit to CITY monthly invoices for approval by the Director of Public Works prior to payment. 9. EXTRA WORK In the event of authorization, in writing by the City Engineer of changes from the work as indicated in Exhibit "A" or for other written permission authorizing additional work not contemplated herein, additional compensation shall be allowed for such extra work, so long as the prior written approval of CITY is obtained. 10. TERMINATION OF CONTRACT All work shall be done in a good and workmanlike manner. CITY may terminate CONSULTANT'S services hereunder at any time with or without cause, and whether or not PROJECT is fully complete. Any termination and anv special instructions hereunder from CITY shall be made through the City Engineer, and in writing, which may be delivered in person to CONSULTANT or mailed through the normal course of mail to its now -established business address. In the event this Agreement is terminated, M all drawings, designs, specifications and appurtenant data may be used by CITY. 11. bURATION OF AGREEMENT CONTRACTOR agrees to complete the PROJECT within five (5) months of the execution of this Agreement. 12. Enlargement of the Heil Avenue Box Culvert. 2. Addition of a new 13 foot long catch basin on the east side of the Sunlight Drive -Magellan Lane intersections and addition of a new 24 inch diameter storm drain from the new catch basin to the Heil Avenue pump station. 3. Enlargement of the existing catch basin at the north end of Delton Circle and replacement of the 24 inch diameter portion of the pipeline between Delton Circle and the Heil Avenue Pump Station, with 36 inch diameter pipe. 4. Enlargement of the existing Heil Avenue pump station to include addition of a third engine pump (to be furnished by the City), and discharge line into the channel. This proposal confirms the design costs established in our existing contract with the City dated February 3, 1984. That contract incorporated as Exhibit A, our December 9, 1983 Proposal for Engineering Services (on upgrading of a concrete flood control channel and a concrete box culvert, CC649) and authorized us to proceed with Tasks 1, 2, and 3 (Hydrology, Hydraulics, and Preliminary Design) while excluding surveying, mapping, utility investigation, and geotechnical investigations. These three tasks were completed with submittal of our Technical Memorandum on June 13, 1984. Our contract also provides that upon completion of Tasks 1, 2, and 3, the City shall have the option to authorize us to perform Tasks 4 through 6 (Final Design and Assistance during Bidding and Construction). This option extends for a period of six months Mr. Les Evans -2- June 25, 1984 beyond completion of the work authorized in Tasks 1, 2, and 3 (until December 13, 1984). The method for determining design phase fees has already been established in Exhibit A to our contract. That Exhibit indicates that design fees are to be based on a percent of construction cost using ASCE curve B in ASCE Manual No. 45 (Consulting Engineering) as a guideline. A factor of 0.75 will then be applied to compensate for work completed during the preliminary phase. The exhibit references ASCE curve B, which is applicable to projects of average complexity such as the work being proposed on at that time (upgrading the channel and box culvert). ASCE Manual No. 45 specifically defines pumping station design work as being of above average complexity for which curve A would be applicable. Design Fees In order to establish a design fee, it is necessary to utilize our estimated construction costs for the proposed work (since actual construction costs are indeterminate at this time). Our Technical Memorandum submitted on June 13, 1984 estimated these costs to be $410,000. Of that amount, $270,000 is for the box culvert, catch basin, and storm drain work, and $140,000 is for the pump station work. Therefore, design fees can be determined utilizing ASCE curves A and B as follows: o Design of Box Culvert, Storm Drains, and Catch Basins Estimated Construction Cost $270,,000 Median Compensation in % (Curve B) 7.7% Fee Utilizing 0.75'Factor $ 15,600 o Design of Pumping Station Addition Estimated Construction Cost $140,000 Median Compensation in % (Curve A) 11.0% Fee Utilizing 0.75 Factor $ 11,550 DESIGN FEE SUBTOTAL $ 27,150 Other Design Phase Costs Exhibit A also notes costs for surveying work and a geotechnical investigation of $3,000 and $5,000, respectively. As noted previously, these items were excluded from the earlier City authorization. Both of these services will need to be performed prior to final design of the proposed work. The existing improvement plans (as furnished by the City) for the channel, box culvert, tract storm drain system, and pump station accurately depict existing conditions in the project area. Since none of these plans are marked "Record Drawings" or "As -Built" we cannot be sure of their accurate depiction of existing conditions. 2. Technical specifications, piping requirements, installation instructions, and wiring diagrams for the existing engine to be furnished for the pump station will be provided by the City. It is our intent to request the Waukesha Service Center to provide a quotation on a complete overhaul of the engine and appurtenances. When the job is bid, this quotation would be added to the contractor's bid and made a part of his contract. An alternate bid from the contractor for supplying the exact same overhaul could also be accepted. The lower of the two bids could then be awarded. Existing natural gas/propane service lines and manifold piping are adequately sized to serve the third engine. 4. Such policy insurance shall specifically provide that any other insurance coverage which may be applicable to the loss shall be deemed excess coverage and CONSULTANT'S insurance shall be primary. Therefore, pursuant to Chapter 3.03 "Professional Services" of the Municipal Code, requests for engineering services were mailed to qualified firms listed on the City's professional roster. Requests were received fran four (4) engineering firms. Of the four, Boyle Engineer- ing Corporation submitted the most qualified proposal. Phase I, of their proposal, consists of recommending specific improvements. These reccmTendations will be based on extensive studies of flood control channel needs relevant to existing facilities. Phase II, the cost of preparing plans and specifications for the reccmxended improve- ments, is also included in the Boyle proposal; however, this will not be incorporated into the agreement at this time. FUNDING SOURCE: Adequate fund for Phase I are available in Drainage District 5C. The July 1, 1983 audit report showed an unencumbered balance of $110,704.03. The location of the channel is approximately 600 feet west of Gothard Street and north of Heil Avenue (see Attach. "A"). Tile City's 1979 Master Plan of Drainage discusses the subject channel and concludes that it has adequate capacity to aeccmTcdate the drainage area. Recent review of the 1979 report indicate that an incorrect slope was used for channel analysis and both the channel and the 6 x 10 foot reinforced box culvert under Heil Avenue are inadequate to handle design flows. in addition to the problem of channel capacity, the residents of the subdivision west of the subject flood control channel and north of Heil Avenue are concerne:', that the drainage system serving their neighborhood is inadequate and that floodirg regularly occurs at the intersection of Magellan and Sunshine where curb inlets are located. The inlets discharge to the Heil Avenue pump station which pumps storm water into the adjacent channel. Maintenance personnel report no problems with the pump station even during the heavy storms of January and March, 1983. The scope of work for which proposals are being solicited include: 1. Perform and/or provide all necessary studies and field investigations required to prepare the preliminary plans and working drawings. Project studies shall include: ...a hydrologic analysis of the drainage area tributary to the Heil-Gothard channel and a determination of the capacity necessary to meet the City's design standards; ...an evaluation of the Heil pump station and inlet structure including the preparation of any recommended improvements necessary to accommodate design flows. Based on an approval of the preliminary plans and cost estimates, the engineer shall prepare and provide 40 sets of the: (a) final working drawings (b) contract do=rkents/specifications 5. The engineer shall, during bid advertisement and construction, provide support including interpretation of plans and specifications, review of shop drawings, review of and make reoammendations on change orders. 6. Provide one acceptable set of reproducible "as -built" mylar drawings. (Note: 10% of the contract amount will be withheld until the "as-builts" are submitted and approved.) :7. Furnish $300,000 of errors and omission insurance and all other i-issrances as noted in sample contract. The advertising for bids and awarding of a contract for this project will be admin- istered by City staff.
