Approve change order number 2 for $12,545.00.

While excavati'riV for the Ellis Avenue r"oadw ,.runsuitable soil and

debris were discovered. The Orange County.E.M.A. testing laboratory de--
termined that the unsuitable material be removed and replaced with clean
soil. This change order increased the roadway excavation bid item by
2,509 cubic yards.

of Ellis Avenue improvements (S.P.T.C. R/W to Guthard Street) including
a railroad bridge, highway improvements, water main facilities, and
storm drain system; ail in the City of Huntington Beach, Project CC-250.
The contract was awarded to your firm at the regular meeting of the City
Council, held June 4,1979.
Will you kindly execute the contracts and have all.signatures notarized
on all copies and return to this office, together with the labor and
Materials Bcnd equal to fifty percent (50%) and Performance Bond in
the amount of one hundred percent (100,) of the contract price. Also
enclosed are two sets of a Certificate of Insurar.e in quadruplicate.
This insurance form is the only one that will be accepted by the City
of Huntington Beach. Please return one set with the bonds and executed
contra%lts .
Following approval of the bonds and insurance, the City will execute
the contract and return a copy to you.

Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions:
-Statemen or Issue:
On April 16, 1979, the City Council authorized a call for bids for the
subject project.
Recommended Action:
(1) Accept the low bid and award the contract to Brutoco Engineering and
Construction, Inc., in the amount of $679,169.B2 and reject all other
bids.
(2) Approve the addition of Galland Electric to Brutoco Engineering's
list of subcontractors.
Analysis:
On May 21, 1979, the City received bids for the subject project and the
bids are listed below in order of dollar amount:
1. Brutoco Engineering and Construction, Inc $679,169.82
2, Arnold F. Richter, Contractor $779,045.90
The project was estimated to cost $625,000.00. The 8% difference between
the 'low bid and the engineer's estimate is most likely due to the current
high level of activity in the construction industry and also the unstable
fuel supply situation.
This project includes the construction of the roadway, a railroad bridge,
storm drain, water main, traffic signal, and street lighting. These im-
provements on Ellis Avenue are needed to improve the safety vehicle
response and traffic circulation for the residents in the area.
The project's.specifications require the prime contractor to list his sub-
contractors, but Brutoco Engineering inadvertantly'failed to list his
electrical subcontractor. Attached is a letter from Brutoco Engineering

On May_21,, 1979. our firm submitted a bid and was -the

apparent low bidder on the above project. Unfortunately
it seems that: in the rush to include all the last
minute subquotes I apparently failed to name.the electrical
subcontractor. At the time.of bid I had intended to name
Galland Electric of Buena Park, California and had honestly
thought I had done so. Galland Electric was informed
shortly after the Ji.d that he had been named in the bid.
On May 22 while reviewing the bid results in the Dodge
Construction News I noticed that Galland Electric was not
listed. I called Mr. Bill Patapoff of your office and
Bill confirmed that Galland Electric was indeed not listed.
In order,Ito alleviate this problem I hereby request that
Galland. Electric be added to our list of subcontractors
at this time. Both our firm. and Galland Electric are
looking forward to working with you on this project. I
hope that you will understand my oversite and help to

struction of Ellis Avenue improvements (S.P.T.C. right of way to
Gothard Street) including a railroad bridge�hi hway improvements,
water main facilities, and storm rain ��stem; all in to C jr of

specifications and special provisions on file in the office of the
Director of Public Works. Documents will be available on April 27,
1979. A charge of $25.00, not refundable, will be required for each

Final Pay Quantity
In accordance with the provisions of Section 1773 of the Labor
Code, the State of California, Director of the Department of Industrial
Relations shall. determine the general prevailing rate of wages,
applicable to the work to be done; copies of the latest general wage
rate determinations are on file at the office of the City Clerk and
the office of the Director of Public Worh,s of the City of Huntington
Beach, California.
Plans and specifications, together with proposal form, may be
obtained at the office of the Director of Public Works, City Hall,
Huntington beach, California.
No bid will be received unless it is made on a blank form furnished
by the Director of Public Works. The special attention of prospective
bidders is called to the proposal requirements, setforth in the specifi-
cations, for full directions as to the bidding.

The foregoing quantities are approximate only, being given as a
basis for the c.impa.rision of bids, and the City of Huntington Beach
does not express or by implications agree that the actual amount of
work will correspond therewith but .reserves the right to increase or
decrease the amount of any class or portion of the work, as may be
deemed necessary or expedient by the Director. of Public Works.
All bids will be compared on the basis of the Director of Public
Works astimate of the quantities of work to be done.
No bid will be accepted from a contractor who is not licensed
in accordance with the law, California Business and Professions Code,
Division 3, Chapter 9, Contractors, or to whom a proposal form has
not been issued by the City of Huntington Beach.
Each bid shall be made out on a form to be obtained at the office
of the Director of Public Works, Development Wing, 2000 Main Street,
Huntington Beach, California; shall. be sealed and filed with the City
Clerk at the Civic Center, Second Floor Administration Building,
2000 Main Street, Huntington Beach, California, on or before 10:00 AM
of May 21,_19_7_9., and shall be opened by a committee composed of tie
City Cleric, the City Attorney and Director of Public Works or their
authorized representative and the results of said bidding will be
reported to the City Council of said City of Huntington Beach at
their regular meeting to be held on Monday the 4th of June, 1979, at
the hour of 7:30 PM in the City Council Chambers in the Civic Center
of said City of Huntington Beach,- and shall be acted upon by said
City Council at the regular meeting of June 4, 1.979.
The City of Huntington Beach, California reserves the right to
reject any or all bids, and to accept the bid deemed for the best
in4ere.st of the City of Huntington beach, California.

Ellis Ave. presently terminates on the east side of the Southern Pacific
Railroad. The extension of Ellis Ave, to Gothard St. is necessary to im-
prove vehicular circulation and safety vehiclE response time in the area.

Approve the and s ecifica ions and authorize the call for bids to
construct Ellis Ave. from Gothar St. to the Southern Pacific Railroad.
Analysis:
In 1973 at the request of the City of Huntington Beach, the construction
of Ellis Avanue ffom Gothard St, to the Southern Pacific Railroad was
included in the Orange County Arterial highway Financing Program. The con-
struction of the project has been postponed because of delays in acquiring
the necessary right of way and the required coordination with the railroad
and utility companies. Now that all of the project's requirements have
been accomplished, the necessary roadway between Ellis Ave. and Gothard St.
can be constructed.
On March 29, 1979 the Orange County Environmental Management Agency authorized
the City to advertise this project for construction.
Alternative:
Do not construct the project and continue to have inadequate safety vehicle
response and traffic circulation for the residents in the area.
Funding Source:
Orange County ATIPP Funds: $329,600
City Gas Tax Funds: $374,000
City Water Funds: $ 27,000

Doar Council members:
Transmitted herewith are plans, specifications and Notice
Inviting Sealed Bids for the construction of Ellis Avenue from
Gothard Street easterly to the Southern Pacific Railroad. The
project includes the construction of an underpass to allow Ellis
Avenue to cross beneath the railroad tracks.
The project's Negative Declaration No. 75-2 has been granted
by the City's Environmental Review Committee. The Planning Commis-
sion has found the project to be in c.,nformance with the City's
General Plan.
Cost estimates for the project are as follows:
