GENERAL The work or procedures covered under this schedule consist, in genera.1, of the project work schedules, phasing of work area, and traffic control within or near the project. SECTION IA. PROJECT SCHEDULES A. General The Contractor shall be expected to prepare a detailed schedule of his proposed prosecution of the several locations and varied items of work on this project. This schedule ; shall be written or prepared in chart form and shall be furnished, within seven days after the contract execution, to the Director of Public Works in triplicate for approval. Tha sign fixture shall be designed and constructed to prevent deformation or failure when subjected to wind loads as set forth in the 1968 AASHO publication, "Specifications for the Design and Construction of Structure Suppo.;is for Highway Signs". The sign panel shall not deflect or warp under the above wind loads. If the sign panel is of an arched design, the contour radius shall not be less than 12 feet. All material used in fabrication shall be new and conform to these Specifications. If not covered herein, both the material and workmanship shall be of the best quality consistent with the intended purpose. All steel. parts shall be hot -dip galvanized or :.r cadmium plated, unless otherwise specified herein. 2.6.02 - Brackets The sign shall be hung from a traffic signal mast arm by 2 M free -swinging brackets located approximately 12 inches from ends of sign. At least one bracket shall be adjustbable vertically for leveling to either a straight or curved mast arm. The adjustable bracket assembly shall provide for controlled move- ment by use of bronze bushings so the fixture may saving perpen- dicular to the sign surface to reduce wind load. The bracket hangers shall be firmly attached to the top of the housing. t. Mounting brackets shall be of adequate structural design and shuil be made of galvanized steel or extruded aluminum bar. 2 . G 03 - Ilousing I The housing shall be of extruded or formed aluminum and shall. be rigidly constructed to re.,ist torsional twist and warp. The tole shell of the fixture housing shall have a full length track throughout the length of the assembly for attachment to 11r:1,C - 1.,7 .A V 1 r C M mounting brackets. One end or side shall be hinged to permit insertion or removal of the sign face and access to the electrical, components without the use of tools. With the sign panels in place, the housing shall provide a weatherproof unit for the electrical. component. Reflectors shall be formed aluminum with acrylic baked white enamel having a minimum reflective factor of 86 percent. The design of the reflectors shall be such as to evenly illuminate the entire surface of the sign panels. Gaskets between the sign panel frames and the fixtures housing shall be uniform and oven textured and shall be the closed cell sponge neoprene type. Gasketing shall br; adequate to resist the entrance of water between the frame and fixture housing. Gask,ats shall be neatly applied to thoroughly degreased, clean surfaces with a suitable heat res1stant adhesive which will, not allow the gaskets to slip at a temperature of 160 degrees F. 2.6.04 - Weep Holes Screened weep holes shall be provided at strategic locations in all members subject to the collection of moisture. Weep holes shall be shielded to prevent light spillage from within - he f i.xture . 2.6.05 - Sien Panels Sign panels shall have a ininimum thickness of 0.060-inch a 16,740 PST tensile strength conforming to the requirements of A,STM resignation D 638, and a 16,670 IPSI shear strength conformity to the requirements of ASTM Designation D732. The panels sliall not shatter when a one -inch diameter steel ha7.1 bearing (67) grams is dropped from 8.5 feet anywhere on the sign face with the sign face supported within it's frame. The sign panels may be constructed of any of the following materials: (1) Translucent lens and blue translucent plastic filin laminated together to provide w.aity letters on a blue background. The weather exposed l,.yer of the lens shall be blue translucent film with cut out letters. Translucent lens shell consist of white acrylated resin, glass fiber reinforced, and shall have a thin coat: of poly►vinyl flouride applied to one side of the lens at the time of manufacture. Ballasts shall be listed by UL or Electrical Testing Laboratories for operation on 110/125-volt. 60-Hertz circuits and shall conform to the requirements of ANSA Standards C82.1 and C82.2. Each lamp shall operate from a single lamp ballast. 2.6.08 - Lamoholders High voltage lampholders shall be listed by UL with a rating of 1,000 volts for outdoor use and shall de -energize the primary system of the ballast when a lamp is removed. No live parts shall be -exposed during relamping. Each lampholder shall be! provided with a heat -resistant, circular cross-section, partially recessed neoprene ring to seal against the lamp ends and protect electrical contacts from moisture and dirt or other injurious elements. The distance between the: face of the lampholders for each lamp shall be designed to provide a compression of at least 0.10-inch on the spring -type lampholder when the lamp is inplace. The lamp shall have positive mechanical and electrical contact when the lamp is in place. Where the work is nct sufficiently detailed or clearly shown, the contractor, before proceeding, shall apply in writing for additional details. Any work done by the contractor before receipt of such details, if not in accordance with same, shall be removed and replaced or adjusted, at his own expense. 5-c. Workipl Drawings Working drawings or plans for any structure, item of work, or facility, not included in the plans furnished by the Director , of Public Works shall be approved by the Director: before any work involving these plans shall be performed, unless approval is waived in writing by the Director of Public Works. ,a It is mutually agreed, howeverr that approval by the Director r of the contractor's working plans does not relieve the con- tractor of any responsibility for accuracy of dimensions and details, and that the contractor shall be responsible for agreement and conformity of his working plans with the &pproved plans, and specifications. 5 _d . Conformil:y with Plans and Allowable Deviation Finished surfaces in all cases ahE-.,& conform with the lines, grades, cross-section, and dimensions shown on the approved plans. Deviations from the approved plane, as Tay be required by the exigencies of construction, will be determined in all cases by the Director and authorized in writing. R-e. Coordination of Plans and Specifications These general requirements, specifications, special provisions, they plans, and all supplementary documents are essential parts of the contract, and a requirement occurring on one is as binding as though occurring in all. They are intended, to be coc.:perative, to describe, and to provide for a complete work. Plans shall. govern over specifications. Ins terpretatu.A .ion of Plans and Specifications . Should it appear that the work to be: done, or any matter relative thereto, is not sufficiently detailed or explained in these specifications and plane, the contractor shall apply # to the Director for such further explanations as may be necessary, and shall conform, to such axplanationn or inter- pretation as part of, the contract. The dncisioix of the Director shall be final. 5-g. Inspection The Director or his authorized agent shall at all times have access to the work during construction and shall be furnished with every reasonable facility for ascertaining full know -- ledge respecting Vfte progress of the work., workmanship, and the character of materials ussd and employed in the work. Whenever the contractor varies the period during which work is carried on each day he shall give adequate notice to the Director of Pulic; Works, so that proper inspection may be provided. Any work done on holidays, (holidays defined as those in Ubor Agreements), weekends or unusual hours beyond the normal 40 dour week will rEquire prior approval of the Engineer ana application and fee tar special inspection at contractor's expense (see special forms) unL*ass ordered by the City. Any work cone in the absence of tie inspector will be subject to rejection. The inspention of the work shall not relieve the contractor y of a.ny of his obligation to fulfill the contracts as pre- scribed.. Defective work shall be made goad, and t;isuitable materials may be rejected, not withstanding the f.....t that such defective work and unsuitable materials have been previously accepted or, estimated for payment. The contractor shall prosecute work on any State Highway or within any railroad right of way only in the presence of the inspector representing the State Division of Highways; or the railroad Company and any work done in the absence of said inspector. will be subject to rejection. The con- tractor shall make tl.e appropriate notification according to the instruction given on the State Encroachment Permit or railroad permit for all inspections, and shall post all bonds and Certifications required by the permit. The permit shall be acquired by the City. However, the contractor may also be required to -secure additional permits under his own name, which permits shall be processed at the contractor's expense. The contractor shall pay for all t,sti.ng and inspections required by a State Encroachment .`ermit or a railroad permit. V 5•-h. Removal of defective and, Unauthorized Work All work which is defective in its construction or does not meat all of the requirements of these plaris and/or specifications shalt* • be remedied, or removed and replaced by the contractor in an acceptable manner, and no compensation will be allowed for such correction. i Any work done beyond the limits of the lines and grades shown on the plans or established by the Director of Public Works, or any extra work done without w_Itten authority, will be considered as unauthorized and will not be paid for. Upon failure on the part of the contractor to comply forth- with with any order of the Director made under the provisions of this article, the Director shall have authority to cause defective work to be remedied, or removed and replaced, and unauthorized work to be removed, and to deduct the-- costs thereof from any moneys sue or to become due the contractor. 5-i. Superintendence Whenever the contractor is not present on any part of t'. Control of Materials 6-a. Qualitx of Material Materials shall be new, and of specified kind and quality and fully equal to samples when samples are required. When the j quality or kind of material or articles shown and required under the contract is not particularly specified, the contractor � shall estimate that the City will require articles or mc-terials representing the beat of its class or kind or at least equal to the class or duality of similar articles or materials that are specified. Materials shall be furnished in ample quantities and at such times to insure uninterrupted progress of the work. Same shall be stowed properly and protected as required. The contractor shall be entirely responsible for damage or loss by weather or other cause. 6--b. �.. Samlles and Tests At the option of the Director, the source of supply of each of the materials shall be approved by the Director before delivery is started and before such material is used in the work. Upon request of the Director of Public Works, representative preliminary material samples of the character and quality prescribed shall be submitt,_',d, by the contractor producer or manufacturer of all materials to be used in the � worts, for such testing or examination deemed necessary by th#% i.Arect�ir of Public Works. All tests of materials furnished by the contractor shall be made .in accordance with commonly recogni.7,rid standards of national organization, and such spacial :.-i,thodie and tests as are prescribed in tbsse specifi­,,atIons. No rejected material., the defects of which have been sub- sequently corrected, shall be used until approved in writing by the Director. of Public Works. upon failure on the part of the contractor to comply with any order of the Director of Public Works made under the provisions of this article, the Director of Public Works shall have authority to remove and replace defective material and to deduct the coat of removal and replacement from any monies due or to become due the contractor. 7. Legal Relations and Responsibilities 7-a. General Com 1p` iance with Law The contractor shall keep informed and observe, and comply with, and cause all of his agents and employees to observe - and comply with, all prevailing Federal, State and Municipal Laws Ordinances, Rules and Regulations which in any way affect the conduct of the work of this contract. If any conflict arises between provisions of the plans and specific- ations and any such law above referred for then the contractor shall notify the City at once in writing. The contractor `F shall protect and indemnify the City or any of its officers, agents, and employees against any claim or liability arising from or based on the violation of any such law, ordinance, rule or regulation, whethar by himself or his agents �.mployees . 7-b. Progress _Schedule When, in the judgement of the City; it becomes na.cessary to accelerate the work, the contractor, when ordered, shall cease ' work at any particu?.ar point and concei.trate his forces at such other point or points as directedf and execute such portions of his work as may be required to enable others to hasten and properly engage and carry on their work. 8-b. Working DaZss Every calendar day except Saturdays, Sundays and legal holidays is counted a full working day in fiSuring the working days allowed under L:he contract. No work may be performed on Sundays and holiday:, except: as other wise provided for .y herein. Sec paragraph 2, Section 5-g, page 8. 2-c . 'Labor The contractor shall observe stricly that each and every kind of work shall be performed by workmen? laborers, or mechanics especially skilled in the class of work required and that workmanship shall be of the best regardless of the quality of material. z The contractor shall provide, at all times, sufficient com- petent labor to properly accomplish the work and to insure completion of each part in accordance with schedule and with the time agreed to. The contractor shall retain a competent superintenO_znt to direct" the work constantly during construction and to represent the contractor at all times in coo-.nection with the contract. 8-d. Subletting and Assignment The contractor shall give his personal attention to the fulfillment of the contract and shall keep the work under his control, A� �ij0.il•; P • 1� The specifications are- in '"Schedules" divided and arranged according to various trades. No obligation is inferred to sublet the work as divided, nor is the contractor relieved of fully performing and completing any part of the work. Subcontractors will not be recognized as such, and all persons engaged in the work of construction will be considered as employees of the contractor, and he will be held responsible for their work, which shall be subject to the provisions of the contract and specifications. The contractor submitting a bid for the work, covered by these General Requirements and Special Provisions, shall perform, with his own labor forces or organization, work of a value amounting to not loss than 50 percent of the remainder obtained by subtracting from the total original contract value the sum of any items that may be designated as specialty items in the special provisions. The contractor shall, in his proposal, set forth the name and the location of the place of busi.r..ess of each subcontractor who will perform work or labor or render service to the contractor in or aboutthe construction of the work or improve- inent in an amount in excess of one half of one percent of the contractor's total bid; and shall set forth the description of the portion of the work -vhich will be done by each subcontractor. The contractor agrees that he is fully qualified to perform the balance of all work which is not set forth to be performed by subcontractors, and that he shall perform such balance of work. The contractor further agrees to furnish the City copies of all subcontractors bond: and insurance eerti.fic:atres which have been required by the contractor. Where a portion of the work sublet by the contractor is not being prosecuted in a manner satisfactory to the Director of Public Works, the subcontractor shall be removed imiedia tely on the request of the Director of Public Works and shall not again be employed on the work. Assignment of the obligations and/or duties of the contractor in the whole or any part of the contract shall be made only upon the consent and approval of the City Council of written request by the con.--ractor. 8--e . Pro resii of the Work and Time for CorIpletior. The contractor shall becain Eiork within ten (in) days after receiving notice that tho contract has been executed by the City and shall di.liguntly prosecute the same to completion before the expiration of the time specified in the proposal, specifications, and/or con -tract. Character of Workmen If any subcontractor or person employed by the contractor either fail or refuse to carry out the directions of the Director of Public Works or shall appear to the Director of Public Works to be incompetent or to act in a disorderly or improper manner, he shall be discharged imme--Aately upon request of the Director of Public Works, and such person ir shall not again be employed on the work. 8-g. Temporary Sussp ension of Work, The Director of Public Works shall have the authority to suspend the work wholly or in part, for such period as he may deem necessary, due to unsuitable weather, or to such other conditions as are considered unfavorable for the prosecution of the work, or for such time as he may deem necessary, due to the failure can the part of the con- tractor to carry out orders give, or to perform any provisions of the work. The contractor shall immediately obey all orders of the Director of Public: Works and shall not resume the 1 work until. ordered to do so in writing by the Director of Public Works. 8-h. Time of Completion and Liquidated Damages It is agreed by the parties to the contract that in care all • work called for under the contract is rot completed before or upon the expiration of the time limit as set forth in these specifications, damage will be sustained by the City of Huntington Beach and that it is and will be impracticable to determine the actual. damage which the City will sustain in the event of and by reason of such delay; and it is therefore agreed that the contractor will pay to the City of Huntington Beach the sum of one hundred dollars ($100.00) per ray for each and every day's delay beyond the time prescribed to complete the work, or any approved extension thereof, and the contractor agrees to pay such liquidated damages as herein provided and in case the same are not paid, agrees that the " City of Huntington Beach may deduct thn amount thereof from any money due or that may become due the contractor under the contract. It is further agreed that ir.. case the work called for under the contract is not finished and completed in all Farts and ` requirements within the time spcacified the Director shall have the right to extend the time for completion. If the Director extends the time limit for the completion of the contract, the City shall further have the right to charge to the contractor, his heirs, assigns or is -reties, and to deduct frog, the final payment for the work, all o: any p&rt, as it ' may deem proper, of the actual cost of �nSinearing, inspection, superintendence, and other overhead expensen which are directly chargeable to thm contract, and which accrue during the period of such extension, except that the ,.lost of final surveys and preparation of final estimate shall not be inclulo-d in such charges. The contractor shall not be assessed with liquidation damages nor the cost of engineering and inspection during any delay in the completion of the work caused by acts of God or of public enemy, acts of the City, fire, floods epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe weather or delays of sub- contractors due to such causes; provided, that the contractor shall within ten C107 days fiorr. the beginning of any such delay notify the Director of public Works in writing of the causes of delay. The Director of Public Works shall ascertain the faces and the extent of delay, and his findings of the facts thereon shall be final and conclusive. 8-i. Suspension of a Cash Contract If at any time in the opinion of the City Council the contractor has failed to supply an a,:*.aquate working force, or material of ;.roper quality, or, has failed in any other respect to prosecute the work witli the. diligence ,and force suecif ied and intended by the terms of the contract, notice thereof in writing will be served upor, hint, and should he neglect or refuse to provide means for a satisfactory compliance with the contract, as directed by the Director of Public Works, within the time specified in stich notice, the City Council shall. have the power to suspend the operation of the contract. Upon recei•ir:i.ng notice of such suspension, the contractor shall. discont_i.^ue performance of said work, or such par -: ,a of it as the City Council may designate. Upon such suspension, the contractor's control shall ter- minate and therr:1pon the City Council or its duly authorized representative may take possession of all or any pare of the contractor' materials, tools, equipment and apt liance upon the premises, and use the same for the purpose of completion of said contract., and hire such labor and bul- or rent such additional machinery, tools, appl•ianows, and equipment-, at the contractor's expense as may be necessary for the proper conduct of the work and for the completion thereof, or may employ other parties to carry the contract to completion, or employ the necessary workmen, substitute other machinery or materials, and purchase the materia?.s contracted for by contractor, in such manner as the City Council may deem proper; or the City Council may annul and cancel. the contract and rel et the work or any part thereof. Any excess of cost arising therefrom over and above the contracts price will be charged against the contractor and his sureties, who will be liable therefor, In the event of such suspension, all money due the contractor or rete.ined under the terms of this contract shall be forfeited to the City; but such furfeitu-.•e will not release the contractor or his sureties from liability by failure to fulfill the contract. The contractor shall make his own arrangements, and pay all +expentses for additional area required by him outside of the limits of rights of way. 8-1. Preservation and Cleaning The contractor shall properly preserve and clean the work as it progresses. At regular in::ervals, or when directed, rubbish shall be collected and removed, and at completion the whole work shall be cleaned and all t"oo..s, false work, equ :.pment and rubbish shall be removed from the site, which shall be k left in clean and proper condition as directed. 8--m. Acceptance Should it become necessary, due to developed condition, to occupy any portion of ;:he work before contract: is fully com- pleted, suwh occupancy shall not constitute ac•�eptance. 9. Extra. and Fcrce Account Work Extra work as defined, when ordered and, accepted, shall be paid for under a written change order in accordance with V.ie terms therein provided. All extra work and force accornt shall be recorded daily upon report sheets prepared by the Director of Public, Works and furnished to the contractor and signed by both parties, which daily reports shall thereafter be �onsiclered the true record of extra work or force account work done. 9-b. Progress Payments The City shall, once in each month, cause an estimate in writing to be made by the Director of Public Works of the total amount of work done and the acceptable materials turn:.shed and delivered by the contractor to the job site and not used as of the time of such estimate and the value thereof. The City shall retain money in the amount of ten percent (10%) of the progress payment unless approval of Director for greater percent of such estimated value of the work dons. The City shall retain money in the amount of fifty percent (50%) of the value of the materials so estimated to have been furnished and delivered and anused provided the materials were fabricated specifically for the project. No payment: will be made for standard stock items that have not been incorporated in the work. The City shall monthly pay to the contractor while performing the work, the progress payment balance, after deducting therefrom all previous payments and all sums to be kept or retained under the previsions of the contract. No estimate or payment shall be required to be made when in the judgement of the Director of Publi. Works, the work is not proce_ding in accordance with the provisions of the contract or when .in his judgment the total value of the work done since the last estimate amounts to lass than three hundred dollars ($300). Progress payments shall be submitted to the Departmeant of Public Works on the Monday before each City Council meeting for monthly progress payment or final payment,. City Council meetings are held on the first and third Monday of each month. Progress payment shall also be typed written on form furnished by the City (see forms), 9-c. Final-2 aymeint ...�.
